RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN APPROVING MEMORANDUM
OF AGREEMENT WITH DEPARTMENT OF PUBLIC
WORKS OF THE STATE OF CALIFORNIA FOR
EXPENDITURE OF ONE-FOURTH CENT GAS TAX
ON STREETS OF MAJOR IMPORTANCE WITHIN
THE CITY OF TUSTIN, DURING THE FISCAL
YEAR ENDING JUNE 30th, 1937, AND
AUTHORIZING THE MAYOR TO EXECUTE THE
SAME FOR AND ON BEHALF OF SAID CITY.
WHEREAS, in accordance with the provisions of Section
194 and Section 195 of the Streets and Highways Code of the
State.of California, the Department of Public Works of the State
of California, acting by and through the Director of Public Works,
shall expend or cause to be expended within the cities of this
State from the State Highway Fund, an amount equal to the net
revenue derived from one-fourth cent per gallon of tax on motor
vehicle fuel,upon Streets of Major Importance other than State
highways, as are agreed upon by the Department and the legis-
lative body of the City, in the proportion that the total popula-
tion of each city bears to the total population of all cities
in this State; and
WHEREAS, in accordance with the requirements of Sec-
tion 196 of the Streets and Highway Code, the City of Tustin
has set up by Ordinance No. 42 a "Special Gas Tax Street Improve-
ment Fund" in which are to be deposited all amounts allocated
pursuant to Section 194 and received by the Oity of Tustin; and
WHEREAS, the City of Tustin has prepared and submitted
to the Department a proposed budget showing the estimated ex-
penditure of such funds re commended to be made during the fiscal
year ending June 30, 1937, as required by Section 197 of the
Streets and Highways Code; and
WHEREAS, the Department of Public Works has submitted
to the City of Tustin for consideration a Memorandum of Agreement
for the expenditure of one-fourth cent gas tax on streets of
Major Importance in the City of Tustin, and it appears to the
City Council of the City of Tustin that said agreement is for the
best interests of said City, and that said City should enter into
and execute the same;

NOW, THEREFORE;
BE IT RESOLVED, by the City Council of the City of
Tustin, acting on behalf of said City, that said City approve,
and it does hereby approve said memorandum of Agreement between
said City of Tustin and the Department of Public Works of the
State of California dated December 21, 1936, relative to the
expenditure of one-fourth cent gas tax on streets of major Impor-
tance within the City of Tustin during the fiscal year ending
June 30, 1937, pursuant to the provisions and requirements of the
Streets and Highways Code of the State of California.
BE IT FURTHER RESOLVED, by the City Council of the City
of Tustin, acting on behalf of said City, that W. M. Huntley, as
Mayor of the City of Tustin, and J. R. Harbour, as City Clerk of
the City of Tustin, be authorized, and they are hereby authorized
and directed to date, sign and execute said Memorandum of Agree-
ment for and on behalf of the said City of Tustin.

1936.
