RECOMMENDATION
That the Zoning Administrator adopt Zoning Administrator Action (ZAA) 09-003
approving Conditional Use Permit (CUP) 08-021.
BACKGROUND
The applicant is requesting approval to provide educational/tutoring services at a tenant
suite in an existing office building located at 17802 Irvine Boulevard (Attachment A -
Location Map).
While educational/instructional facilities are not a listed use in the Retail Commercial (C-
1) zoning district, the use is listed as a conditionally permitted use in other commercial
districts such as the Professional (Pr) district, Central Commercial (C-2) district, and
Commercial General (CG) district. Tustin City Code (TCC) Section 9232a states that
unlisted uses which in the opinion of the Community Development Director are resolved
to be similar will be allowed in the Retail Commercial district. In a January 2009 Use
Determination, the Community Development Director determined that this type of use
would be appropriate in the Retail Commercial (C-1) zoning district subject to a use
permit. The Tustin General Plan land use designation of Professional Office allows for
a variety of general and professional office uses, business support services, and
supportive commercial uses such as public service uses and public/institutional
facilities.
Pursuant to Tustin City Code (TCC) Section 9299b(3)(e), the Zoning Administrator is
authorized to consider requests for minor conditional use permits for existing
development where there would be no change of occupancy or primary use, no
expansion of floor area, and .the request does not alter the original intent of the
project/site. The proposed project meets all criteria to merit Zoning Administrator review
of Conditional Use Permit 09-003.
DISCUSSION
Site and Surrounding Properties
The project site is an approximately 43,560 square foot lot located on Irvine Boulevard
east of Prospect Avenue. The site is currently improved with atwo-story office building
that was built circa 1972. The subject property and the adjacent mirror-image property at
17842 Irvine Boulevard make up an office complex known as Tustin Business Center.
The property is zoned Retail Commercial (C-1), where professional ofFces are permitted
outright. The Tustin Business Center is surrounded by other professional office buildings
directly to the west and by Planned Development (residential) directly to the east
(Palmwood Gardens) and the south (Prospect Park). Columbus Tustin School and Park
are located to the north across Irvine Boulevard (see Figure 1 -Surrounding Zoning
Districts).

The applicant is proposing to operate an education/tutoring facility in Suite 225 (a 2,157
square foot tenant suite) on the second floor of the subject property (Attachment B -
Submitted Plans). The tenant/applicant is currently authorized to operate an office for the
consulting business from the subject suite. No tenant improvements or physical changes
are proposed in association with this application. The business plan submitted by the
applicant indicates that XL Learning Center specializes in tutorial services for school
subjects, service in essay writing, SAT preparation, and college admissions consulting.
According to the submitted business plan, the typical number of persons in the facility at
one time is 1-2 staff and 4-6 students (see Attachment B). This is consistent with the
maximum permitted occupancy proposed in Condition 2.1, which is based on the amount
of available parking. Proposed Condition 2.2 requires each class to conclude with
sufficient time for attendees of the prior class to vacate the site prior to arrival of
attendees of the next class. Since the facility will serve school children, the applicant is
proposing different business hours during the school year and school holidays (summer,
winter break, spring break). The proposed business hours are as follows:

Parking
The project proposal is to operate an instructional facility at an existing office building.
The subject property is located in the Combining Parking Overlay District (C-1 P). Per
Tustin City Code Section 9263G, offices (administrative, corporate) in the Parking
District require one (1) space for each 300 square feet of gross floor area, and
instructional uses require one (1) space for every three (3) students at maximum
capacity of each classroom, plus one (1) space for each faculty member and employee.
Since the facility will be located at an existing development, the amount of available
parking will dictate the maximum enrollment at any given time. So, at a ratio of 1/300,
the subject 2,157 square foot tenant suite would be allotted seven (7) parking stalls on
site. The maximum number of instructors/staff members and students permitted in the
facility at any given time will be limited based on the seven (7) available stalls, as
follows:
• Two (2) instructors or staff members AND fifteen (15) students; OR
• Three (3) instructors or staff members AND twelve (12) students; OR
• Four (4) instructors or staff members AND nine (9) students; OR
• Any combination thereof using the ratios of one (1) parking space/instructor or
staff member and one (1) parking space/three (3) students.
Therefore, as conditioned, the existing parking provided on-site is sufficient to
accommodate the proposed instructional facility.
ANALYSIS
In determining whether to approve the Conditional Use Permit, the Zoning Administrator
must determine whether or not the proposed use will be detrimental to the health,
safety, morals, comfort, and general welfare of the persons residing in or working in the
neighborhood or whether it will be injurious or detrimental to property or improvements
in the vicinity or to the welfare of the City.
A decision to approve this request may be supported by the following findings:
1. The Community Development Director determined that tutoring/instructional
facilities are permitted in the C-1 zoning district subject to approval of a conditional
use permit.
2. No physical changes or tenant improvements are proposed in conjunction with
this application.
3. As conditioned, sufficient parking for the use is ensured by limiting the maximum
number of faculty/staff members and students at the facility at any given time.

