HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION APPROVAL OF CONSULTANT SERVICES AGREEMENT FOR MAIN STREET AND BRYAN AVENUE PAVEMENT REHABILITATION PROJECTS (CIP NOS. 7163, 7164, 7166, 7167) SUMMARY The approval of a Consultant Services Agreement with Norris Repke, Inc. will provide for engineering design services for the Main Street and Bryan Avenue Pavement Rehabilitation Projects (CIP Nos. 7163, 7164, 7166, 7167). The limits of rehabilitation for Main Street include one segment between Stoneglass and the SR-55 Fwy (CIP No. 7163) and a second segment between Newport Avenue and Bryan Avenue (CIP No. 7167). The limits of rehabilitation for Bryan Avenue include a first segment from Newport Avenue to Red Hill Avenue (CIP No. 7166) and a second segment from Red Hill Avenue to Browning Avenue (CIP No. 7164). RECOMMENDATION It is recommended that the City Council approve the Consultant Services Agreement with Norris Repke, Inc., for the Main Street and Bryan Avenue Pavement Rehabilitation Projects (CIP Nos. 7163, 7164, 7166 and 7167) in the amount of $103,990, and authorize the Mayor and City Clerk to execute the Consultant Services Agreement on behalf of the City. FISCAL IMPACT The Consultant Services Agreement is task oriented and Norris Repke, Inc., will invoice for actual services performed. The total cost of services to be performed for this project is $103,990. These services will be performed during FY 01/02. The FY 01/02 Capital Improvement Program Budgets for the Main Street and Bryan Avenue Rehabilitation Projects (CIP Nos. 7163, 7164, 7166, 7167) have adequate funds for this work. BACKGROUND Proposals to perform engineering design services for this project were requested from several firms and three (3) proposals were received. Based upon review of the proposals, familiarity with the project area and past performance on similar projects, it is recommended that Norris Repke, Inc. provide the engineering design services required of this project. The fee for this project has been deemed fair and reasonable. Approval of Consultant Services Agreement for Engineering Design Services on Main Street and Bryan Avenue Rehabilitation Projects (CIP Nos. 7163, 7164, 7166, 7167) January 22, 2002 Page 2 A Consultant Services Agreement with Norris Repke, Inc., for engineering design services for the Main Street and Bryan Avenue Rehabilitation Projects (CI'P Nos. 7163, 7164, 7166, 7167) is submitted for Council's consideration. The City Attorney has reviewed and approved this agreement as to form. The subject rehabilitation projects will be designed this fiscal year and it is anticipated that construction will commence next fiscal year (FY 02,03). Construction for the segment of Main Street between Stoneglass and the SR-55 Fwy (CIP No. 7163) and the segment of Bryan Avenue between Red Hill Avenue and Browning Avenue (CIP No. 7164) will be federally funded in part by the Orange County Combined Transportation Funding Program's (CTFP) Arterial Highway Rehabilitation Program (AHRP). RECITALS WHEREAS, City requires the services of a consultant to furnish the necessary engineering services for the Main Street and Brgan Avenue Rehabilitation Projects (CI.P Nos. 7163, 7164, 7166, and 7167) hereinafter referred to as "Project"; and, WHEREAS, Consultant has submitted to City a proposal dated December 10, '2001 a copy of which is attached hereto, marked as Exhibit "A" and is by this reference incorporated into this Agreement; and WHEREAS, Consultant is .qualified to provide the necessary services for the Project and desires to provide said services; and WHEREAS, City desires, to retain the services .of Consultant for said Project. ,. NOW, THEREFORE, for the consideration and upon the terms and conditions hereinafter set forth, the parties agree as follows' AGREEMENT Section 1: Scope of Consultant;s Services. Consultant shall perform all work necessary to complete in a manner satisfactory to City, the services set forth in Exhibit "A". Any "Special Requirements" or additional terms and conditiOns of this Agreement are set forth in Exhibits "B", "C", and "D" and are incorporated herein by this reference. Section 2: Order of Precedence. In the event of a conflict between or among any of the documents comprising this Agreement, the following order of precedence shall govern the provision in question' 1. This Agreement 2. Special Requirements Exhibit "B", "C" and "D" 3. Consultant's 'Proposal (Exhibit "A") Section 3' Time for Completion. The time for completion of the work to be performed by Consultant is an essential condition of this Agreement. Consultant shall prosecute regularly and diligently the -1- S:\CSA & RFP~2001\CSA Norris Repke Bryan & Main.doc work of this Agreement according to reasonable schedules established by the City for various items described and as outlined within Consultant's-proposal. Consultant shall not be accountable 'for delays in the progress of its work caused 'by any condition beyond its control and without the fault or negligence of Consultant. Delays shall not entitle Consultant to'any additional compensation regardless of the party responsible for the delay. Section 4' Compensation. Ao The compensation to be' paid under this Agreement shall be as set forth in Exhibit "A", not to exceed a total' cost of $103,990.00.