REQUEST: TO AMEND CONDITIONAL USE PERMIT 94-021 TO

FOOTAGE OF OFFICE SPACE FROM 115,500 SQUARE FEET
TO 142,900 SQUARE FEET WITHIN THE EXISTING
BUILDINGS AT THE TUSTIN BUSINESS CENTER.
RECOMMENDATION
That the Planning Commission:
1. Adopt Resolution No. 4117 adopting the Final Negative Declaration as adequate for
an Amendment to Conditional Use Permit 94-021 to increase the maximum
allowable square footage of office space.

2. Adopt Resolution No. 4118 approving an Amendment to Conditional Use Permit 94-
021, authorizing an increase in the maximum allowable square footage of office
space from 115,500 square feet to 142,900 square feet within the existing buildings
at the Tustin Business Center located at the southerly corner of Red Hill Avenue
and Edinger Avenue.
BACKGROUND
Pursuant to Tustin City Code Section 9242(b), uses which maintain greater than fifty (50)
percent of their gross floor area for office purposes in the Industrial (M) Zoning District are
authorized subject to a conditional use permit.
On October 17, 1994, the Zoning Administrator approved Conditional Use Permit 94-021 to
authorize the establishment of uses that have more than 50 percent of their floor area
devoted to office use at the Tustin Business Center located at the southerly corner of Red Hill
Avenue and Edinger Avenue (Attachment A — Location Map). One of the conditions of
Conditional Use Permit 94-021 limited the square footage of office space to a maximum of
115,500 square feet, provided there is adequate on-site parking.
The types of office uses permitted by Conditional Use Permit 94-021 in the Tustin Business
Center include general offices, medical offices, professional offices, administrative offices,
and offices in conjunction with other permitted uses. The Tustin Business Center consists of
240,602 square feet of office, warehouse, and manufacturing uses on a site of 31.4 acres
(see Figure 1).

Site and Surrounding Properties
The site is surrounded by Edinger Avenue and commercial businesses to the north and
northeast, light industrial uses to the east and southeast, vacant land to the southwest, and
Red Hill Avenue, office, and light industrial uses to the west and northwest. (see Figure 2).

Project Description
The proposed amendment to Conditional Use Permit 94-021 would allow an increase in
the square footage of office space at the Tustin Business Center. According to the
applicant, additional office square footage is necessary to ensure the economic viability of
the center.
Land Use
The proposed conditional use permit amendment responds to local market forces, which
have resulted in a greater demand for office space. Although offices that are accessory to
industrial uses are outright permitted in the City's industrial districts, a conditional use
permit is required in the Industrial (M) Zoning District for independent office uses. The
Tustin Business Center is a light industrial park that attracts a variety of industrial
business -serving office uses, as well as other types of offices. Office uses can support

warehouse and manufacturing uses, and additional office square footage at the Tustin
Business Park would be compatible with other permitted uses.
Parking, Circulation, and Traffic
To accommodate the proposed increase in the square footage of office space from
115,500 square feet to 142,900 square feet, an additional 31 on-site parking spaces are
proposed along Parkway Loop, which is a private street that provides access to the Tustin
Business Center. Parkway Loop is 36 feet in width and can accommodate the proposed
parallel parking spaces on one side and still provide a minimum width of 27 feet for
access, which is more than sufficient for passenger vehicles, trucks, and emergency
vehicles. The additional 31 parking spaces would bring the total number of parking spaces
at the Tustin Business Center to 606 parking spaces.
Figure 3 shows the proposed square footage by use and the required number of parking
spaces based on the parking ratios required by Tustin City Code Section 9263(8).

