REQUEST: TO AMEND CONDITIONAL USE PERMIT 94-021 TO INCREASE THE MAXIMUM ALLOWABLE SQUARE FOOTAGE OF OFFICE SPACE FROM 115,500 SQUARE FEET TO 142,900 SQUARE FEET WITHIN THE EXISTING BUILDINGS AT THE TUSTIN BUSINESS CENTER. RECOMMENDATION That the Planning Commission: 1. Adopt Resolution No. 4117 adopting the Final Negative Declaration as adequate for an Amendment to Conditional Use Permit 94-021 to increase the maximum allowable square footage of office space. Planning Commission Report Amendment to CUP 09-021 June 9, 2009 Page 2 2. Adopt Resolution No. 4118 approving an Amendment to Conditional Use Permit 94- 021, authorizing an increase in the maximum allowable square footage of office space from 115,500 square feet to 142,900 square feet within the existing buildings at the Tustin Business Center located at the southerly corner of Red Hill Avenue and Edinger Avenue. BACKGROUND Pursuant to Tustin City Code Section 9242(b), uses which maintain greater than fifty (50) percent of their gross floor area for office purposes in the Industrial (M) Zoning District are authorized subject to a conditional use permit. On October 17, 1994, the Zoning Administrator approved Conditional Use Permit 94-021 to authorize the establishment of uses that have more than 50 percent of their floor area devoted to office use at the Tustin Business Center located at the southerly corner of Red Hill Avenue and Edinger Avenue (Attachment A — Location Map). One of the conditions of Conditional Use Permit 94-021 limited the square footage of office space to a maximum of 115,500 square feet, provided there is adequate on-site parking. The types of office uses permitted by Conditional Use Permit 94-021 in the Tustin Business Center include general offices, medical offices, professional offices, administrative offices, and offices in conjunction with other permitted uses. The Tustin Business Center consists of 240,602 square feet of office, warehouse, and manufacturing uses on a site of 31.4 acres (see Figure 1). Figure 1 Planning Commission Report Amendment to CUP 09-021 June 9, 2009 Page 3 Site and Surrounding Properties The site is surrounded by Edinger Avenue and commercial businesses to the north and northeast, light industrial uses to the east and southeast, vacant land to the southwest, and Red Hill Avenue, office, and light industrial uses to the west and northwest. (see Figure 2). DISCUSSION Figure 2 Project Description The proposed amendment to Conditional Use Permit 94-021 would allow an increase in the square footage of office space at the Tustin Business Center. According to the applicant, additional office square footage is necessary to ensure the economic viability of the center. Land Use The proposed conditional use permit amendment responds to local market forces, which have resulted in a greater demand for office space. Although offices that are accessory to industrial uses are outright permitted in the City's industrial districts, a conditional use permit is required in the Industrial (M) Zoning District for independent office uses. The Tustin Business Center is a light industrial park that attracts a variety of industrial business -serving office uses, as well as other types of offices. Office uses can support Planning Commission Report Amendment to CUP 09-021 June 9, 2009 Page 4 warehouse and manufacturing uses, and additional office square footage at the Tustin Business Park would be compatible with other permitted uses. Parking, Circulation, and Traffic To accommodate the proposed increase in the square footage of office space from 115,500 square feet to 142,900 square feet, an additional 31 on-site parking spaces are proposed along Parkway Loop, which is a private street that provides access to the Tustin Business Center. Parkway Loop is 36 feet in width and can accommodate the proposed parallel parking spaces on one side and still provide a minimum width of 27 feet for access, which is more than sufficient for passenger vehicles, trucks, and emergency vehicles. The additional 31 parking spaces would bring the total number of parking spaces at the Tustin Business Center to 606 parking spaces. Figure 3 shows the proposed square footage by use and the required number of parking spaces based on the parking ratios required by Tustin City Code Section 9263(8). Land Use Total Area (sf) Parking Ratio Required Spaces Office 142,900 sf 4/1,000 sf, 1S 25,000 sf 1/300 sf, over 25,000 sf 493 Warehouse 82,744 sf 1/1,000 sf 83 Manufacturing 14,958 sf 2/1,000 sf 30 TOTAL 240,602 sf 606 Figure 3 A traffic analysis for this project was prepared by Austin -Foust Associates, Inc. and was reviewed by the City's Engineering Division (Exhibit 1 of the Environmental Analysis). The analysis concluded that the use of up to 142,900 square feet of office in the Tustin Business Center would generate a maximum increase of 46 AM and 45 PM peak hour trips, which would not significantly impact the surrounding roadway network. All study intersection locations will continue to operate at acceptable levels of service. Conditional Use Permit In determining whether to approve the Conditional Use Permit Amendment, the Planning Commission must determine whether or not the proposed use will be detrimental to the health, safety, morals, comfort, and general welfare of the persons residing in or working in the neighborhood or whether it will be injurious or detrimental to property or improvements in the vicinity or to the welfare of the City. A decision to approve this request may be supported by the following findings: Planning Commission Report Amendment to CUP 09-021 June 9, 2009 Page 5 1. Pursuant to Tustin City Code Section 9242(b), uses which maintain greater than fifty (50) percent of their gross floor area for office purposes are authorized subject to a conditional use permit in the Industrial (M) Zoning District. 