- B. C. Consultant shall submit 'detailed invoices, based upon the actual work performed accompanied by backup documentation as requested by the City. " Progress payments for work completed shall be paid by City as the work progresses, within thirty (30) days of the date of'Consultant's invoice. D. Consultant shall provide City with a monthly itemization of all. work performed, and the fees accrued thereon, in complete and sufficient detail to fully apprise City thereof. Section 5: Independent Contractor. Consultant's relationship to City in the performance of this Agreement is that of an independent contractor. Consultant's personnel performing services under this Agreement shall at all times be under Consultant's exclusive direction and control and shall be employees of Consultant and not employees of City. Consultant shall pay ali wages, salaries and other amounts due its employees in connection with this Agreement and shall be responsible for all reports and obligations respecting them, · such as social security, income tax withholding, unemployment compensation, workers' compensation .and similar matters. · . Section 6' Indemnification. Consultant agrees t© indemnify, defend and hold City, its officers, agents, employees, successors and assigns harmless from any loss, damage, injury, sickness, death, or other claim made by any person and from all costs, expenses and charges including attorney's fees caused by or arising out of Consultant's, its officers', agents', subcontractors', or employees' negligent acts, negligent errors, or negligent omissions or willful misconduct, or conduct for which the law imposes strict liability on Consultant in the performance or failure to perform this Agreement. Section 7-Insurance. , ,, , ,,, Ao Consultant shall maintain in full force and effect during the term of this Agreement policies of comprehensive general liability, personal injury and -2- S:\CSA & RFP~001\CSA Norris Repke Bryan & Main.doc automobile, liability insurance with limits of at least $1,000,000 combined single limit coverage per occurrence. .B. Consultant shall maintain in full force and effect during the term of this Agreement a policy of professional liability insurance.coverage with limits of at least $1,000,000 combined single limit coverage, per claim or per occurrence. If Consultant provides claims made"pr°fossional liability insurance,. Consultant shall also agree in writing either (1) to purchase tail insurance in the amount required by this Agreement or to cover claims made within five (5) years of the completion of Consultant's service Under this Agreement, or (2) to maintain professional liability insurance coverage with the same carrier in the amount required by this Agreement for at least five (5) years after completion of Consultant's services under this Agreement. Consultant shall also provide evidence to the City of the purchase of the required' tail insurance or continuation of the professional liability policy by executing the attached Letter Agreement on Consultant's letterhead. Co Consultant shall:carry and pay fo.r such compensation insurance as is necessary to fully protect Consultant and its employees under California Worker's Compensation Insurance and Safety Laws, and shall-relieve the City from' all responsibility under said laws in Connection 'with the performance of this Agreement. D. All insurance required pursuant to this Section shall be issued by a company admitted in the State of California and rated A, VII or better .by the latest edition of Best's Key Rating Guide. · E. Upon execution of-this Agreement, Consultant shall provide to City certificates of insurance on the City's form evidencing the required insurance. If self-insured for worker's compensation, Consultant shall submit to City a Copy of its certification of self-insurance issued by the Department of Industrial Relations. ,Section 8' Termination. of. Agreement. A. City shall have the right to terminate any or all of the services covered by this Agreement at any time for any reason by giving written notice to Consultant. B. Upon termination of this Agreement, Consultant .shall be paid for' services rendered by the effective date of the.termination.. C. Upon' termination of this Agreement or completion of the Project, all docUments relating to the Project shall become the sole property of City. Should City terminate this Agreement pursuant .to subparagraph A. of this Section, Consultant shall, within ten (1:0) business days .of receipt of notice of termination., .provide City with all documents within 'Consultant's possession relating .to this. Agreement and the Project, including but not' limited to all completed documents and all drafts of 'uncompleted documents. This Agreement shall extend, to and be binding upon and inure to the benefit of heirs, executors, administrators, successors and assigns of the respective parties hereto. D. Consultant shall perform all services, required under this Agreement using that degree of care and skill ordinarily exercised under similar conditions in similar localities, and shall be