A traffic analysis for this project was prepared by Austin -Foust Associates, Inc. and was
reviewed by the City's Engineering Division (Exhibit 1 of the Environmental Analysis). The
analysis concluded that the use of up to 142,900 square feet of office in the Tustin
Business Center would generate a maximum increase of 46 AM and 45 PM peak hour
trips, which would not significantly impact the surrounding roadway network. All study
intersection locations will continue to operate at acceptable levels of service.
Conditional Use Permit
In determining whether to approve the Conditional Use Permit Amendment, the Planning
Commission must determine whether or not the proposed use will be detrimental to the
health, safety, morals, comfort, and general welfare of the persons residing in or working in
the neighborhood or whether it will be injurious or detrimental to property or improvements in
the vicinity or to the welfare of the City.
A decision to approve this request may be supported by the following findings:

1. Pursuant to Tustin City Code Section 9242(b), uses which maintain greater

2. The proposed increase in the maximum allowable square footage of office
space is not anticipated to result in parking impacts because the required
number of parking spaces would be provided, and the Traffic and Parking
Study found that the existing parking spaces are not fully utilized.
3. The City's Traffic Engineering Division has reviewed the proposed project
and has concluded that there will be no adverse traffic impacts, and there is
sufficient street capacity to support the proposed increase in office square
footage.
4. Office uses can support industrial uses, which are outright permitted at the
Tustin Business Center.
5. The Tustin Business Center is surrounded by other commercial and industrial
uses and additional office uses would be consistent with the existing
development and the Industrial (M) zoning designation and consistent with
the proposed elementary school to the southwest and nearby residential
uses.
6. As conditioned, Conditional Use Permit 94-021 may be reviewed on an annual
basis, or more often if necessary, by the Community Development Director. If
the use is not operated in accordance with Conditional Use Permit 94-021 or is
found to be a nuisance or negative impacts are affecting the surrounding uses,
the Community Development Director would have the authority to impose
additional conditions to eliminate the nuisance or negative impacts or may
initiate proceedings to revoke the Conditional Use Permit.
7. The implementation/application of the proposed conditions would ensure
compatibility of the increased office square footage with the surrounding uses
and the Tustin City Code.
8. If in the future the City determines that a parking or traffic deficiency exists on
the site or in the vicinity as a result of the proposed project, the Community
Development Director may require the applicant to prepare a parking
demand analysis or traffic study analysis, and the applicant shall bear all
associated costs. If said study indicates that there is inadequate parking, the
applicant shall be required to provide mitigation measures to be reviewed
and approved by the Community Development Department and/or Public
Works Department.

Environmental Analysis
A Negative Declaration has been prepared for this project (Exhibit A of Resolution No.
4117).
The attached Initial Study discusses potential impact categories, and there is no substantial
evidence that the project may have a significant effect on the environment. The draft
negative declaration was made available for public review from May 15, 2009, to June 4,
2009. No comments were received during the public review period.

A RESOLUTION OF THE PLANNING COMMISSION
ADOPTING THE FINAL NEGATIVE DECLARATION
FOR AMENDMENT TO CONDITIONAL USE
PERMIT 94-021 AUTHORIZING AN INCREASE IN

OF OFFICE SPACE FROM 115,500 SQUARE FEET
TO 142,900 SQUARE FEET WITHIN THE EXISTING
BUILDINGS AT THE TUSTIN BUSINESS CENTER
LOCATED AT THE SOUTHERLY CORNER OF RED
HILL AVENUE AND EDINGER AVENUE.
The Planning Commission of the City of Tustin does hereby resolve as follows:
The Planning Commission finds and determines as follows:
A. That a proper application, Amendment to Conditional Use Permit
94-021, was filed by Sapetto Group, Inc. on behalf of
Scanlankemperbard Companies, requesting authorization to
increase the maximum allowable square footage of office space
from 115,500 square feet to 142,900 square feet within the existing
buildings at the Tustin Business Center located at the southerly
corner of Red Hill Avenue and Edinger Avenue;
B. That the requested conditional use permit amendment is
considered a "project' by the California Environmental Quality Act
("CEQA") (Pub. Resources Code §21000 et. seq.);
C. That City staff prepared an Initial Study to evaluate the potential
environmental impacts associated with Amendment to Conditional
Use Permit 94-021 that concluded there is no substantial evidence
that the project may have a significant effect on the environment,
and a Draft Negative Declaration (ND) was prepared;
D. That a Notice of Intent to Adopt a Negative Declaration was published
and the Negative Declaration and Initial Study were made available
for a 20 -day public review and comment period from May 15, 2009,
to June 4, 2009, in compliance with Sections 15072 and 15105 of the
State CEQA Guidelines;
F. That the Planning Commission is the final authority for the project,
considered the Initial Study and the Negative Declaration (Exhibit A),
and finds it sufficient for the proposed Amendment to Conditional
Use Permit 94-021.