2. The proposed increase in the maximum allowable square footage of office space is not anticipated to result in parking impacts because the required number of parking spaces would be provided, and the Traffic and Parking Study found that the existing parking spaces are not fully utilized. 3. The City's Traffic Engineering Division has reviewed the proposed project and has concluded that there will be no adverse traffic impacts, and there is sufficient street capacity to support the proposed increase in office square footage. 4. Office uses can support industrial uses, which are outright permitted at the Tustin Business Center. 5. The Tustin Business Center is surrounded by other commercial and industrial uses and additional office uses would be consistent with the existing development and the Industrial (M) zoning designation and consistent with the proposed elementary school to the southwest and nearby residential uses. 6. As conditioned, Conditional Use Permit 94-021 may be reviewed on an annual basis, or more often if necessary, by the Community Development Director. If the use is not operated in accordance with Conditional Use Permit 94-021 or is found to be a nuisance or negative impacts are affecting the surrounding uses, the Community Development Director would have the authority to impose additional conditions to eliminate the nuisance or negative impacts or may initiate proceedings to revoke the Conditional Use Permit. 7. The implementation/application of the proposed conditions would ensure compatibility of the increased office square footage with the surrounding uses and the Tustin City Code. 8. If in the future the City determines that a parking or traffic deficiency exists on the site or in the vicinity as a result of the proposed project, the Community Development Director may require the applicant to prepare a parking demand analysis or traffic study analysis, and the applicant shall bear all associated costs. If said study indicates that there is inadequate parking, the applicant shall be required to provide mitigation measures to be reviewed and approved by the Community Development Department and/or Public Works Department. Planning Commission Report Amendment to CUP 09-021 June 9, 2009 Page 6 Environmental Analysis A Negative Declaration has been prepared for this project (Exhibit A of Resolution No. 4117). The attached Initial Study discusses potential impact categories, and there is no substantial evidence that the project may have a significant effect on the environment. The draft negative declaration was made available for public review from May 15, 2009, to June 4, 2009. No comments were received during the public review period. DETERMINATION: On the basis of this initial evaluation: ❑Hazards ❑Noise ❑Public Services ❑Utilities and Service Systems ❑Aesthetics ❑Cultural Resources ❑Recreation ❑Mandatory Findings of Significance Z I find that the proposed project COULD NOT have a significant effect on the environment, and a NEGATIVE DECLARATION will be prepared. ❑ I find that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because the mitigation measures described on an attached sheet have been added to the project. A NEGATIVE DECLARATION will be prepared. ❑ I find that the proposed project MAY have a significant effect on the environment, and an ENVIRONMENTAL IMPACT REPORT is required. ❑ I find that the proposed project MAY have a significant effect(s) on the environment, but at least one effect 1) has been adequately analyzed in an earlier document pursuant to applicable legal standards, and 2) has been addressed by mitigation measures based on the earlier analysis as described on attached sheets, if the effect is a "Potentially Significant Impact" or "Potentially Significant Unless Mitigated." An ENVIRONMENTAL IMPACT REPORT is required, but it must analyze only the effects that remain to be addressed. ❑ I find that although the proposed project could have a significant effect on the environment, there WILL NOT be a significant effect in this case because all potentially significant effects 1) have been analyzed adequately in an earlier EIR pursuant to applicable standards, and 2) have been avoided or mitigated pursuant to that earlier EIR, including revisions or mitigation measures that are unposed upon the proposed project. ❑ I find that although the proposed project could have a significant effect on the environment, there WILL NOT be a significant effect in this case because all potentially significant effects 1) have been