HomeMy WebLinkAboutCC RES 85RESOLUTION NO. 85 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN DETERMINING AND DECLARING THAT WEEDS WHICH BEAR SEEDS OF A WINGY OR DOWNY NATURE AND ATTAIN SUCH A LARGE GROWTH AS TO BECOME A FIRE MENACE WHEN DRY, AND WHICH ARE NOXIOUS AND DANGEROUS, ARE GROWING UPON CERTAIN STREETS, SIDEWALKS AND PRIVATE PROPERTY IN CERTAIN STREETS, SIDEWALKS AND PRIVATE PROPERTY IN SAID CITY OF TUSTIN AND ARE A PUBLIC NUISANCE: DIRECTING THE STREET SUPERINTENDENT TO POST NOTICES TO DESTROY SAID WEEDS AS REQUIRED BY LAW; FIXING THE TIME FOR HEARING OBJECTIONS AND PROTESTS, AND DIRECTING THE ABATEMENT THEREOF IN ACCORDANCE WITH AND ACT OF THE LEGISLATURE OF THE STATE OF CALIFORNIA ENTITLED "AN ACT AUTHORIZING MUNICIPALITIES TO BE PUBLIC NUISANCE, A LIEN UPON THE PROPERTY FRONTING UPON SUCH STREETS OR SIDEWALKS, OR UPON WHICH S~CH NUISANCE EXISTS FOR THE COST OF ABATING THE SAME, APPROVED MAY 26, 1915", AND AMENDMENTS THERETO'. The City Council of the Uity of Tustin do resolve as follows: Ssetion 1. Pursuant to the provisions of an Act of the Legislature of the 8'~ate of California, entitled "An Act Authorizing Nunicipalities to Declare Noxious or Dan- gerous Weeds Growing u~on the Streets or Oidewalks, or upon Private Property within Nunicip~lities to be Public Nuisance; Creating a Lien upon the Property Fronting upon such Streets or Sidewalks or puon which such Nuisance mxists for the Uost · of Abating the Same, Approved ~ay 26, 1915". , and amer~.dments . t~':~ereto, the, Uity ~ouncil of ti-~e City of Tustin hereby determines and declares t~at weeds which bear seeds of a wing¥ or downy nature, or attain such a large g~owth as to beoQ~e a f~e menace when dry and which are noxious and dangerous, are growing upon certain streets, sidewalks and private property in said City, and tl'~at t.i'~e property front- ing such streets or~ sidewalks, or upon which such nuisance exists are particularly described as follows; to-wit: DESCRIPTION OF PROPERTIES AND STREETS HAVING OBNOXIOUS WEEDS ON THEM' L~)T ......... 'A'he Street Superintendent of the ~it¥ of Tustin is hereby instructed to prepare and post notices to destroy said weeds as required by law. Said notices ~hall be so posted at least five (5) days prior to the time for hearing objections and protests by the-City Council of said ~ity, and shall be con- spicuously posted in front of the property on which or in front of which such nuisance exists, and not more than one hundred ~lO0) feet in distance apart, but not less than three (3) inall. Section 3- Said City ~ouncil will hear and consider all obje~tions or protests, if any, to the proposed removal of weeds at its meeting on Nonday, the 15th day of Nay, 1939, at the hour of 8 o'clock P. N. CALIR. Section 2. The Street Superintendent of the City of Tustin is hereby instructed to prepare and post notices to des- troy said weeds as required by law. Said notices shall be so posted at least five (5) days prior to the time for hearing objections and protests by the City Council of said City, and shall be conspicuously posted in front of the property on which or in front of which such nuisance exists, and not more than one hundred (100) feet in distance apart, but not less than three (3) in all. Section 3. Said City Council will hear and consider all objections or protests, if any, to the proposed removal of ~Q,, o weeds at its meeting on Monday, the 15th day of lday, 1939, at the hour of g o'clock P. M.