II. The Planning Commission hereby adopts Final Negative Declaration
attached hereto as Exhibit A for Amendment to Conditional Use Permit 94-
021 for an increase in the maximum allowable square footage of office
space from 115,500 square feet to 142,900 square feet within the existing
buildings at the Tustin Business Center located at the southerly corner of
Red Hill Avenue and Edinger Avenue.

D. EVALUATION OF ENVIRONMENTAL IMPACTS
Directions
1) A brief explanation is required for all answers except "No Impact" answers that are adequately supported by the
information sources a lead agency cites in the parentheses following each question. A "No Impact" answer is
adequately supported if the referenced information sources show that the impact simply does not apply to projects
like the one involved (e.g. the project falls outside a fault rupture zone). A "No Impact" answer should be
explained where it is based on project -specific factors and general standards (e.g. the project will not expose
sensitive receptors to pollutants, based on a project -specific screening analysis).
2) All answers must take into account the whole action involved, including off-site, on-site, cumulative project level,
indirect, direct, construction, and operational impacts.
3) Once the lead agency has determined that a particular physical impact may occur, the checklist answers must
indicate whether the impact is potentially significant, less than significant with mitigation, or less than significant.

been adequately analyzed in an earlier EIR or negative declaration. Section 15063 (c) (3)(D). In this case, a brief

b) Impacts Adequately Addressed. Identify which effects from the above checklist were within the scope of
and adequately analyzed in an earlier document pursuant to applicable legal standards, and state whether

TUSTIN BUSINESS CENTER AMENDMENT TO CUP 94-021
SOUTHWEST CORNER OF RED HILL AVENUE AND EDINGER AVENUE
BACKGROUND
The project is a proposed amendment to Conditional Use Permit 94-021 to increase the
maximum allowable square footage of office space from 115,500 square feet to 142,900 square
feet within the existing buildings at the Tustin Business Center located at the southeasterly
corner of Red Hill Avenue and Edinger Avenue. Tustin Business Center consists of 240,602
square feet of office, warehouse, and manufacturing uses. An increase in the square footage of
office space would result in a decrease in the square footage of industrial (warehouse and/or
manufacturing) space. No new exterior building construction is proposed. However, the striping
of an additional 31 on-site parking spaces and modified and new trash enclosures are proposed.
The site is surrounded by Edinger Avenue and commercial businesses to the north and northeast,
light industrial uses to the east and southeast, vacant land to the southwest, and Red Hill Avenue,
office, and light industrial uses to the west and northwest.
The site is zoned Industrial and is designated by the Tustin General Plan as Industrial.
The discretionary actions that are anticipated to be considered by the Tustin Planning Commission
include:

Approval of the amendment to the conditional use permit
In addition, subsequent ministerial approvals by the City of Tustin may include:

The project site is relatively flat, and the proposed project will continue to maintain a
relatively flat site with proper site drainage, including roads, curbs and gutters, and
landscaping. No new buildings or grading activity are proposed, so there is no potential to
impact stormwater runoff from construction and post -construction activities with stormwater
pollutants. There is also no potential for discharge of stormwater to affect the beneficial uses
of the receiving waters and changes in the flow velocity or volume of storm water runoff. As

or degrade water quality in the area. A portion of storm water received on-site will percolate

are made for noise sources associated with construction activities between the hours of 7:00
a.m. and 6:00 p.m. Monday through Friday, and between the hours of 9:00 a.m. and 5:00

The conversion of interior industrial space to office space and the striping of additional