analyzed adequately in an earlier NEGATIVE DECLARATION pursuant to applicable standards, and 2) have been avoided or mitigated pursuant to that earlier NEGATIVE DECLARATION, including revisions or mitigation measures that are imposed upon the proposed project. Preparer:, Title Senior Planner (fi+/,Y.i l¢ -p lL Date May 15, 2009 Elizabeth A. B ommunity Development Director D. EVALUATION OF ENVIRONMENTAL IMPACTS Directions 1) A brief explanation is required for all answers except "No Impact" answers that are adequately supported by the information sources a lead agency cites in the parentheses following each question. A "No Impact" answer is adequately supported if the referenced information sources show that the impact simply does not apply to projects like the one involved (e.g. the project falls outside a fault rupture zone). A "No Impact" answer should be explained where it is based on project -specific factors and general standards (e.g. the project will not expose sensitive receptors to pollutants, based on a project -specific screening analysis). 2) All answers must take into account the whole action involved, including off-site, on-site, cumulative project level, indirect, direct, construction, and operational impacts. 3) Once the lead agency has determined that a particular physical impact may occur, the checklist answers must indicate whether the impact is potentially significant, less than significant with mitigation, or less than significant. "Potentially Significant Impact" is appropriate if there is substantial evidence that an effect may be significant. If there are one or more "Potentially Significant Impact" entries when the determination is made, an EIR is required. 4) "Negative Declaration: Less Than Significant With Mitigation Incorporated" applies where the incorporation of mitigation measures has reduced an effect from "Potentially Significant Impact" to a "Less than Significant Impact." The lead agency must describe the mitigation measures, and briefly explain how they reduce the effect to a less than significant level (mitigation measures from Section XVII, "Earlier Analyses," may be cross- referenced). 5) Earlier analyses may be used where, pursuant to the tiering, program EIR, or other CEQA process, an effect has been adequately analyzed in an earlier EIR or negative declaration. Section 15063 (c) (3)(D). In this case, a brief discussion should identify the following: a) Earlier Analysis Used. Identify and state where they are available for review. b) Impacts Adequately Addressed. Identify which effects from the above checklist were within the scope of and adequately analyzed in an earlier document pursuant to applicable legal standards, and state whether such effects were addressed by mitigation measures based on the earlier analysis. c) Mitigation Measures. For effects that are "Less than Significant with Mitigation Measures Incorporated," describe the mitigation measures which were incorporated or refined from the earlier document and the extent to which they address site-specific conditions for the project. 6) Lead agencies are encouraged to incorporate into the checklist references to information sources for potential impacts (e.g. general plans, zoning ordinances). Reference to a previously prepared or outside document should, where appropriate, include a reference to the page or pages where the statement is substantiated. 7) Supporting Information Sources: A source list should be attached, and other sources used or individuals contacted should be cited in the discussion. 8) This is only a suggested form, and lead agencies are free to use different formats; however, lead agencies normally address the questions from this checklist that are relevant to a project's environmental effects in whatever format is selected. 9) The explanation of each issue should identify: a) the significance criteria or threshold, if any, used to evaluate each question; and; b) the mitigation measure identified, if any, to reduce the impact to less than significance. I. AESTHETICS —Would the project: a) Have a substantial adverse effect on a scenic vista? b) Substantially damage scenic resources, including, but not limited to, trees, rock outcroppings, and historic buildings within a state scenic highway? c) Substantially degrade the existing visual character ar quality of the site and its surroundings? d) Create a new source of substantial light or glare, which would adversely affect day or nighttime views in the area? H. AGRICULTURE RESOURCES: In determining whether impacts to agricultural resources are significant environmental effects, lead agencies may refer to the California Agricultural Land Evaluation and Site Assessment Model (1997) prepared by the California Dept. of Conservation as an optional model to use in assessing impacts. on agriculture and farmland. An increase in the square footage of office space would result in a decrease in the square footage of industrial (warehouse and/or manufacturing) space. No new exterior building construction is proposed. However, the striping of an additional 31 on-site parking spaces and modified and new trash enclosures are proposed. The site is surrounded by