responsible for all errors and omissions for services performed by COnsultant under the terms of this Agreement. Consultant certifies that there shall be no discrimination against any employee who is employed in the work covered by this Agreement, or against any application for such employment, because of race, religion, color, sex or national origin including but not limited to, the following' employment, upgrading, demotion or transfer, recruitment, or recruitment advertising, lay-off or termination, rate of pay or 'other forms of compensation, and selection for training, including apprenticeship. This proposal is based' on the City's Request for ProPosal (RFP) and our extensive background in public works and street rehabilitation projects. Section 5.0: Project Schedule Phasing of work including proposed time schedule, with milestone dates, is provided. · Section 6.0: Additional Information · Section 6.0: Appendix · The proposed fees are presented under separate cover as requested. 1.2 Project Descripfion The City's RFP describes the work to be completed on four separate road segments: 1) Main Street from Stoneglass .to the SR-55 Freeway (CIP No. 7163); 2).Bryan Avenue from Red Hill Avenue to Bro~g Avenue (CIP No. 7164); 3) Mm Street from Nexvport Avenue to Bryan Avenue (CIP No. 7167); and 4) Bryan Avenue from Newport Avenue to Red Hill Avenue (CIP No. 7166)'. The project, in general, consists of the preparation of construction plans, specifications, and cost estimates. The proposed improvements include crack sealing,' cold planning the pavement at the edge of existing concrete, improvements, and joins at project limits, reconstruction of failed pavement and damaged concrete improvements, replacement of traffic signal loops, .restriping, and' adjustment of manholes and utility valves..Our scope of work also includes review of the pavement report provided to us by the City and to verify whether the preliminary analysis is adequate. Two of the project segments will be partially funded with A3-nLP funds therefore the Caltrans Federal Local Transportation Program requirements will be complied with. Main Street and Bryan. (CIP No. 7163)' , The.existing facility is an east-west roadway .with one lane of travel in each direction with a painted median and a traffic.signal at Stoneglass. There. is an existing sidewalk adjacent to the curb on the north side of' the street and a right mm only lane at Stoneglass' for westbound traffic.(see photo no. I at the end of this section). The segment is the approach to the SK-55' Freeway overpass with no access points to the adjacent properties.. The existing pavement is in poor condition with several areas throughout.the project of obv/ous pavement failures. Typical .pavem. ent conditions include alligator cracking, longitudinal cracking, and transverse cracking (see photo no. 2). The condition of the existing curb and gutter in general appear to be good with a few exceptions. ... Major Issues: · Coordination with Caltrans · Existing pavement condition Bryan Avenue between Red.Hill Aven.ue an.d Browning Avenue (CIP No. 7164) The existing facility is an east-weSt roadway with two lanes of travel in each direction with a painted median and bike lanes on each side of the street. There are traffic.signals at Red Hill Avenue, Farmington Road, and Browning Avenue. The adjacent properties are single-family residences with the exception of the intermediate school on. the south side of the street at Browning Avenue. There are existing sidewalks, along the entire street, some of which has recently been replaced (see photo no. 3), except for on the north side just west of Browning Avenue where there is a raised,' landscaped parkway that 'separates the street from a frontage road (see photo no 4). There are existing street trees with tree .wells in the parkway. The existing pavement is fair condition. Major Issues: .. * .Existing. cross fall slopes · Construction traffic concerns adjacent to intermediate, school Main Street between Newport Avenue and BrYan Avenue (CIP No. 7167) The existing facility is an east-west roadway with two lanes of travel in each direction. There is a raised median at the west end of the segment near Newport Avenue (see photo no. 5). The easterly section, is striped with a double-yellow centerline. The adjacent properties are commercial-on the. north side of. the street. The 'south side has one commercial strip center at the west end and the .remaining area is developed with multi-family residential units. There are a number of points of access along the street to the various properties and existing flail parkway sidewalks with street trees in tree wells'(see photo no, 6). There are raised channelizafion islands at both ends of the project limits. At the east end, the island provides for a. fight nam movement (see photo no. 7). There. are traffic signal poles located within the island. At the west end, there are two raised islands that are on Bryan Avenue and are discussed below. IP '.No. 7166) The existing fadlity is an east-west roadway with two lanes of travel in each direction separated with a double-yellow centerline east of the transition to Main Street. West of. the Main