4. As conditioned, the tutoring facility would generally operate between the hours of
8:00 a.m. and 10:00 p.m., which is consistent and compatible with the hours of
operation for other commercial uses in the area.

XL Learning Center aims to prepare its students to excel as young leaders of tomorrow by combining tutorial service
for school subjects as well as specialized service in essay writing and SAT preparation to meet the requirements to
compete for entrance in prestigious colleges and universities. It also offers specialized college consulting and
provides bi-annual seminars for the community regarding current college requirements and financial information
necessary to attend college. XL Learning Center has made its services available to the local high schools that may
need an outside professional to speak to its students regarding the current conditions of successful admissions to
colleges/universities.
XL Learning Center is a privately held corporation run by its owner, Anna Kim who has 20 years experience as an
education consultant/ private instructor and 7 years experience successfully operating XL Learning Center at 910 E.
Birch Street, Suite 380, Brea, California 92821. The second proposed site is at 17802 Irvine Blvd, Suite 225, Tustin,
California 92780. The facilities are open Monday through Thursday 3:00 PM to 10:00 PM, Friday from 3:00 PM to
8:00 PM, and Saturday from 8:00 AM to 6:00 PM during the school year. Eight week summer sessions will have
extended hours from 8:00 AM to 10:00 PM. Students ire dropped off at the front of the facility and picked up by the
parents at the end of the class. Parents are requested to call their child when they have arrived at the parking
structure and are encouraged to carpool whenever possibl; .
With competition to enroll in colleges continuing to rise each year, the average student has to excel in not only his
grades, but in his SAT test scores. This trend has created a need for quality college-preparatory services. XL
Learning Center will focus on communities within the 10 mile radius of the facility. Our target customers are middle-
class to upper-class families who value the quality of education we provide for their children grade levels 6 to
12.According to city statistics, the average communities within the 10 mile radius have 26+% of population of those
under 18 years of age and adult residents who have college education are above the current state population level.
This leads us to anticipate expanding market potential for this industry in our local area. Price, service, and reputation
are critical success factors in the child care services industry. XL Learning Center will compete well in our market by
offering competitive prices, high-quality educational services, and leading-edge educational progPams with college-
degreed instructors, and by maintaining an excellent reputation with parents and the community we serve.
We had planned to be open for business on June 11, 2008, but due to incorrect information through the management
of the building, a permit with the city was rejected and a aw permit requiring a Conditional Use Permit (CUP) was
submitted. Depending on the approval of the CUP by the city of Tustin, we will revise our plans for the opening of the
business. We project healthy revenues by the end of the first year; we anticipate a net profit within our first summer
term. Our biggest operating expenses will be compensation at industry standard rates for our highly-qualified
personnel, and rent on our facilities, improved for our purposes during the start-up period. Growth is planned
conservatively, to be financed from existing cash flow as we go.
XL Learning Center is committed to taking a leadership role in, higher learning, community services and promoting
leadership and responsibility in its students. XL Learning Center directs its activities towards student success.