Edinger Avenue and commercial businesses to the north and northeast, light industrial uses to the east and southeast, vacant land to the southwest, and Red Hill Avenue, office, and light industrial uses to the west and northwest. The site is zoned Industrial and is designated by the Tustin General Plan as Industrial. The discretionary actions that are anticipated to be considered by the Tustin Planning Commission include: Adoption of the Negative Declaration Approval of the amendment to the conditional use permit In addition, subsequent ministerial approvals by the City of Tustin may include: • Demolition permits • Building permits (for interior tenant improvements) 1. AESTHETICS Items a through d — No Impact: The site is developed with an existing business center and parking lot and is surrounded by developed parcels. The property is not located on a scenic vista or within a State scenic highway; thus the project would not damage scenic resources such as trees, rock outcroppings, or historical buildings within a State scenic highway. Tustin Business Center Page 2 The site is currently improved. The striping of additional parking spaces on existing private streets and an increase in the square footage of office space within the existing buildings would not change the visual character of the site and its surroundings. The project site is located in an urban setting that is currently subject to on -street and on-site lighting. No new lighting is proposed. Mitigation Measures/MonitoringRequired: None Required Sources: Tustin General Plan Tustin Zoning Map Field Inspection Submitted Plans Tustin City Code 2. AGRICULTURAL RESOURCES Items a through c — No Impact: The site is developed with an existing business center and parking lot and is surrounded by developed parcels. The proposed project is not located on a property designated as Prime farmland, Unique farmland, or Farmland of Statewide Importance, nor is it located within a property zoned for agricultural use, or a Williamson Act contract; therefore, the project will have no impacts on any farmland, nor will it conflict with existing zoning for agricultural use, or a Williamson Act contract. The proposed project will not result in conversion of farmland to a non-agricultural use. Mitigation Measures/Monitoring Required: None Required Sources: Tustin General Plan Field Inspection Submitted Plans 2004 CA Dept. of Conservation Farmland Mapping and Monitoring Program 3. AIR OUALIT Items a through e — No Impact: The project is below the thresholds of significance established by Tables 6-2 (operation thresholds) and 6-3 (construction thresholds) of the Air Quality Management District's CEQA Air Quality Handbook. The Air Quality Management District's CEQA Air Quality Handbook is intended to provide professional guidance for analyzing and mitigating air quality impacts of projects when preparing environmental documents. The construction of fewer than 1,309,000 square feet of building and the grading of fewer than 177.00 acres is not considered to have a significant air quality impact. Since no new buildings or grading are proposed, no impact is anticipated. As such, the proposed project Tustin Business Center Page 3 will not conflict with or obstruct implementation of any applicable air quality plan, violate any air quality standard, result in a cumulatively considerable increase of any criteria pollutant as applicable by Federal or ambient air quality standard, nor will it expose sensitive receptors to substantial pollutant concentrations, or create objectionable odor affecting a substantial number of people. Mitigation Measures/Monitoring Required: None Required Sources: South Coast Air Quality Management District Rules & Regulations South Coast Air Quality Management District CEQA Air Quality Handbook - April 1993 Submitted Plans Field Inspection 4. BIOLOGICAL RESOURCES Items a throng h f — No Impact: The site is improved and is surrounded by properties that are developed with pavement and structures. The site is not inhabited by any sensitive species of animals and the proposed project would have no impacts on animal populations, diversity of species, or migratory patterns. No wetlands exist within the project site. No impacts to any unique, rare, or endangered species of plant or animal life identified in local or regional plans, policies, or regulations by the California Department of Fish and Game or U.S. Fish and Wildlife Service would occur as a result of this project. GEOLOGY & SOILS Items a through e — No Impact: The site is located on expansive soil and is located within an area that may subject people or structures to strong seismic ground shaking and seismic -related ground failure including liquefaction. However, no new buildings are proposed. The project site is not located within an area on the Alquist-Priolo Earthquake Fault Zoning Map. The project will not be located on a geologic unit or soil that is unstable and will not result in on- or off-site landslide, lateral spreading, subsidence, or collapse. Mitigation Measures/Monitoring Required: None Required Sources: Tustin General Plan Tustin City Code Submitted Plans Field Evaluation 7. HAZARDS & HAZARDOUS