Street intersection, the street is striped for one.lane of'traffic in each direction. At 1Vfain Street, the eastbound Main Street traffic transitions directly to eastbound Bryan Avenue without stopping. Westbound traffic can either continue west on Bryan Avenue or veer to the left and transit/on to' Main Street. Eastbound traffic on Bryan Avenue from Newport Avenue must stop at the Main Street/Bryan Avenue transition (see photo no. 8). There are traffic signals at Newport Avenue .and Red Hill Avenue. The adjacent properties west of the intersection with Main Street are commercial developments. East of Main Street the properties are single family resident/al on the north while the south side has multi-family . residential near Main Street, single family residential in the center section; and Pine Tree Park west.of Red · Hill Avenue with an on-street parking lane (see photo no. 9). There are existing sidewalks and street trees along the entire length of the street. 'There are two raised islancls at the intersection, with Main Street. One separates the eastbound fight roms from the left turning traffic and has a stop sign installed in the island (refer to photo no. 8). The larger island proxfides separation for westbound traffic proceeding either on Bryan Avenue or on to Main Street and eastbound traffic on Bryan Avenue (see photo no. 10).. The existing pavement is in fair to poor condition with several areas throughout the project of obvious pavement failures, some of which appear to have been previously marked for removals .(see photo nos. 11 al2). Major Issues: · 'Existing cross £~U slopes * Striping between Newpo .~ Avenue and Main Street 1.4 Project Elements Based On the Request for Proposals, our site visit and our past experience with the design of the several similar projects, the folloxving will present what we believe are some of the key elements and major considerations of.the project that w/ll need to be addressed to insure this is a successful project.. Rehabilitation Method and Design: We have had the opportunity to review the Materials Reports prepared by the County of Orange Public Facilities and Resources Depaxtment. for each'of the four street segments. The existing pavement on both Main Street segments has recommendations for overlay strategies for rehabilitation to a 20;year life. The 'Materi~s Reports for both Bryan Avenue segments have overlay recommendations for a 10-?ar life. 'To achieve a 20-?ar.~fe on Bryan Avenue the reports, indicate the roadway segments would require a total reconstruction. At this time, we recommend the overlay strategies for Bryan Avenue unless it is determined, the overlay strategies will create cross slopes of an unacceptable nature. Upon completion of the design sur~ey services and review of the existing and proposed cross slopes, a final recommendation will be provided to the City. It has typically, been our experience that the design of the final pavement rehabilitation requires a detailed review by the Project Engineer of the Pavement Report. Some existing conditipns that may need to be considered during the rehabilitation design, such as maintaining proper pavement cross- fails. Additional refinements to the general recommendations in the materials report are a Norris Repke specialty to de~relop a "best fit" economical rehabilitation strategy. Street and Browning Avenue is an issue that'needs to be addresse'd. From our initial field review,.it appears that the existing crown line is offset to the north of centerline. It also appears that 'the existing cross fall is greater than current design standards. A. typical overlay with edge grinding only may increase the cross fall to unacceptable levels.' Field sur~ey cross sections will be required to obtain the true. existing conditions and determine the proper method of rehabilitation to'address the situation. Norris Kepke has extensive experience in street rehabilitation projects having completed several rehabilitation projects for over 25 agendes in the last five years. We are familiar with materifls repons and the rehabilitation methods' typically recommended. We are .comfortable and experienced in working with geotechnical engineers and the City of Tustin staff in. choosing, the most effective yet economical street rehabilitation alternate. B.. Curb, Gutter, Sidewalk and Drive Approach Repair The existing curb and gutter appear to be generally in good condition. However, the~e are some damaged sections 'scattered throughout the project (see photo nos. 13 thru 19). During our initial field review we identified some areas. (see photo no. 18) where the sidewalk has been.lifted by existing trees, but the "path of travel" is in compliance with'ADA requirements. We also noted some existing areas that have been marked for removal (see photo 19). During the detailed street evaluation phase of the project we will take note of broken.or depressed curb and gutter and confirm concttrrence with the City staff prior to. theix, inclusion in the project improvements. Our extensive experience with rehabilitation projects, including the preparation of recent citywide curb, gutter and sidewalk repair contracts for several dries, will be a .valuable