The Zoning Administrator of the City of Tustin does hereby resolve as follows:
The Zoning Administrator finds and determines as follows:
A. That a proper application for Conditional Use Permit (CUP) 08-021 was
filed by Anna Kim of XL Learning Center requesting authorization to
establish an educational/tutoring facility in Suite 225 of an existing two-story
office building located at 17802 Irvine Boulevard.
B. That the proposed land use is consistent with the Tustin City Code and
General Plan. The site is zoned Retail Commercial with Combining
Parking Overlay (C-1 P) where instructional schools are conditionally
permitted and the land use is designated by the General Plan as
Professional Office, which allows for general and professional office uses,
business support services, and supportive commercial uses such as public
service uses and public/institutional facilities. The project is consistent with
the Air Quality Sub-element of the City of Tustin General Plan.
C. That pursuant to Tustin City Code (TCC) Section 9299b(3)(e), the Zoning
Administrator is authorized to consider requests for minor conditional use
permits for existing development where there would be no change of
occupancy or primary use, no expansion of floor area, and the request
does not alter the original intent of the project/site. That the proposed

safety, morals, comfort, or general welfare of the persons residing or working
in the neighborhood of such proposed use, nor be injurious or detrimental to
the property and improvements in the neighborhood of the subject property,
or to the general welfare of the City of Tustin in that:
1) The Community Development Director determined that
tutoring/instructional facilities are permitted in the C-1 zoning district
subject to approval of a conditional use permit.
2) No physical changes or tenant improvements are proposed in

II. The Zoning Administrator hereby approves Conditional Use Permit 08-021
granting authorization to establish an educational/tutoring facility in Suite 225 of an
existing two-story office building located at 17802 Irvine Boulevard, subject to
conditions attached hereto.

CONDITIONS OF APPROVAL
GENERAL
(1) 1.1 The proposed project shall substantially conform with the submitted plans
for the project date stamped on the date of approval, on file with the
Community Development Department, as herein modified, or as modified
by the Director of Community Development in accordance with this
Exhibit. The Director of Community Development may also approve
subsequent minor modifications to plans during plan check if such
modifications are consistent with provisions of the Tustin City Code.
(1) 1.2 This approval shall become null and void unless the use is established
within twelve (12) months of the date of this Exhibit. Time extensions may
be granted if a written request is received by the Community Development
Department within thirty (30) days prior to expiration.
(1) 1.3 All conditions in this Exhibit shall be complied with prior to the start of
classes or as specified, subject to review and approval by the Community
Development Department.
(1) 1.4 Approval of Conditional Use Permit 08-021 is contingent upon the
applicant and property owner signing and returning to the Community
Development Department a notarized "Agreement to Conditions Imposed"
form and the property owner signing and recording with the County Clerk-
Recorder a notarized "Notice of Discretionary Permit Approval and
Conditions of Approval" form. The forms shall be established by the
Director of Community Development, and evidence of recordation shall be
provided to the Community Development Department.
(1) 1.5 Any violation of any of the conditions imposed is subject to issuance of an
Administrative Citation pursuant to Tustin City Code Section 1162(a).
(1) 1.6 The applicant shalt be responsible for costs associated with any
necessary code enforcement action, including attorney fees, subject to the
applicable notice, hearing, and appeal process as established by the City
Council by ordinance.

(1) 1.7 As a condition of approval of Conditional Use Permit 08-021 the applicant
shall agree, at its sole cost and expense, to defend, indemnify, and hold
harmless the City, its officers, employees, agents, and consultants, from
any claim, action, or proceeding brought by a third party against the City,
its officers, agents, and employees, which seeks to attack, set aside,
challenge, void, or annul an approval of the City Council, the Planning
Commission, or any other decision-making body, including staff,
concerning this project. The City agrees to promptly notify the applicant of
any such claim or action filed against the City and to fully cooperate in the
defense of any such action. The City may, at its sole cost and expense,
elect to participate in defense of any such action under this condition.
USE RESTRICTIONS
(***) 2.1 The maximum number of students and instructors within the facility at any
given time shall be as follows:
• Two (2) instructors or staff members AND fifteen (15) students; OR
• Three (3) instructors or staff members AND twelve (12) students; OR
• Four (4) faculty or staff members AND nine (9) students; OR
• Any combination thereof using the ratios of one (1) parking
space/instructor or staff member and one (1) parking space/three (3)
students.
Any request to modify the maximum number of students and/or instructors
shall require the applicant to provide property owner permission, a parking
summary of the site showing the additional parking spaces, and shall be
subject to the Community Development Director approval.
(1) 2.2 Each class shall be concluded with sufficient time for attendees of the
prior class to vacate the site prior to arrival of attendees of the next class.
(***) 2.3 Hours of operation are limited to the following:
• Monday -Saturday: 8:00 a.m. to 10:00 p.m.
• Sunday: Closed
The hours may be modified administratively subject to review and
approval by the Community Development Director if it is determined that
no impacts to the surrounding tenants or properties would occur.
(1) 2.4 All activities shall comply with the City's Noise Ordinance.
(1) 2.5 If a parking problem is observed by a representative of the City, the
applicant shall submit a study prepared by a traffic engineer and perform

