NAULT, FINANCE DIRECTOR RESOLUTION NO. 02-13 APPROVING A NAME CHANGE OF THE ORANGE COUNTY CITIES RISK MANAGEMENT AUTHORITY TO THE CALIFORNIA INSURANCE POOL AUTHORITY SUMMARY: The Board of Directors of the Orange County Cities Risk Management Authority (OCCRMA) has determined that a name change to the California Insurance Pool Authority is more reflective of the JPA's goals to provide a broad range of insurance products and services to a wider market. They are requesting the approval of this change by each member agency per the Joint Powers Agreement. RECOMMENDATION: Adopt Resolution No. 02-13 approving the JPA name change and authorizing the Mayor to sign the amendment to the Joint Powers Agreement. FISCAL IMPACT: None. DISCUSSION: The OCCRMA Board of Directors has worked with a committee of City Managers of the member agencies for the past two years to amend the Joint Powers Agreement and the plan document to provide a higher level of coverage and services to the members. After completing this project the Board felt that a new name for the Authority would be appropriate. After much input and consideration, the Board settled on the California Insurance Pool Authority (CIPA). A name change requires an amendment to the Joint Powers Agreement and approval of two-thirds of the members. Finance Director Attachments OCCRMA:AmendmentOfJo~ntPowersAgreement RefNameChangeToCIPA doc 1 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 02-13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AMENDMENT OF THE JOINT POWERS AGREEMENT FOR THE ORANGE COUNTY CITIES RISK MANAGEMENT AUTHORITY, CHANGING ITS NAME TO THE "CALIFORNIA INSURANCE POOL AUTHORITY" WHEREAS, the City of Tustin ("City") is a Member of the Orange County Cities Risk Management Authority ("Authority"); and WHEREAS, the Board of Directors of the Authority has determined that it is in the best interest of the Authority that it change its name to the "California Insurance Pool Authority"; and WHEREAS, the City Council has reviewed the proposed Amendment, attached as Exhibit 1, and concurs that the name change would be in the best interest of the City. NOW, THEREFORE, BE IT RESOLVED: SECTION 1' The City approves the Amendment to the Joint Powers Agreement for the Orange County Cities Risk Management Authority, attached as Exhibit 1, changing the name of the Authority to the "California Insurance Pool Authority". SECTION 2: The Mayor is hereby directed and authorized to execute and forward the Amendment to the Clerk of the Authority. Thomas Mayor Pamela Stoker City Clerk AMENDMENT TO JOINT POWERS AGREEMENT FOR THE ORANGE COUNTY CITIES RISK MANAGEMENT AUTHORITY This amendment (the "Amendment") to the Joint Powers Agreement for the Orange County Cities Risk Management Authority (the "Agreement") is executed and entered into as of January 1,2002 (the "Effective Date"), by and between the Member Agencies as defined by the Agreement. The Member Agencies agree as follows: WHEREAS, the Member Agencies previously entered into the Agreement, pursuant to Government Code section 6500, et seq., establishing the Orange County Cities Risk Management Authority (the "Authority"); and WHEREAS, the Board of Directors of the Authority has determined that it is in the best interests of the Authority that it change its name to the "California Insurance Pool Authority"; and WHEREAS, each Member Agency has reviewed the proposed name change and concurs that the name change would be in the best interest of the Member Agencies and the Authority, NOW, THEREFORE, for and in consideration of the mutual advantages to be derived therefrom and in consideration of the execution of this Amendment by each Member Agency, The Member Agencies agree to amend the Agreement by adding a new article as follows: ARTICLE IA. NAME CHANGE. (a) The name of the Authority is changed to "California Insurance Pool Authority". All references in the Agreement to "Orange County Cities Risk Management Authority", "OCCRMA", and the "Authority" shall mean "California Insurance Pool Authority" ("CIPA"). (b) The powers, obligations, and responsibilities of the Authority as set forth in this Agreement are not affected in any way by the name change. IN WITNESS WHEREOF, each Member Agency has caused this Amendment to be executed by its duly authorized officers. This Amendment is effective as of the date first written above.
