RESOLUTION NO. 92
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, ORANGE COUNTY, CALIFORNIA
On motion of Councilman Logan, duly seconded
and carried, the following Resolution was adopted:
WHEREAS, the County of Orange now owns, maintains
and operates a Police Broadcasting Station KGHX in the
City of Santa Ana, California, and
WHEREAS, the City of Tustin is desirous of
having a remote control station established in said City
of Tustin and maintained under a licensed supervising
technician of the County of Orange,
NOW, THEREFORE, BE IT RESOIVED AND ORDERED by
the City Council of the City of Tustin in regular session
duly assembled, that the City of Tustin enter into an
agreement with the County of Orange for the establishment,
maintenance and operation of a Police Broadcasting Remote
Control Station, upon the following terms and conditions,
to wi t:
1. The County of Orange agrees to install and
maintain a Police Broadcasting Remote Control Station in
said city of Tustin, to be ooerated bv a telephone line
connection between said Remote Control Station and Police
Broadcasting Station KGHX, under the rules and regulations
of the Federal Communications Commission.
All work and expense of installation and maintenance, except expense
and cost of equipment, materials, apparatus and parts,
shall be borne by the County of Orange. All equipment,
material, apparatus and parts required for installation,
maintenance, replacements and repairs shall be furnished
by and at the expense of the said city of Tustin, and
in acordance with the specifications of the County of
0range.
2. The County of Orange agrees to furnish a
licensed supervising technician, and said Remote Control
Station shall be under the supervision of said licensed
technician, who shall be a radio telepohone operator
first-class.
3. That a telephone line connecting said
Remote Control Station with the Polite Broadcasting
Station KGHX shall be rented by the Parties hereto, and
it is further understood and agreed that one-half of the
rental charge for said telephone line shall be borne
by the County of Orange, andn one-half of the rental charge
for said telephone line shall be borne by the said City of Tustin.
4. Said Remote Control Station or point shall
be in continuous connection with the Broadcasting room of
Station KGHX and the City Police Officers of the said
City of Tustin shall be permitted to broadcasst over the
air at any time the Station is not actually being used
to broadcast messages for other police agencies of Orange
County utilizing said Station.
5. It is further agreed and understood that
any message of local origin or importance shall have
preference, over any "All Point Messages", and the facil-
ities for broadcasting shall be immediately surrendered
to such use upon demand Emergency calls shall always
have preference. In case of a dispute over priority of
emergency messages originating in two departments, the
operator of Station KGHX shall be the final authority in
deciding which emergency message shall have priority,
6. The said City of Tustin proposes to use
said Station for such purposed as may be permitted by the
Federal Communications Commission. The operator on duty
at Station KGHX shall monitor all broadcasting and shall
have the authority to take said Remote Control Station
off the air should any rule or regulation of the Federal
Communications Commission or Federal Commission Act be
violated. The ooerator of Station KGHX shall have no
control over the broadcast from the Police Department of
the said City of Tustin except as explicitly set forth
herein.
7. The said City of Tustin agrees that so long
as this agreement remains in effect said City of Tustin
will not apply to the Federal Communicat'ions Commission
for a license or individual authority to operate a munic-
ipal Police Radio Transmitting Station, and the said City
of Tustin hereby agrees to accept Radio Police Service
over and through Radio Police Station K. GHX, as herein
agreed upon.
AND BE IT FURTHER RESOLVED AND ORDERED
that the Mayor and the City Clerk and ex-officio Clerk of the
City council be, and they are hereby authorized and directed
to enter into and execute for and on behalf of the City
of Tustin, an Agreement with said County of Orange, upon
terms and conditions herein specified.

City Council of the City of Tustin, Orange County, California,
hereby certify that the above and foregoing Resolution was duly and
regularly adopted by the said City Council at a regular meeting
thereof held on the 5th day of September, 1939, and passed by a
unanimous vote of said Board.
