BEREFT, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: AWARD OF CONTRACT FOR CARPET PURCHASING, REMOVAL AND INSTALLATION AT TUSTIN AREA SENIOR CENTER (TASC) (CIP NO. 1032) UTILIZING THE CALIFORNIA MULTIPLE AWARD SCHEDULE (CMAS) BID PROCESS SUMMARY Approval of Resolution No. 09-21 will authorize the award of a contract to Shaw Industries, Inc., dba Shaw Strategic Solutions Group for carpet purchasing, removal and installation at Tustin Area Senior Center (TASC) (CIP 1032) using the California Multiple Award Schedule (CMAS) bid process under the General Services Department of the State of California. RECOMMENDATION It is recommended that the City Council approve Resolution No. 09-21 authorizing the award of contract to Shaw Industries, Inc., dba Shaw Strategic Solutions Group for carpet purchasing, removal and installation at TASC (CIP 1032) using the CMAS bid process under the General Services Department of the State of California. FISCAL IMPACT The FY 2008/2009 Capital Improvement Program (CIP) Budget provides $70,000 for replacing the existing carpet at TASC (CIP 1032). The total proposal amount from Shaw Strategic Solutions Group under the CMAS contract is $ 44,024.57. BACKGROUND The FY 2008/2009 CIP budget provides $70,000 for carpet replacement at TASC. The existing carpet was installed with the construction of TASC, approximately 20 years ago, and is in need of replacement. Each year the state bids and awards material and equipment contracts to various contract/suppliers throughout the state. Since the state buys in large volume they are able to receive a lower competitive price for materials and equipment than the City would receive by itself. Staff investigated the CMAS Program and found that Shaw Industries, Inc., dba Shaw Strategic Solutions Group had submitted a competitive proposal for carpet purchasing, removal and installation under that Program. Staff also contacted the staff at the County of Orange and the City of Yorba Linda and found that both agencies have used the CMAS Program successfully for their carpet installation using Shaw Strategic Solutions Group's proposal. Both agencies were extremely satisfied with the product and installation process. Each highly recommended Shaw Strategic Solutions Group for the work. Award of Contract for Carpet Purchasing, Removal and Installation at TASC (CIP No. 1032) Utilizing the California Multiple Award Schedule (CMAS) Bid Process May 5, 2009 Page 2 The City staff also visited the installation site at the County of Orange and was satisfied with the product. Therefore, staff concludes that the most cost effective method to replace the carpet is to utilize the CMAS Program and award the contract to Shaw Strategic Solutions Group. Approval of the attached resolution allows the City of Tustin to utilize the state's purchasing program to replace the carpet as specified at a competitive price without going through the formal bid process. It also authorizes the award of contract for the carpet purchasing, removal and installation at TASC to Shaw Strategic Solutions Group in the amount of $44,024.57. The state charges an additional 2.24% of the total contract as their fees for providing this service. Tim D. Serlet Director of Public Works/City Engineer f,. chl Field ervices Manager Award of contract purchase, remove & install carpet @TASC & Reso 09-21.docx RESOLUTION NO. 09-21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA AUTHORIZING THE AWARD OF CONTRACT TO SHAW INDUSTRIES, INC., DBA SHAW STRATEGIC SOLUTIONS USING THE CALIFORNIA MULTIPLE AWARD SCHEDULE (CMAS) BID PROCESS UNDER THE GENERAL SERVICES DEPARTMENT OF THE STATE OF CALIFORNIA WHEREAS, the City has need to purchase and install various material, supplies and equipment in order to conduct the operations of the City; and WHEREAS, Section 1624, Item C of the Tustin Municipal Code authorized the state of California to purchase materials, supplies and equipment if it can be acquired more cheaply or efficiently by the State; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tustin, California does hereby authorize the award of contract to Shaw Industries, Inc., dba Shaw Strategic Solutions Group for carpet purchasing, removal and installation at TASC using the California Municipal Award Schedule (CMAS) bid process under the Procurement Division, Department of General Services of the State of California and authorize the Mayor and City Clerk to sign and deliver all necessary requests and contract documents for and on behalf of the City of Tustin.