MATERIALS Items a through h — No Impact: The proposed project primarily consists of the striping of additional parking spaces on existing private streets and an increase in the square footage of office space within existing buildings. No storage or transport of hazardous materials are proposed from the proposed project. The project would not result in exposure to hazardous substances. The project would not emit hazardous materials which could create a hazard to the adjacent businesses or the general public if released into the environment. The site is not listed as a hazardous materials site, is not located on any potential impact zones identified for John Wayne Airport, and there are no private airstrips nearby. The project is not anticipated to interfere with emergency response or evacuation. The construction of new or modified trash enclosures is subject to compliance with all applicable Uniform Building Codes. As such, the project is not anticipated to result in any significant hazards. Mitigation Measures/Monitoring Required: None Required. Sources: Uniform Building and Fire Codes Submitted Plans Tustin General Plan California Seismic Hazard Zone Map, Tustin Quadrangle, January 17, 2001 Tustin Business Center Page 5 8. HYDROLOGY & WATER QUALITY Items a through n —No Impact: The project site is relatively flat, and the proposed project will continue to maintain a relatively flat site with proper site drainage, including roads, curbs and gutters, and landscaping. No new buildings or grading activity are proposed, so there is no potential to impact stormwater runoff from construction and post -construction activities with stormwater pollutants. There is also no potential for discharge of stormwater to affect the beneficial uses of the receiving waters and changes in the flow velocity or volume of storm water runoff. As such, the project will not violate any water quality standards or waste discharge requirements or degrade water quality in the area. A portion of storm water received on-site will percolate into the soil where landscaping is provided, but the majority of the storm water will be conveyed to a City storm drain. City storm water infrastructure is able to accommodate the water from the project, and the amount of water will not increase as a result of the project, While the project is located within Zone X (areas of 0.2 percent annual chance flood), the project site is located outside a 100 -year flood hazard area (areas of 1 percent annual chance of flood) as mapped on a Flood Insurance Rate Map. The project is not located within a 100 - year flood hazard area structure which will impede or redirect flood flows. The project site will not expose people or structures to a significant risk of loss, injury, or death as a result of the failure of a levee or dam, or by inundation by seiche, tsunami, or mudflow. Mitigation Measures: None Required. Sources: Field Verification Submitted Plans Tustin City Code 9. LAND USE PLANNING Items a through c —No Impact: The property is designated by the Tustin General Plan Land Use Map as Industrial and is zoned Industrial (M). The proposed project would allow for an increase in the square footage of office space on the property, but would not change the allowable uses of the property. The site is accessible from the City's current street system, and the project would support existing transportation and public facilities. The proposed project would not divide an established community since it involves minor modifications to an existing site that is already improved with buildings and a parking lot. The proposed project is not located in the conservation plan or natural community conservation plan. The proposed project would not conflict with any applicable conservation plan. Tustin Business Center Page 6 Mitigation Measures: None Required Sources: Submitted Plans Tustin City Code Tustin General Plan Tustin Zoning Map 10. MINERAL RESOURCES Items a and b — No Impact: The proposed project is not located on a mineral resource recovery site. The increase in the square footage of office space within the existing buildings and the striping of additional parking spaces on existing private streets will not result in the loss of availability of a known mineral resource. Mitigation Measures/Monitoring Required: None Required Sources: SubmittedPtans Tustin City Code Tustin General Plan 11. NOISE Items a throueh f — No Imnact: The maximum allowable noise level for industrial districts in Tustin is 70 dB(A). The conversion of interior industrial space to office space and the striping of additional parking spaces associated with the project would not occur beyond these hours nor on Sundays or City -observed federal holidays. Therefore, any noise generated by these activities would comply with the City's Noise Ordinance and construction activities would not result in a significant noise impact. Furthermore, the proposed project would involve typical construction activities and equipment. There would be no construction or operational activities that would generate excessive groundborne vibration or noise. Operations at the project site following the conversion of industrial space