SUBJECT: NON- PROFIT PROGRAM SUBSIDIES AND FEE WAIVERS
SUMMARY:
At their July 21, 2009 meeting the City Council directed staff to return with a resolution
embodying a new policy stating all programmatic subsidy and percentage fee waivers
made to non-profit organizations and community groups be eliminated beginning this
fiscal year.
RECOMMENDATION:

FISCAL IMPACT:
The elimination of community funding to the local community groups and non-profit
organizations this fiscal year will reduce expenditures to the General Fund by
approximately $5,575.
DISCUSSION:
Historically, local community groups and nonprofit organizations have solicited the City
Council for direct monetary contributions, facility fee waivers, and city labor cost waivers
to subsidize their special programs and activities.
During a March 20, 2007 special meeting regarding community funding, the City Council
decided to phase-out subsidizing community groups and local non-profits by reducing
the level of community funding by twenty five percent (25%) each fiscal year and
forwarding community funding requests thereafter to the Tustin Community Foundation
for consideration. The Tustin Community Foundation's mission is to advance
philanthropy in the community of Tustin in order to support non-profit organizations and
public institutions which effectively address the needs of the community.
The anticipated requests for community funding for the FY09-10 is $5,575.
• Miss Tustin Scholarship Pageant: $625
• Tustin Unified School District, Grad Nights: $2,250
• Tustin Public Schools Foundation, Dino Dash: $2,700
At the July 21, 2009 City Council Meeting the Council discussed expediting the
complete elimination of community funding and fee waivers to begin one fiscal year
earlier than originally planned due to current budget limitations and possible financial
exposure to State of California takeaways.
The City Council agreed to an exception for The Tustin Area Council for Fine Arts
(TACFA), which, under the previously mentioned phase out program would have
received a 50% waiver this fiscal year for their Broadway in the Park Production.
Because this program is on the City's facility use calendar beginning August 10, the
Council agreed to retain this waiver; however, any fee waivers for this program would
be eliminated and not available beginning FY2010-11.

RESOLUTION NO. 09-44
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, TO ELIMINATE, BEGINNING FY2009-10, THE
EXPENDITURES OF PUBLIC FUNDS THROUGH DIRECT
CONTRIBUTIONS, FACILITY FEE WAIVERS AND CITY LABOR COST
WAIVERS, AS SOLICITED BY COMMUNITY GROUPS AND NON-
PROFIT ORGANIZATIONS FOR SPECIAL PROGRAMS AND
PROJECTS
The City Council of the City of Tustin does hereby resolve as follows:
WHEREAS, local community groups and non-profit organizations have
historically solicited the City Council for direct contributions, facility fee waivers and City
labor cost waivers to subsidize their special programs and projects; and
WHEREAS, historically, the City Council has approved funding support to local
community groups and non-profit organizations; and
WHEREAS, on March 20, 2007, a Special Meeting of the City Council was held
to review the City's role in subsidizing community groups and nonprofits; and
WHEREAS, at the March 20, 2007 Special Meeting of the City Council it was
recommended to phase out the subsidies to community groups and non-profits;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Tustin, California, does hereby approve the elimination of subsidies to local community
groups and nonprofit organizations through direct contributions, facility fee waivers and
City labor cost waivers, beginning with this fiscal year, 2009-10.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin on the 4th day of August, 2009. ,