Traffic And Parking Study
Tustin Business Center (TBC), located on the southeast corner of Red Hill Avenue and Edinger
Avenue, is a 240,602 square foot (sf) business Center with office, warehouse and manufacturing uses.
The TBC is entitled to use up to 115,500 sf as office, but is applying to the City for a Conditional Use
Permit (CUP) to allow up to 142,900 sf to be used as office space.
TRAFFIC ANALYSIS
An aerial view of the TBC site is shown in Figure 1. Austin -Foust Associates, Inc., (AFA)
conducted all day parking and traffic counts for three days, September 23-25, 2008 to determine the peak
parking; demand and trip generation of the site. Table 1 reveals these counts based upon the then 86
percent building occupancy (205,358 sf occupied in September 2008). Also shown in Table 1 is the
forecasted trip generation of the site using the Institute of Transportation Engineers (ITE) Trap
Generation -8"' Edition rates (see Appendix for rate calculations).

The results of the three day traffic and parking counts reveal that a maximum of 337 spaces were
ever occupied and the average AM and PM peak hour traffic entering/exiting the site is 173 vehicles per
hour (vph) and 187 vph, respectively as shown in Figure 2. The sites observed trip generation is well
below that expected from using, the ITE rates. The existing ITE trips in the AM and PM would be 211 vph
and 206 vph, respectively. An estimated increase of 46 AM and 45 PM peak hour trips is expected from
the expansion. Based off of the existing traffic patterns of the TBC, Figure 3 shows the forecasted
expansion peak hour trip distribution. Using this information, the traffic impact that the project expansion
will have on the project site and local street system can be calculated based on levels of service (LOS)
using the intersection capacity utilization method (ICU) for the signalized intersection locations. Shown
in Table 2 are the ICU calculations for the existing TBC and the expected TBC with office expansion
LOS comparisons.

.02 at a location that is operating at an unacceptable LOS D. As can be seen from Table 2, all study
intersection locations will operate at LOS A or B with and without the project expansion, and that the

PARKING ANALYSIS
The project is applying for a CUP to allow up to 142,900 sf of the total 240,602 sf to be used as
office. Currently, the site is entitled to a maximum of 115,500 sf of office use. The application would, in
fact, increase the office usage by 27,400 sf. The current peak parking demand is 1.64 spaces per TSF
(337 maximum spaces occupied divided by 205,358 sf). The current use of the TBC is 55 percent office,
38 percent warehouse, and seven percent manufacturing. Based upon this mix of uses, the City's Parking
Code, shown in Table 3, would require a parking ratio of 2.45 spaces per TSF for the current occupied
TBC, versus the actual peak demand of 1.64 spaces occupied per TSF observed.

In effect, all this information indicates is that the actual demand for parking at the TBC is well
below that required by the City's Parking Code. The TBC currently has a total of 575 marked parking
spaces in all. To simplify the issue, the application can be viewed as a request to increase office use by
27,400 sf at the expense of reducing the warehouse/manufacturing use by a 10,468 sf (27,400 sf — 16,932
sf vacant, non -approved office use = 10,468 sf). However, it is recognized that office use requires more
parking than the average in the center. The City Code requirement for the net office increase is one space
per 300 sf, whereas warehouse requires only one space per 1,000 sf, and manufacturing requires two
spaces per TSF. Taking the worst case that the office replaces warehousing (which constitutes 38 percent
of the existing usage), means the 10,468 sf of converted office space needs to provide a net 102 additional
parking spaces above what is currently required of the existing TBC (86 percent occupancy), bringing the
total required City parking to 606 spaces as shown in Table 4. With a total of 606 required parking
spaces, the proposed TBC office expansion would be 31 spaces over the current 575 -space supply.