to office space would be similar to existing conditions. The proposed project would not significantly increase ambient noise levels in the project vicinity above levels existing without the proposed project. Tustin Business Center Page 7 The site is not located within an airport land use plan or within two (2) miles of a public or private airport. Therefore, no noise impacts related to airports would occur. Mitigation Measures/Monitoring Required: Sources: Submitted Plans Tustin City Code Tustin General Plan Tustin Zoning Code 12. POPULATION & ROUSING Items a through c — No Impact: None Required The proposed project consists primarily of the striping of additional parking spaces on existing private streets and an increase in the square footage of office space within existing buildings. No residential development is proposed. Implementation of the proposed project would not result in a population increase in the City. In addition, no expansion of infrastructure would be required which could indirectly induce population growth in the area. The proposed project would not displace existing housing or people, nor require the construction of replacement housing. The proposed project would not result in any impacts to population and housing. Therefore, no mitigation is required. Mitigation Measures/Monitoring Required: None required Sources: Submitted Plans Tustin City Code Tustin General Plan 13. PUBLIC SERVICES Item a—No Impact: The proposed project consists primarily of the striping of additional parking spaces on existing private streets and an increase in the square footage of office space within existing buildings. The proposed project is in an existing urbanized area where fire and police protection are currently provided. Although the project would increase the number of parking spaces, no new streets, public services, or infrastructure would need to be created. Mitigation Measures/Monitoring Required: None required Sources: Submitted Plans Tustin City Code Tustin Business Center Page 8 14. RECREATION Items a and b — No Impact: The proposed project would not increase the use of, or require the construction or expansion of City parks or recreational facilities. No significant impact related to recreation would occur, and no mitigation is required. Mitigation Measures/Monitoring Required: None required Sources: Submitted Plans Tustin City Code 15. TRANSPORTATION/TRAFFIC Items a throueh H — No Impact: The traffic analysis for this project is contained in the Traffic and Parking Study dated March 23, 2009, prepared by Austin -Foust Associates, Inc. (Exhibit 1). The use of up to 142,900 square feet of office in the Tustin Business Center would generate a maximum increase of 46 AM and 45 PM peak hour trips, which would not significantly impact the surrounding roadway network. All study intersection locations will continue to operate at acceptable levels of service. The proposed project will not induce substantial population or growth wherein the project will not result in changes to air traffic patterns, or conflict with adopted policies, plans, or programs supporting alternative transportation such as bus turnouts or bicycle racks. The project will improve parking capacity and is proposed to satisfy current and future parking demand at the Tustin Business Center. The project does not include any uses or design features that would increase hazards, Furthermore, the new parking spaces would be located to ensure that adequate fire protection facilities are provided and that sufficient emergency access is provided. Mitigation Measures/Monitoring Required: None Required. Sources: Submitted Plans Tustin City Code Traffic/Circulation Technical Memorandum (Exhibit 1) 16. UTILITIES & SERVICE SYSTEMS Items a through 2 — No Impact: The proposed project will not exceed the requirements of the applicable Regional Water Quality Control Board or require or result in the construction of new water or wastewater treatment Tustin Business Center Page 9 facilities. The proposed project will utilize the existing sewer and storm drain systems and thus will not require construction of a new storm water drainage facility or solid waste facility. The project would not be required to submit a hydrology report to ensure proper grading, drainage, and sewer systems. The project will utilize the City's existing trash hauler contract, thus not requiring a new trash hauler. Adequate water supply from existing resources will be available to serve the proposed project. Therefore, no environmental impact related to utilities and service systems would occur, and no mitigation is required. Mitigation Measures/Monitoring Required: None Required. Sources: Submitted Plans Tustin City Code Tustin General Plan 17. MANDATORY FINDINGS OF SIGNIFICANCE Items a, b & c — No Impact: The project design, construction, and operation will comply with applicable regulations. The project, by nature of its location and as designed, does not have the potential to: degrade the quality of the environment; reduce the habitat of fish or wildlife species; cause a fish or wildlife population to drop below self-sustaining levels; threaten to eliminate a plant or animal community; reduce