asset in this element of the work. C. Construction Phasing and Traffic Control Traffic control and local access during construction will need to be addressed as part of the PS&E preparation. Access to the existing commerdal businesses along Main 'Street and Bryan Avenue will have to be maintained during the construction-phase of the project. The project spedfications 'will include requirements and guidelines for preparation and submittal of. traffic control plans by the contractor for street rehabilitation projects. Norris Repke has extensive experience in the preparation of specific requirements in the project specifications regarding access and phasing for the construction of the project. D. Utility Coordination: · As with most projects in existing public right-of-way, utility location notification and coordination is an important aspect of the project. Norris Kepke }las extensive experience in this .area and has a long established and .successful comprehensive utility notification procedure to insure we have done all that is reasonable to eliminate cosily utility conflicts. Early notification and dose communication are necessary to avoid delays and construction Problems. The project will also require .the adjustment of existing manholes and water valve covers. Notices to existing utility owners to service their facilities, check for leaks, etc., will also be coordinated to insure the new pavement surface will remain intact for years to come. We will also advise the utility companies of the City:s excavation moratorium for the project limits. E. ADA Compliance: · As with all street improvement projects, compliance with ADA regulations is a design criteria that must be considered. Although there are some curb access ramps to appear to be in compliance with Main'Street and Bryan Avenue Rehabilitation Projects Page 4 of 25 .NORRIS-~ ^'s~'~"' ~~'" Cit~. of Tustin ADA requirements (see photo no. 20), the majority of the existing ramps are not (see photo no. 21). Another area that will need to be discussed is the existing drive approaches (see photo no. 22). Most of the drive approaches do not provide a "path of travel" .that meets ADA regulations. Norris Repke has considerable experience in design of street improvements to conform to ADA requirements. We have completed _ADA upgrade projects in the City's of Costa Mesa, Pomona and San Gabriel'and have dealt with this issue on many street improvement projects. 'Photo 1. This will include reconstruction area recommendations as well as overlay and other surface treatment recommendations. · Determine areas requiting special treatment due to excessive or insufficient cross-fall. · Potential curb,, gutter and drive approach repair recommendations. · Signing and striping replacement feed back. · Preliminary storm dr~n .catch basin and connecter pipe locations and layout. Preliminary design for the reconstruction of the intersections required to remove the existing cross gutters. · ADA compliance recommendations. Hydrology Calculations Norris Kepke proposes to perform additional research and prepare minimal hydrology calculations to adequately size the catch basins that will be required to eliminate the existing cross gutters discussed above. This w/ll include the following: · Obtain copies of the .available existing street improvement plans to determine drainage patterns. , · Based on'the drainage patterns, calculate the tributary areas for each of the proposed catch basins. Utilizing County of Orange hydrology criteria, calculate the storm water run-off for each tributary area and the size the catch basins accordingly. · Prepare a brief report of findings and submit to the City. Task G. City Staff Meeting · Meet with City staff to present and discuss results of the conceptual designs and reach concurrence on the 'project elements prior to. final construction plan preparation to insure the best solutions are achieved that are within the existing budget constraints. The. completed plans and specifications shall conform to AHRP funding guidelines, including all other criteria necessary as well as the City of Tustin requirements as provided in the RFP. Three separate sets of PS&E wil/be, prepazed as requested. Task A. Construction Plans " . 1. Prepare project Tide Sheets using AutoCAD 14. Tide sheets to Contain general, notes, location map, utility contact information, special instructions to bidders and sheet index. . Prepare plan only construction plans, eight sheets with two" (2) strips per sheet, using the previously prepared base sheets showing construction to conform to the approved concept designs. Included.on these sheets would' be any reconstructed curb and gutter, driveways,' and access ramps and any new PCC installations such as new sidewalk and bus pads. Close coordination with UPRR, the City and property owner was required on this difficult design. City o£ Tustin, Red Hill Avenue Traffic signal, signing and striping improvements for Red Hill Avenue between Nisson Road and the southbound Interstate 5 on-ramp. Improvements were completed in conjunction with a Taco Bell restaurant for the City. The scope of work included two signal modifications. One signal was located at N/sson