A unique characteristic of the TBC site is that it contains a 36 -foot wide private internal roadway
system (Parkway Loop). Motorists currently utilize Parkway Loop for curbside parking in the TBC.
Based on the City's on street parallel parking design standards (9 feet wide by 22 feet length stalls), the
TBC could create an additional 31 -marked curbside spaces on the 36 -foot wide Parkway Loop Street (as
shown in Figure l). The on street parking; stalls design and location were selected to avoid any potential
conflicts that might arise. The Orange County Fire Authority only requires a 20 foot drive aisle for its
trucks to maneuver (which could allow parking on both sides of the 36 foot wide Parkway Loop).
Regardless, parking has been restricted to only one side of the street to give Parkway Loop a wide 27 foot
drive isle. The parking stalls were also restricted from areas within 18 feet from of driveways, to reduce
turning radius impacts on site. Vehicles exiting a driveway will have adequate sight distance, thereby
avoiding conflicts with the parking on the street. Parkway Loop contains speed humps that significantly
reduce the travel speed to only 10-15 miles per hour, which in turn reduces the necessary sight distance to
under 150 feet and gives drivers more than enough time to complete safe turns in and out of driveways.
With 31 additional marked parking spaces the site's new parking supply total would increase to 606
marked spaces, which would be sufficient for the proposed 142.9 TSF CUP to be compliant with the
City's Parking Code.
CONCLUSION
In summary, it is concluded that use of up to 142,900 sf of office in the TBC would create a
maximum increase of 46 AM and 45 PM peak hour trips, which would not significantly impact the
surrounding roadway network. The proposed 142,900 sf office expansion would need to provide a net 31
additional parking spaces for a total of 606 spaces. With the additional marked street parking spaces the

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF TUSTIN, APPROVING AN AMENDMENT TO
CONDITIONAL USE PERMIT 94-021 AUTHORIZING AN
INCREASE IN THE MAXIMUM ALLOWABLE SQUARE
FOOTAGE OF OFFICE SPACE FROM 115,500 SQUARE
FEET TO 142,900 SQUARE FEET WITHIN THE EXISTING
BUILDINGS AT THE TUSTIN BUSINESS CENTER
LOCATED AT THE SOUTHERLY CORNER OF RED HILL
AVENUE AND EDINGER AVENUE.
The Planning Commission does hereby resolve as follows:
I. The Planning Commission finds and determines as follows:
A. That a proper application, Amendment to Conditional Use Permit 94-021,
was filed by Sapetto Group, Inc. on behalf of Scanlankemperbard
Companies, requesting authorization to increase the maximum allowable
square footage of office space from 115,500 square feet to 142,900 square
feet within the existing buildings at the Tustin Business Center located at
the southerly corner of Red Hill Avenue and Edinger Avenue.
B. That the General Plan land use designation and zoning designation of
Industrial allow for a variety of commercial and industrial uses, including
offices. In addition, the project has been reviewed and determined to be
consistent with the Air Quality Sub -element of the City of Tustin General
Plan.
C. That a public hearing was duly called, noticed, and held for Amendment to
Conditional Use Permit 94-021 on June 9, 2009, by the Planning
Commission.
D. That the proposed increase in office square footage will not be detrimental to
the health, safety, morals, comfort, or general welfare of the persons residing
or working in the neighborhood, nor be injurious or detrimental to the property
and improvements in the neighborhood of the subject property, or to the
general welfare of the City of Tustin, in that:
1. Pursuant to Tustin City Code Section 9242(b), uses which maintain
greater than fifty (50) percent of their gross floor area for office
purposes are authorized subject to a conditional use permit in the
Industrial (M) Zoning District.
2. The proposed increase in the maximum allowable square footage of
office space is not anticipated to result in parking impacts because
the required number of parking spaces would be provided, and the
Traffic and Parking Study found that the existing parking spaces are
not fully utilized.