the number or restrict the range of a rare or endangered plant or animal; or, eliminate important examples of the major periods of California history or prehistory. The project does not have the potential to achieve short-term environmental goals to the disadvantage of the long-term. It does not have impacts that are individually limited but cumulatively considerable or that would cause substantial adverse impacts on human beings. The TBC is entitled to use up to 115,500 sf as office, but is applying to the City for a Conditional Use Permit (CUP) to allow up to 142,900 sf to be used as office space. TRAFFIC ANALYSIS An aerial view of the TBC site is shown in Figure 1. Austin -Foust Associates, Inc., (AFA) conducted all day parking and traffic counts for three days, September 23-25, 2008 to determine the peak parking; demand and trip generation of the site. Table 1 reveals these counts based upon the then 86 percent building occupancy (205,358 sf occupied in September 2008). Also shown in Table 1 is the forecasted trip generation of the site using the Institute of Transportation Engineers (ITE) Trap Generation -8"' Edition rates (see Appendix for rate calculations). Inc. Traffic and Parking Study 1148001 rpt 401 le The results of the three day traffic and parking counts reveal that a maximum of 337 spaces were ever occupied and the average AM and PM peak hour traffic entering/exiting the site is 173 vehicles per hour (vph) and 187 vph, respectively as shown in Figure 2. The sites observed trip generation is well below that expected from using, the ITE rates. The existing ITE trips in the AM and PM would be 211 vph and 206 vph, respectively. An estimated increase of 46 AM and 45 PM peak hour trips is expected from the expansion. Based off of the existing traffic patterns of the TBC, Figure 3 shows the forecasted expansion peak hour trip distribution. Using this information, the traffic impact that the project expansion will have on the project site and local street system can be calculated based on levels of service (LOS) using the intersection capacity utilization method (ICU) for the signalized intersection locations. Shown in Table 2 are the ICU calculations for the existing TBC and the expected TBC with office expansion LOS comparisons. In terms of ICU and LOS, a significant impact to an intersection would be an increase in ICU by .02 at a location that is operating at an unacceptable LOS D. As can be seen from Table 2, all study intersection locations will operate at LOS A or B with and without the project expansion, and that the project increase of 46 ANI and 45 PM peak hour trips would not significantly impact the surrounding roadway network (see appendix for ICU and LOS calculation sheets). Traffic and Parking Study 1148001tsFig3.dwg PARKING ANALYSIS The project is applying for a CUP to allow up to 142,900 sf of the total 240,602 sf to be used as office. Currently, the site is entitled to a maximum of 115,500 sf of office use. The application would, in fact, increase the office usage by 27,400 sf. The current peak parking demand is 1.64 spaces per TSF (337 maximum spaces occupied divided by 205,358 sf). The current use of the TBC is 55 percent office, 38 percent warehouse, and seven percent manufacturing. Based upon this mix of uses, the City's Parking Code, shown in Table 3, would require a parking ratio of 2.45 spaces per TSF for the current occupied TBC, versus the actual peak demand of 1.64 spaces occupied per TSF observed. Table 3 EXISTING 86 % OCCUPIED TBC (9/2008) CODE REQUIRED PARKING Required Parking_ Land Use Total Area S City Parking Rates (space) Office 114,040 (1,460 Vacant 4 Spaces/TSF for First 25 TSF 398 16,932 Vacant Non -Approved) + 1 Spaces/300 SF over 25 TSF Warehouse 77,404 (15,808 Vacant) 1 Space TSF 7$ Manufacturing 13,914 (1,044 Vacant) 2 Spaces/TSF 28 TOTAL 205,358 (35,244 Vacant) 504 In effect, all this information indicates is that the actual demand for parking at the TBC is well below that required by the City's Parking Code. The TBC currently has a total of 575 marked parking spaces in all. To simplify the issue, the application can be viewed as a request to increase office use by 27,400 sf at the expense of reducing the warehouse/manufacturing use by a 10,468 sf (27,400 sf — 16,932 sf vacant, non -approved office use = 10,468 sf). However, it is recognized that office use requires more parking than the average in the center. The City Code requirement for the net office increase is one space per 300 sf, whereas warehouse requires only one space per 1,000 sf, and manufacturing requires two spaces per TSF. Taking the worst case that the office replaces warehousing (which constitutes 38 percent of the existing usage), means the 10,468 sf of converted office space needs to provide a net 102 additional parking spaces above what is currently required of the existing TBC (86 percent occupancy), bringing the total required City parking to 606 spaces as shown in Table 4. With a total of 606 required parking spaces, the proposed TBC office expansion would be 31 spaces over the current 575 -space supply. Tustin Business Center—Expanded Office Use Entitlement 6 Austin -Foust