RESOLUTION CONCERNING DISTRIBUTION OF THE SUM
OR SUMS ACCRUING TO ORANGE COUNTY FROM THE
MOTOR VEHICLE FUEL TAX ACT, THE VEHICLE TAX
ACT, AND THE GROSS TRANSPORTATION RECEIPT ACT.
WHEREAS, under provisionS of the Motor Vehicle Fuel Tax
Act, the Vehicle Tax Act, the Gross Transportation Receipts Tax
Act the State of California collects large sums of money annually
which are divided between the counties of the State of California
according to the Provisions of.said acts, and
,
WHEREAS, the sum or sums ng to Orange County under
these said acts is a sizeable sum amounting to approximately
$364,000 in 1929-30, & $385,000 in 1930-31, and $336,000 in
1931-32; which sum was originally and is now intended to be used
for 't'he expressed purposes as provided in the respective acts and

especially to make .possible the construction and maintenance of
county and city roads, or systems, adapted to present traffic
requirements and to do so from funds raised from the use of such
road system or systems, and. in such a manner as not to assess
property with TAX .BuHD~s beyond the benefits derived and

PROPERTY,S ability to pay; and
WHEREAS, notwithstanding these large annual sums
collected and accruing to Orange County from said funds, the
cities of Orange County have not received an equitable distri-
bution of these funds and have carried an unduly large proportion
of the cost of construction and maintenance of streets for thru
traffic; and likewise the unincorporated area has been burdened
with a special tax, known as the 40-CENT ROAD TAX, long after the
Justification for such a special tax burden has been passed,
N0W, THEREFORE, BE IT RESOLVED, that the City Council
of the City of Tustin respectfully petition the BOARD OF SUPER-
VISORS 0F 0RANGE COUNTY to allow to the cities of 0range County

according to a plan to be agreed, upon by and between the Board
of Supervisors and a special committee, consisting of the Mayors
of Orange County cities, 32 1/2% of the sum or sums accruing to
Orange County from said above referred to state road funds,
which shall be used by the cities, of Orange County for the con-
struction and maintenance on designated city streets, that are
connecting links with thru county or state roads; provided how-
ever, that in any particular year, in any city, the designated
streets, connecting links with thru county, roads, do not require,
for construction and maintenance purposes, all of the moneys so
alotted to that particular city or cities, then other streets
shall be designated, to receive such aid for that particular year,
providing that such allotments and the expenditure thereof, shall
in all instances, conform to the provisions of said above
referred to Acts; and
BE IT FURTHER RESOLVED, that the remaining 67 1/2%
and maintenance purposed to designated roads in the unincorporated
area, which form connecting links in the thru county road system;
provided however that in any particular year should these designated
roads not require, for construction and maintenance purposes, all of
the monies so allotted to them, then the sum over and above the required
amounts may either be accumulated as a reserve for future use on said roads,
or spent, in the unincorporated area, on other roads to be designated by
the Board of Supervisors, providing that such allotment and the
expenditure thereof in unincorporated areas shall in all instances
conform to the provisions of said above referred to Acts; and
BE IT FURTHER RESOLVED THAT, since the 40 - CENT
ROAD TAX represents an unfair tax burden upon the unincorporated
area which was supposed to be relieved thru the receipt of the the 40-C~NT ROAD

above referred to sum or sums from the said Acts, that we
respectfully request the Board of Supervisors to reduce the
said 40-CENT ROAD TAX to 10-CENTS PER $100 assessed valuation,.

duly and regularly introduced and passed by the City Council

WfiEREAB, under provisions of the Motor Vehicle Fuel Tax
Act, the Vehicle Taac Aat, The Grosa Transportation Receipts Tax
Act the State of California collects large sums of money annually
which are divided between the counties of the State of California
according to the provisions of said acts, and
AHEREAS, the sum or sums accruing to Orange County under
these said acts is a sizeable sum amounting to approximately
X354,000 in 1929-30, X355,000.00 in 1930-31, and X336,000 in
1931-32; which sum was originally a.nd is now intended to be used
for the expressed purposes as provided in the respective acts an
especially to make possible the construction and maintenance of
county and city roads, or systems, adapted to present traffic
requirements and to do so from funds raised from the use of sudz
road system or systems, and in such a manner as not to assess
property with TAX BURDENS beyond the benefits derived and
PROPERTY'S ability to pay; and

NOW, THEREFORE, BE I T RESOLVED, that the City Counci 1
of the City of Tustin respectfully petition the BOARD OF SUPER-
VISORS OF ORANGE COUNTY to allot to the cities of Orange County

the sum over a.nd above the required amounts may either be
a.ccummulated as a reserve for future use on said roads, or spent,
in the unincorporated area, on other roads to be designated by
the Board of supervisors; providing that such allotment and the
expenditure thereof in unincorporated areas shall in all in-
stances conform to the provisions of said above referred to

above referred to sum or sums from the said Acts, that we

said 110-CENT ROAD TAR to 10-CENTS PER X100 assessed valuation.