3. The City's Traffic Engineering Division has reviewed the proposed
project and has concluded that there will be no adverse traffic
impacts, and there is sufficient street capacity to support the
proposed increase in office square footage.
4. Office uses can support industrial uses, which are outright permitted
at the Tustin Business Center.
5. The Tustin Business Center is surrounded by other commercial and
industrial uses and is not adjacent to any residential or sensitive
uses.
6. As conditioned, Conditional Use Permit 94-021 may be reviewed on an
annual basis, or more often if necessary, by the Community
Development Director. If the use is not operated in accordance with
Conditional Use Permit 94-021 or is found to be a nuisance or negative
impacts are affecting the surrounding uses, the Community
Development Director would have the authority to impose additional
conditions to eliminate the nuisance or negative impacts or may initiate
proceedings to revoke the Conditional Use Permit.
7. The implementation/application of the proposed conditions would
ensure compatibility of the increased office square footage with the
surrounding uses and the Tustin City Code.
8. If in the future the City determines that a parking or traffic deficiency
exists on the site or in the vicinity as a result of the proposed project,
the Community Development Director may require the applicant to
prepare a parking demand analysis or traffic study analysis and the
applicant shall bear all associated costs. If said study indicates that
there is inadequate parking, the applicant shall be required to provide
mitigation measures to be reviewed and approved by the Community
Development Department and/or Public Works Department.
E. That an Initial Study was prepared to evaluate the potential environmental
impacts associated with Amendment to Conditional Use Permit 94-021
that concluded there is no substantial evidence that the project may have
a significant effect on the environment, and a Draft Negative Declaration
(ND) was prepared. The Final ND was adopted by the Planning
Commission on June 9, 2009.
II, The Planning Commission hereby approves Amendment to Conditional Use
Permit 94-021 authorizing an increase in the maximum allowable square footage
of office space from 115,500 square feet to 142,900 square feet within the
existing buildings at the Tustin Business Center located at the southerly corner of
Red Hill Avenue and Edinger Avenue, subject to the conditions contained within
Exhibit A attached hereto,

AMENDMENT TO CONDITIONAL USE PERMIT 94-021
CONDITIONS OF APPROVAL
GENERAL
(1) 1.1 The proposed project shall substantially conform with the project as
approved by the Planning Commission on June 9, 2009, which is on file
with the Community Development Department, as herein modified, or as
modified by the Director of Community Development in accordance with
this Exhibit. The Director of Community Development may make minor
modifications to the project if such modifications are consistent with
provisions of the Tustin City Code.
(1) 1.2 All conditions in this Exhibit shall be complied with prior to the approval of
any new business license applications or tenant improvement plans for
office uses utilizing the additional office square footage authorized by
Amendment to Conditional Use Permit 94-021, subject to review and
approval by the Community Development Department.
(1) 1.3 Approval of Amendment to Conditional Use Permit 94-021 is contingent
upon the applicant and property owner signing and returning to the
Community Development Department a notarized "Agreement to Conditions
Imposed" form and the property owner signing and recording with the
County Clerk -Recorder a notarized "Notice of Discretionary Permit Approval
and Conditions of Approval' form. The forms shall be established by the
Director of Community Development, and evidence of recordation shall be
provided to the Community Development Department.
(1) 1.4 As a condition of approval of Amendment to Conditional Use Permit 94-021,
the applicant shall agree, at its sole cost and expense, to defend, indemnify,
and hold harmless the City, its officers, employees, agents, and consultants,
from any claim, action, or proceeding brought by a third party against the
City, its officers, agents, and employees, which seeks to attack, set aside,
challenge, void, or annul an approval of the City Council, the Planning
Commission, or any other decision-making body, including staff, concerning