Associates, Inc. Traffic and Parking Study 1148001 rpt Table 4 PROPOSED TBC EXPANSION CODE REQUIRED PARKING Required Parking Land Use Total Area SR City Parking Rates (Space) sf 132,.468 4 Spaces/TSF for First 25 TSF Office + 1046 sf + I Spaces/300 SF over 25 TSF 493 = 142,900 sf 93,212 sf Warehouse 10,468 sf 1 Space/TSF 83 = 82,744 sf Manufacturing 14,958 2 Spaces/TSF 30 TOTAL 240,602 606 A unique characteristic of the TBC site is that it contains a 36 -foot wide private internal roadway system (Parkway Loop). Motorists currently utilize Parkway Loop for curbside parking in the TBC. Based on the City's on street parallel parking design standards (9 feet wide by 22 feet length stalls), the TBC could create an additional 31 -marked curbside spaces on the 36 -foot wide Parkway Loop Street (as shown in Figure l). The on street parking; stalls design and location were selected to avoid any potential conflicts that might arise. The Orange County Fire Authority only requires a 20 foot drive aisle for its trucks to maneuver (which could allow parking on both sides of the 36 foot wide Parkway Loop). Regardless, parking has been restricted to only one side of the street to give Parkway Loop a wide 27 foot drive isle. The parking stalls were also restricted from areas within 18 feet from of driveways, to reduce turning radius impacts on site. Vehicles exiting a driveway will have adequate sight distance, thereby avoiding conflicts with the parking on the street. Parkway Loop contains speed humps that significantly reduce the travel speed to only 10-15 miles per hour, which in turn reduces the necessary sight distance to under 150 feet and gives drivers more than enough time to complete safe turns in and out of driveways. With 31 additional marked parking spaces the site's new parking supply total would increase to 606 marked spaces, which would be sufficient for the proposed 142.9 TSF CUP to be compliant with the City's Parking Code. CONCLUSION In summary, it is concluded that use of up to 142,900 sf of office in the TBC would create a maximum increase of 46 AM and 45 PM peak hour trips, which would not significantly impact the surrounding roadway network. The proposed 142,900 sf office expansion would need to provide a net 31 additional parking spaces for a total of 606 spaces. The Planning Commission does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That a proper application, Amendment to Conditional Use Permit 94-021, was filed by Sapetto Group, Inc. on behalf of Scanlankemperbard Companies, requesting authorization to increase the maximum allowable square footage of office space from 115,500 square feet to 142,900 square feet within the existing buildings at the Tustin Business Center located at the southerly corner of Red Hill Avenue and Edinger Avenue. B. That the General Plan land use designation and zoning designation of Industrial allow for a variety of commercial and industrial uses, including offices. In addition, the project has been reviewed and determined to be consistent with the Air Quality Sub -element of the City of Tustin General Plan. C. That a public hearing was duly called, noticed, and held for Amendment to Conditional Use Permit 94-021 on June 9, 2009, by the Planning Commission. D. That the proposed increase in office square footage will not be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood, nor be injurious or detrimental to the property and improvements in the neighborhood of the subject property, or to the general welfare of the City of Tustin, in that: 1. Resolution No. 4118 Page 2 3. 5. The Tustin Business Center is surrounded by other commercial and industrial uses and is not adjacent to any residential or sensitive uses. 8. If in the future the City determines that a parking or traffic deficiency exists on the site or in the vicinity as a result of the proposed project, the Community Development Director may require the applicant to prepare a parking demand analysis or traffic study analysis and the applicant shall bear all associated costs. If said study indicates that there is inadequate parking, the applicant shall be required to provide mitigation measures to be reviewed and approved by the Community Development Department and/or Public Works Department. E. That an Initial Study was prepared to evaluate the potential environmental impacts associated with Amendment to Conditional Use Permit 94-021 that concluded there is no substantial evidence that the project may have a significant effect on the environment, and a Draft Negative Declaration (ND) was prepared. The Final ND was adopted by the Planning Commission on June 9, 2009. II, The Planning Commission hereby approves Amendment to Conditional Use Permit 94-021 authorizing an increase in the maximum allowable square footage of office space from 115,500 square feet to 142,900 square feet within the existing buildings at the Tustin Business Center located at the southerly corner of Red Hill Avenue and Edinger Avenue, subject to the conditions contained within Exhibit A attached hereto, Resolution No. 4118 Page 3 PASSED AND ADOPTED by the Planning Commission of the City of Tustin, at a regular meeting on the 9th day of June, 2009.
