HUSTON, CITY MANAGER[/~ RESOLUTION NO. 02-6 RECOMMENDATION' That the City Council adopt Resolution No. 02-6 requesting that the Orange County Board of Supervisors certify Environmental Impact Report (EIR) 582 and approve amendments to the John Wayne Airport Settlement Agreement consistent with Scenario 1 of EIR 582. DISCUSSION: It has been City Council policy to oppose expansion of John Wayne Airport due to the negative impacts on the community. The current Settlement Agreement for John Wayne Airport limits the number of commercial flights, passenger capacity and imposes a noise curfew. The Settlement Agreement expires December 31, 2005. The County of Orange recently released an EIR (No. 582) which evaluates the impacts of extending the Settlement Agreement under three scenarios. The cities of Anaheim, Costa Mesa, Newport Beach, Orange, Santa Ana and Tustin have worked together to assess which scenario would be best for all concerned. The cities have reached a consensus that Scenario 1 would best protect the interests of all communities and provide the County an opportunity to reasonably expand John Wayne Airport. Scenario I of the EIR 582 provides for: (~) (2) (3) (4) Extension of the Settlement Agreement to 2016; Twelve additional noise-regulated flights per day effective January 2005 An additional 1.4 million annual passengers (current capacity is 8.4 million passengers) Extension of the curfew (11:00 p.m. to 7:00 a.m.) Scenarios 2 and 3 of EI R 582 would allow more passengers and flights. RESOLUTION NO. 02-6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN REQUESTING ORANGE COUNTY BOARD OF SUPERVISORS' APPROVAL OF AN AMENDMENT OF THE JOHN WAYNE AIRPORT SETTLEMENT AGREEMENT CONSISTENT WITH SCENARIO 1 OF ENVIRONMENTAL IMPACT REPORT (EIR) 582 WHEREAS, the John Wayne Airport Settlement Agreement (Settlement Agreement) establishes limits on the number of passengers and noise regulated departures that were and are consistent with the number of passenger loading bridges and the size of the terminal; and WHEREAS, the County of Orange--through the efforts of the Board of Supervisors, Chief Executive Officer, Airport Director and Special Counsel--has strictly complied with the letter and the spirit of the Settlement Agreement; and WHEREAS, a substantial number of residents of the cities of Anaheim, Costa Mesa, Newport Beach, Orange, Santa Ana and Tustin (Corridor Cities) are adversely impacted by noise, air pollution and/or traffic generated by commercial aircraft operations at the John Wayne Airport; and WHEREAS, the County of Orange has, in cooperation with the City of Newport Beach, prepared EIR 582 which evaluates the potential impacts of three "scenarios" (Scenarios 1, 2 and 3) and concludes that, of the three project scenarios, Scenario 1 is environmentally superior; and WHEREAS, the elected representatives of the Corridor Cities have determined that amendment of the Settlement Agreement consistent with Scenario 1 would adequately protect the quality of life and property values of their respective constituents and comply with federal law; l0 12 13 14 1'7 20 21 22 23 24 27 28 29 WHEREAS, the elected representatives of the Corridor Cities request the Board of Supervisors approve a Settlement Agreement amendment consistent with Scenario 1. NOW, THEREFORE, the City Council of the City of Tustin resolves to request the Orange County Board of Supervisors certify EIR 582 and approve amendments to the Settlement Agreement consistent With Scenario 1 on February 26, 2002.
