A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, AUTHORIZING THE SUBMITTAL
OF SUBSTANTIAL AMENDMENTS TO THE PROGRAM
YEAR 2008-09 ACTION PLAN FOR THE USE OF THE
CITY'S ALLOCATED CDBG-R FUNDS TO THE
DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT (HUD); AUTHORIZING THE DIRECTOR
OF PUBLIC WORKS TO PREPARE THE PLANS AND
SPECIFICATIONS FOR THE NOTED PROJECTS; AND
AUTHORIZING THE ADVERTISEMENT FOR BIDS
The City Council of the City of Tustin does hereby resolve as follows:
WHEREAS, under the Housing and Community Development Act of 1974, as
amended, Federal assistance may be provided for the support of community
development activities which are directed toward certain specific objectives as set forth
in the Act as the Community Development Block Grant (CDBG) Program;
WHEREAS, on February 17, 2009, the American Recovery and Reinvestment
Act of 2009 (ARRA) was signed into law by the President;
WHEREAS, the purpose of the ARRA is to stimulate the economy through
modernizing infrastructure, improving energy efficiency, and expanding educational
opportunities and access to health care;
WHEREAS, The ARRA appropriated $1 billion to the Department of Housing and
Urban Development (HUD) Community Development Block Grant Recovery (CDBG-R)
program, a grant program created specifically for the use and management of the
appropriated recovery funds;
WHEREAS, the City of Tustin has been allocated with $216,643 of CDBG-R
funds;
WHEREAS, HUD requires the City to prepare a substantial amendment to the
City's Community Development Block Grant (CDBG) 2008-09 Action Plan reflecting how
the City plans to use the CDBG-R funding and meet the goals set by the ARRA;
WHEREAS, The amendment is subject to a seven (7) day public review and
comment period beginning on May 21, 2009, and ending on May 27, 2009;
WHEREAS, the use of the CDBG-R funds must be expended expeditiously and
the activity funded should be project-ready orground-ready;

NOW THEREFORE BE IT RESOLVED, the City Council of the City of Tustin
resolves as follows:
Section 1: Staff is authorized to submit the substantial amendments to the PY
2008-09 Action Plan for the use of the City's allocated CDBG-R funds to the Department
of Housing and Urban Development (HUD) for the following projects:
• Tustin Area Senior Center Heating, Ventilating, and Air Conditioning
(HVAC) improvements - $140,000
• Tustin Area Senior Center Flooring - $56,643
• Tustin Area Senior Center Wall Covering improvements - $20,000;
Section 2: The Director of Public Works is authorized to prepare the plans and
specification for the noted projects.
Section 3: Staff is authorized to advertise bids, if applicable.
Section 4: The Director of Community Development is authorized to execute
such documents, certifications, contracts, or other instruments as may be required to
carry out the CDBG-R Program.
PASSED AND ADOPTED by the City Council of the City of Tustin at a regular
meeting on the 19th day of May, 2009. ~ ~