Road, and another-at the Interstate 5 on/off ramps. The project also included a traffic control plan for the proposed improvements' where a Caimans encroachment perr~t was required. We then installed R73-7 signs to the left of the vehicle heads to cover the exposed mast arm. .. As part .of the project, 18 intersections were modified due to the removal of the 40' wide center median and the eventual narrowing of the roadway. The project consisted of 3 stages of construction, which affected the majority of the intersections on the west side of Santa Momca Boulevard. The design included temporary traffic poles, ~g, signal pole relocations, pull boxes, controllers and service cabinets, as well as preparation-of signal interconnect plans over the 3-mile stretch of roadway. Upon completion 'of design, over 43 traffic signal modification plans were prepared in 8 weeks. The Consultant shall not release to the .public-or press 'any information regarding the purpose/scope of services to be accomplished or data specific to the 'project required under the Agreement without prior authorization of the Contract Officer. All such information is considered confidential. All inquiries made of Consultant shall be immediate referred to the Contract Officer. The Contract Officer for the project shall be the City's Engineering Services Manager. · 'Consultant shall present to the City certificates'of insurance and endorsement forms verifying that the Consultant has 'the insurance as required by this Agreement. Said form shall be reviewed and approved by the office of the City Attorney. A certificate of insurance form is attached. Consultant shall 'utilize those professional staff members to perform services as identified in Consultant's proposal. No substitution shall be made without the advance written approval of the Contract Officer. No increase in comPensation or reimbursable salary rates will be allowed when personnel or firm substitutions are authorized by the Contract Officer: The Consultant shall review and replace project personnel who do not perform assigned duties in a' manner satisfactory to Contract Officer when requested by Contract Officer. Monthly progress reports.shall be submitted by Consultant with billing requests. At minimum, these reports shall 'specify the period reported, tasks completed, tasks underway, percent of project completed and strategies to solve any timing delays. Consultant shall be required to meet.with the Contract Officer as determined necessary or desirable to discuss elements of the Scope of Work and project's progress. Field Investigation necessarY. The Consultant shall obtain all necessary field data and make investigations and stUdies necessary to Properly accomplish the work required under this Agreement. -1- EXHIBIT "C" SCHEDULE. OF COMPENSATION Compensation , As comPensation for the Consultant's services under this Agreement, the City shall pay the Consultant a not-to-exceed fixed amount of.$103,990.00. Expense Reimbursement a. The Consultant's not-to-exceed compensation for services under this Agreement may include reimbursement for miscellaneous expenses. The City shall reimburse Consultant for direct 'expenses of reproduction. Itemized payment statements shall set forth in detail all actual reimbursement expenses during the preceding month. ..C..ompensation for Additional Services , in the event the City requires services in addition to those described in Exhibit A and B, said services must first be approved in writing by the Contract Officer. The Consultant shall be compensated at the Consultant's standard hourly rates for professional services, plus reimbursement.of expenses or a fixed amount agreed to in writing by.the City and .Consultant. Method of Payment , As a condition of precedent to any payment .to Consultant under this Agreement, Consultant shall submit monthly to the City a statement of account which clearly sets forth by dates the designated items of Work, as well as reimbursable expenses, for which the billing is submitted. The payment request shall identify each task required by the Agreement, percent of completion, amount of actual reimbursable expenses and requested amount to be billed against each task. .Timing of Payment , The City shall review Consultant's.monthly statements and pay Consultant for services rendered and costs incurred hereunder, at the rates and in the amounts provided. hereunder, on a monthly basis in accordance with the approved monthly statements. -1- EXHIBIT '"D" SCHEDULE OF PERFORMANCE The completion date of the SCope of Services, as described in this Agreement,. for C.I' P. Nos. 7163 and'7164 shall be fourteen (14).weeks after receipt of a Notice to Proceed. In addition, the completio, n date of the Scope of Services, as described in this Agreement, for C.I.P. Nos 7166 and 7167 shall be twenty-three. (23) weeks after receipt of a Notice'to Proceed. The schedules submitted with Consultant's revised proposal dated December 10, 2001, shall be incorporated as part of this Agreement and shall be the baseline schedule for the Project. If any deviations from the. baseline schedules occur, the reasons for the deviations shall be provided to the City .in writing.
