BEREFT, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: CONTINUE PUBLIC HEARING TO CONSIDER APPROVAL OF THE SOLID WASTE RATES TO JULY 7, 2009 SUMMARY Staff is requesting the City Council to continue the public hearing to consider adjustments to solid waste rates from June 2, 2009 to July 7, 2009. RECOMMENDATION Staff recommends that the City Council continue the public hearing to July 7, 2009. FISCAL IMPACT There is no fiscal impact associated with this item. BACKGROUND The City Council previously set a public hearing to consider an adjustment to solid waste rates for June 2, 2009. Proposition 218 requires that a mailed public notice of proposed fee increase be provided to property owners no less than 45 days in advance of a public hearing to consider the increase. The property owner notice for the increase in solid waste rates did not provide for the required 45 day period and a second notice which complied with the Proposition 218 requirement was mailed on May 15, 2009.
