HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION AMENDMENT NO. 1 TO AGREEMENT NO. C-0-0173 WITH THE ORANGE COUNTY TRANSPORTATION AUTHORITY FOR THE TRAVEL TIP PROGRAM SUMMARY The amendment to Agreement No. C-0-0173 with the Orange County Transportation Authority (OCTA) modifies the completion date of the Travel Tip Program to remain in force until terminated. RECOMMENDATION It is recommended that the City Council approve Amendment No. 1 to Agreement No. C-0-0173 between the Orange County Transportation Agency (OCTA) and the City, and authorize the Mayor and City Clerk to execute the document on behalf of the City. FISCAL IMPACT There is no fiscal impact to the City. OCTA is responsible for all installation, modification and ongoing maintenance costs to administer this program. BACKGROUND In 2000, OCTA developed and implemented the Travel Tip Program that provides traffic information to assist Orange County residents and visitors to plan their trips in and around the county. As part of this effort, the City of Tustin and OCTA entered into an agreement (No. C-0- 0173) in November 2000 to implement the Travel Tip Program. The Agreement allows OCTA to install and maintain traffic data gathering equipment in various City traffic signal controller cabinets. OCTA has installed equipment at the intersections of Jamboree Road/Irvine Boulevard and Newport Avenue/Irvine Boulevard and is currently providing traffic data to travelers in the area. The Travel Tip Program was implemented as a demonstration program and was scheduled to be completed in February 2001. However, due to the success of the program OCTA has decided to continue this program indefinitely. The proposed amendment to the Travel Tip Program Agreement is necessary to remove the previous completion date and extend the program until it is terminated. C-0-0173 .,. · BETWEEN ORANGE COUNTY TRANSPORTATION AUTHORITY AND CITY OF TUSTIN THIS AMENDMENT NO. 1 is made and entered into this day of ,2_002 by and between the Orange County Transportation Authority, a public corporation of the state of California (hereinafter referred to as "AUTHORITY") and the City of Tustin, a municipal corporation in the State of California (hereinafter referred to as "CITY"). WITNESSETH-. ,, WHEREAS, by Cooperative Agreement C-0-0173 dated November 20, 2000, AUTHORITY is the lead agency in the development of a county wide multimodal advanced traveler information system (ATIS), (hereinafter known as "TravelTIP"); and WHEREAS, AUTHORITY has completed development of the TravelTIP system which requires a connection to the city's traffic signal master controller system as a means of collecting arterial traffic information as identified in attachments A, B, and C of original Agreement; and. WHEREAS, CITY agrees to continue to provide AUTHORITY acceSs to the city's traffic signal master controller'system in support of TravelTIP; NOW, THEREFORE, it is mutually understood and agreed that the Agreement No. C-0-0173 between the AUTHORITY and CITY is hereby amended in the following particulars only: Amend Article 3. C-0-0173 ARTICLE 3. MUTUAL AGREEMENTS It is mutually understood by the parties hereto that: A. This agreement shall commence upon execution by both parties and continue in full force and effect unless earlier terminated as provided elsewhere in this agreement. The balance of said Agreement remains unchanged. Upon execution by both parties, this Amendment No. 1 shall be made effective on February 1,2001. IN WITNESS WHEREOF, the parties hereto have caused this Amendment No. 1 to Agreement No. C-0-0173 to be executed on the date first above written.
