HUSTON, CITY MANAGER PATRICK SANCHEZ, DIRECTOR, PARKS AND RECREATION SERVICES REQUEST CITY COUNCIL ADOPT RESOLUTION NO. 02-12 SUPPORTING PROPOSITION 40, CLEAN WATER, CLEAN AIR, SAFE NEIGHBORHOOD PARKS AND COASTAL PROTECTION BOND ACT OF 2002 SUMMARY: Seeking support from our City Council to adopt Resolution No. 02-12 in support of Proposition 40, the Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Bond Act of 2002. RECOMMENDATION: Adopt Resolution No. 02-12, supporting Proposition 40, the Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Bond Act of 2002. DISCUSSION: On October 13, 2001, Governor Gray Davis signed AB 1602 (Keely/Burton), which places before the voters the "Clean Water, Clean Air, Safe Neighborhood Parks and Coastal Protection Bond Act" on the March 5, 2002 ballot. Proposition 40 provides $2.6 billion to improve the quality of life of California and the City of Tustin by providing cleaner air, water, recreation opportunities, safe parks and new conservation and open space preserves. The passage of the bond act requires a simple majority of voter approval. Our community is eligible for funding in five categories totaling $1.1 billion. The City of Tustin will receive $331,000 automatically from the Per Capita Program. A total of $727,500,000 will be available to cities counties and districts through competitive programs. The City of Tustin will be actively involved in participating in the competitive funding process if Proposition 40 is successful. The City of Tustin will be able to utilize these funds to provide needed repairs and enhancements to our park system. Specific projects could include all those listed on our current Parks Capital Improvement Priority List. Program services for afterschool programs are also eligible. Supporters of Measure W, "The Great Park in El Toro," have indicated that a portion of Proposition 40 dollars could be redirected toward improvements on that facility. Those reports are unsubstantiated and have not been validated by California State Legislature and the Governor's Office. Proposition 40 will assist the City of Tustin by supporting much needed improvements to our park system and building new neighborhood parks in our community. FISCAL IMPACT: The State's current General Fund debt capacity is upwards of $25 billion over the next five years. The $2.6 billion in bonds that would be issued under Proposition 40 are well within California's debt capacity. WHEREAS, the City of Tustin local parks serve as a recreational, social, and cultural center for Tustin's families, providing important venues for youth enrichment and safety; community identity; and the protection of parkland and open space; and WHEREAS, in order to maintain a high quality of life for Tustin's population, and a continuing investment in parks and recreation facilities, and WHEREAS, Tustin's citizens and visitors have increased their visits to local parks for health and well being, sense of community, freedom and peace, and WHEREAS, Tustin is known for its incredible community facilities, parks, and open space, and WHEREAS, Tustin is largely an urban community where it is projected to continue to grow, thereby placing more pressure on existing parkland and facilities, and WHEREAS, Tustin's economy is dependent upon maintaining a high quality of life that includes attractive and safe public parks and recreation facilities and services, and WHEREAS, Proposition 40, the Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Bond Act of 2002, provides $2.6 billion for state and local park projects to preserve California's and Tustin's urban areas to expand much needed recreation facilities that serve children, youth, seniors, and families. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tustin, California, supports the passage of Proposition 40, the Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Bond Act, and encourages California voters approve this bond act on March 5, 2002.
