SUBJECT: CITY OF TUSTIN RESPONSE TO THE ORANGE COUNTY LOCAL AGENCY
FORMATION COMMISSION SPHERE OF INFLUENCE UPDATE FOR THE
CITIES OF TUSTIN AND ORANGE
SUMMARY
City Council action is requested for the City of Tustin's response to the Orange County
Local Agency Formation Commission's (LAFCO) proposed Sphere of Influence (SOI)
Update for the Cities of Tustin and Orange.
In November 2007, LAFCO slightly modified the Sphere of Influence line for the Cities of
Tustin and Orange in the North Tustin area, with the understanding that the line would be
reviewed again as part of this year's Sphere of Influence update cycle. LAFCO staff has
developed four options, which are scheduled to be considered by their Commission on
June 10, 2009.
RECOMMENDATION:
That the Tustin City Council adopt Resolution No. 09-28, identifying the City's desired
Sphere of Influence boundary.
FISCAL IMPACT:
There are no short term fiscal impacts associated with the potential modification to the
Sphere of Influence boundary. Potential fiscal impacts would typically be evaluated when
considering any future application for annexation to the City of Tustin.
BACKGROUND AND DISCUSSION:
LAFCO establishes spheres of influence to identify the future boundaries and service
areas of both cities and special districts. LAFCO is required to review and update each
Sphere of Influence every five (5) years. Since 1987, four sphere lines have existed in the
North Tustin area. In November 2007, the LAFCO adopted the current Sphere of
Influence line in the North Tustin area, with the understanding that the line would be

reviewed again as part of this year's Sphere of Influence update cycle. The current line
follows a combination of streets, tract boundaries, and property lines.
On February 18, 2009, LAFCO staff presented the proposed Sphere of Influence update
to the North Tustin Advisory Committee (NTAC), which is an advisory board to the Orange
County Board of Supervisors on planning issues in the North Tustin area. The NTAC
voted to support the following:
• 1St Choice — remove Sphere of Influence line in the North Tustin area
• 2nd Choice — place entire sphere area within the Tustin Sphere of Influence
• 3rd Choice — use school district boundaries for the new sphere boundary
On February 27, 2009, City of Tustin staff met with City of Orange staff to discuss the
proposed Sphere of Influence update. Although City of Tustin staff requested an
additional meeting with City of Orange staff to further discuss the issue, the request was
not accommodated. According to City of Orange staff, the City of Orange City Council will
be considering a resolution on May 26, 2009, in support of keeping the existing Sphere of
Influence boundary.
On March 11, 2009, LAFCO staff proposed the following four sphere options, which are
scheduled to be considered by their Commission on June 10, 2009:

• Option B — a Sphere of Influence line following larger roads
• Option C — a Sphere of Influence line following smaller roads
• Option D — a Sphere of Influence line mostly following school district boundaries
Maps depicting these options are included in Attachments A through D. In analyzing
Sphere of Influence boundaries, LAFCO staff may consider factors such as communities
of interest, fiscal impacts, school boundaries, topography, efficient service provision, and
existing development patterns.
The properties affected by Option B, C and D are located within the East Orange County
Water District or Golden State Water Company District. The Orange County Sheriff and
Orange County Fire Authority provide police and fire service to all properties within the
unincorporated Sphere of Influence area. Records indicate that 2,012 households within
the unincorporated area (92705 Zip Code) have registered in the past to participate in
various City of Tustin Parks and Recreation programs with 1,045 residents registering in
the past year, indicating residence affiliation with the City of Tustin.
According to LAFCO staff, utilizing the Tustin Unified/Orange Unified School District
boundary for SOI purposes better defines a community of interest and is superior to
arbitrarily defining a Sphere of Influence boundary using property lines. However, LAFCO

has also recognized that a strict adherence to a school district boundary for SOI purposes
would bifurcate the gated community of Rocking Horse Ridge within both Orange and
Tustin. As noted in the March 11, 2009, staff report to their Commission, LAFCO staff
supports the adoption of Option D, which proposes a slightly modified school district
boundary to include all of the Rocking Horse Ridge community into the City of Tustin's
Sphere of Influence.
Staff requests that the Tustin City Council adopt Resolution No. 09-28 identifying the City's
desired Sphere of Influence boundary.

RESOLUTION NO. 09-28
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, SUPPORTING THE PROPOSED SPHERE OF INFLUENCE
BOUNDARY IN THE NORTH TUSTIN AREA THAT IS IDENTIFIED BY
THE ORANGE COUNTY LOCAL AGENCY FORMATION COMMISSION
AS OPTION .
The City Council of the City of Tustin does hereby resolve as follows:
WHEREAS, the Local Agency Formation Commission (LAFCO) establishes