or install interim and permanent mitigation measures to be reviewed and
approved by the Community Development Department.
(1) 2.6 If the use is wholly discontinued for any reason for a period of one (1) year
or more or replaced with a different permitted or conditionally permitted
use, the use shall be conclusively presumed to be abandoned and any
future tutoring facility in the subject space would require a new conditional
use permit. The year shall not include time of discontinued use due to a
valid order of a court of law or due to building repair under a building
permit.
FEES
(2) 3.1 Within forty-eight (48) hours of approval of the subject project, the
applicant shall deliver to the Community Development Department, a
cashier's check payable to the COUNTY CLERK in the amount of fifty
dollars ($50.00) to enable the City to file the appropriate environmental
documentation for the project. If within such forty-eight (48) hour period
the applicant has not delivered to the Community Development
Department the above-noted check, the statute of limitations for any
interested party to challenge the environmental determination under the
provisions of the California Environmental Quality Act could be
significantly lengthened.

The Zoning Administrator of the City of Tustin does hereby resolve as follows:
I. The Zoning Administrator finds and determines as follows:
A. That a proper application for Conditional Use Permit 09-007 was filed by
Roland and Osbelia Guerra of Rollie's Bakery, requesting authorization for
on-site alcoholic beverage sales for beer and wine (ABC License Type "41 ")
in conjunction with an existing bona fide restaurant located in a 1,819
square foot tenant space with twenty-one (21) seats at 14071 Newport
Avenue.
B. That the proposed land use is consistent with the Tustin City Code and
General Plan. The site is zoned Planned Community Commercial (PCC)
where restaurants are permitted and alcoholic beverage sales
establishments are conditionally permitted pursuant to Ordinance No.
1230. The General Plan land use designation is Community Commercial,
which allows for a variety of retail, office, and service-oriented businesses.
The project is consistent with the Air Quality Sub-element of the City of
Tustin General Plan.
C. That per Section 9299b(3xf) of the Tustin City Code, the Zoning
Administrator has the authority to consider requests for on-site alcoholic
beverage sales licenses for restaurants.
D. That a public hearing was duly called, noticed, and held on said application
on May 18, 2009, by the Zoning Administrator.
E. That the establishment, maintenance, and operation of the use applied for
will not, under the circumstances of this case, be detrimental to the health,
safety, morals, comfort, or general welfare of the persons residing or
working in the neighbofiood of such proposed use nor be a detriment to
the property and improvements in the neighborhood of the subject
property, nor to the general welfare of the City of Tustin as evidenced by
the following findings:
a. The proposed sale of on-site beer and wine is allowed within the
Planned Community Commercial (PCC) zoning district with the
approval of a Conditional Use Permit.
b. As conditioned, the proposed on-site consumption of beer and wine is
consistent with the Alcoholic Beverage Sales Establishment Guidelines
as amended by the Planning Commission and adopted by the City
Council on May 21, 2001.

c. The on-site consumption of alcoholic beverages would be in conjunction
with a restaurant where food will be served at all times when alcoholic
beverages are served. As conditioned, no ancillary bar use would be
allowed at the subject location.
d. Bona fide restaurants with on-site alcoholic beverage sales are exempt
from distance separation requirements to residential uses, sensitive
uses, and other alcoholic beverage sales establishments.
e. The restaurant use is located within a retail center and a commercial
corridor along Newport Avenue where a variety of retail, office, and
restaurant uses are located. The characteristics of the restaurant use
and hours of operation of the restaurant would be similar to other
restaurants in the center and in the vicinity.
f. The 21-seat restaurant complies with the parking requirements originally
established for the site in CUP 89-47.
g. The Tustin Police Department has reviewed the application and has no
immediate concerns.
D. This project is Categorically Exempt pursuant to Section 15301, Class 1
(Existing Facilities), Title 14, Chapter 3, of the Califomia Code of
Regulations (Guidelines for the Califomia Environmental Quality Act).

"41 ") in conjunction with the existing 1,819 square foot restaurant (Rollie's Bakery
and Mexican Cafe) located at 14071 Newport Avenue, subject to the conditions
contained within Exhibit A, attached hereto.