this project. The City agrees to promptly notify the applicant of any such
claim or action filed against the City and to fully cooperate in the defense of
any such action. The City may, at its sole cost and expense, elect to
participate in defense of any such action under this condition.
(1) 1.5 Any violation of any of the conditions imposed is subject to issuance of an
administrative citation pursuant to TCC 1162(a).
(1) 1.6 The applicant shall be responsible for costs associated with any necessary
code enforcement action, including attorney fees, subject to the applicable
notice, hearing, and appeal process as established by the City Council by
ordinance.
1.7 Conditional Use Permit 94-021 may be reviewed on an annual basis, or
more often if necessary, by the Community Development Director. The
Community Development Director shall review the use to ascertain
compliance with conditions of approval. If the use is not operated in
accordance with Conditional Use Permit 94-021, or is found to be a
nuisance or negative impacts are affecting the surrounding uses, the
Community Development Director shall impose additional conditions to
eliminate the nuisance or negative impacts, or may initiate proceedings to
revoke the Conditional Use Permit.
(***) 1.8 All conditions contained within Zoning Administrator Action 94-011 shall be
superseded by the conditions contained in Planning Commission Resolution
4118.
(1) 1.9 Prior to issuance of any Building Permit for additional office space, the
applicant shall submit a written approval from the Orange County
Sanitation District for the additional office use
BUILDING PLAN SUBMITTAL
(3) 2.1 At the time of building permit application, the plans shall comply with the
latest State and the City Tustin adopted Codes: 2007 California Building
Code (CBC), 2007 California Mechanical Code (CMC), 2007 California
Plumbing Codes (CPC), 2007 California Electrical Code (CEC), California
Title 24 Accessibility Regulations, 2005 Title 24 Energy Regulations, City
Ordinances, and State and Federal laws and regulations 2005 Edition.
(3) 2.2 Vehicle parking, primary entrance(s) to the site and building, the primary
paths of travel, cashier space, sanitary facilities, drinking fountain, and public
telephones shall be accessible to persons with disabilities and shall be
shown on the plans. Truncated domes will be required at locations specified
in section 113368.5 and 11278.5 (7) of the 2007 CBC.

(3) 2.3 The plans submitted shall indicate that restrooms are accessible to persons
with disabilities as per State of California Accessibility Standards (Title 24).
Plumbing fixture units are required to comply with the 2007 California
Plumbing Code Chapter 4, Table 4-1 as per type of group occupancy, or as
approved by the Building Official.
(3) 2.4 Parking for disabled persons shall be provided with an additional five (5) foot
loading area with striping and ramp; disabled persons shall be able to park
and access the building without passing behind another car. At least one (1)
accessible space shall be van accessible served by a minimum 96 inch wide
loading area.
USE RESTRICTIONS
(1) 3.1 Office uses permitted by Conditional Use Permit 94-021 shall include
general offices, medical and dental offices, professional offices,
administrative offices and other offices in conjunction with other permitted
uses.
(1) 3.2 The maximum amount of office square footage permitted for the entire
center shall not exceed 142,900 square feet, provided there is adequate on-
site parking. Office area may exceed 50 percent of the floor area for an
individual tenant space.
(1) 3.3 If in the future the City determines that a parking or traffic deficiency exists
on the site or in the vicinity as a result of the proposed project, the
Community Development Director may require the applicant to prepare a
parking demand analysis or traffic study analysis and the applicant shall
bear all associated costs. If said study indicates that there is inadequate
parking the applicant shall be required to provide mitigation measures to
be reviewed and approved by the Community Development Department
and/or Public Works Department.
ORANGE COUNTY FIRE AUTHORITY
(5) 4.1 Prior to the issuance of any permits or approvals, the applicant shall
submit plans and obtain approval from the Fire Chief for fire lanes on
required fire access roads. The plans shall indicate the locations of red
curbs and signage and include a detail of the proposed signage including
the height, stroke and colors of the lettering and its contrasting
background. The applicant may contact the OCFA at (714) 573-6100 or
visit the OCFA website to obtain a copy of the "Guidelines for Emergency
Access Roadways and Fire Lane Requirements."

(5) 4.2 Prior to the issuance of any certificate of occupancy or final approval, the
fire lanes shall be installed in accordance with the approved fire master
plan. The CC&Rs or other approved documents shall contain a fire lane
map, provisions prohibiting parking in the fire lanes, and a method of
enforcement.
FEES
(1) 5.1 Within forty eight (48) hours of approval of the subject project, the
applicant shall deliver to the Community Development Department, a
cashier's check payable to the COUNTY CLERK in the amount of fifty
dollars ($50.00) to enable the City to file the appropriate environmental
documentation for the project. If within such forty-eight (48) hour period
the applicant has not delivered to the Community Development
Department the above noted check, the statute of limitations for any
interested party to challenge the environmental determination under the
provisions of the California Environmental Quality Act could be
significantly lengthened.
(1) 5.2 Prior to issuance of any permits, the applicant shall pay all applicable
Building and Planning plan check and permit fees to the Community
Development Department.
