RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING
MEMORANDUM OF AGREENENT WITH DEPARTMENT
OF PUBLIC WORKS OF THE STATE OF CALIF-
ORNIA, FOR EXPENDNTURE OF ONE-FOURTH CENT
GAS TAX FUND IN THE CITY OF TUSTIN AND AU~
THORIZING THE MAYOR TO EXECUTE THE SAME
FOR AND IN BEHALF OF SAID CITY.
V~HEREAS, under and by virtue of and in s..ccordance
with the provisions of Section 203 of the Streets and Hi.g~-.
ways Code of the State of Cl[lifornia,~lh~"~Department of
Public Works of the State of Califronia ~hall expend, or cause
to be expended, from the State Highway Fund an amount not
less. than the net revenue derived from. one quarter cent per
gallon tax on motor vehicle fuel, on State 'Highways within
cities in the proportion tha~ the tot~al population of each
city bears to the total population of all the cities in this
state, and
WHEREAS, during the biennial ending June 30, 1935,
the said city elected to allow such ~unds to accumulate to
'be used for expenditure upon the State Highway within the
city at a later date; and
WHE~'.EAS, an agr e emant i s now submit t ed t o th e Coun-
cil providing for the further accumulation af Said funds
during the biennial ending June 30, 1937, for expenditure
upon the State Nighway within the City of Tusti~ at a later
date; and it appearing to the City ~:~ounci~ that the' said agree-
ment is for the best interests of said City, and th'~[t the said
City should enter into and execute the same;
NOW, THEREFORE;
BE IT RESOLVED by the City Council of the City of
Tustin~ acting on behalf of said City, that said City. , that
said City approve and it does hereby approve siad memorandum
of agreement between said City of Tustin and the Department
of Public Works of the State of California dated i~arch 2, 1936
relative to the use and expenditure Of the net revenue de-
rived from one quarter cent per gallon tax on meter vehicle
fuel on the State Highway within said City pursuant ct the~
provisions of Section 203 of. the Streets and Highways ~Ode of
the State of California.
BE IT FURTHER RESOLVED by the City ~°Oouncil of the
City of Tustin, acting on behalf of said City, that W. %.
Huntley, as ~ayor of the City of Tud~in, be authorized ~nd
he is hereby authorized and directed to sign and execute
said memorandum of agreement for and o~ behalf of the said ~ity
of Tustin
Passed, approved and adopted this 2nd day of March,
1936.

~YHEREAS, under and by virtue of and in accordance with

from the Stake Highway Fund an amount not less than the net
revenue derived fror~~ one oua.rter cent per gallon tax on motor
vehicle fuel, on State Highways within cities in the nronortion
that the total population of each city bears to the total popu-
lation of all the cities in this state, and
r~HEREAS, during the biennial ending June 30, 1935,
the said c i ty elected to allow such funds to accurma.late to be
used for expenditure upon the State Highway within the city at
a later date; and
:'HEREAS, an agreement i s now subrui tted to the Council
providing for the further accumulation of said funds during the
biennial ending June 30, 1937, for expenditure upon the State
Highway within the City of Tustin at a later date; and it annear-
ing to the City Council that tl~e said agree°aent is for the best
interests of said City, and that the said City should enter ir_to
and execute the saaae;

said City of Tustin and the Department of Public Yorks of the
