Regarding CUP 09-016: Andrew Durant, applicant; Brian Sjoberg, 163 North B Street Regarding CUP 09-022: Carolyn Lovett, applicant; Tiana Lovett, daughter of applicant; Yolanda Bibee, 15162 Touraine Way, Irvine, supporting of the application. PUBLIC HEARING: 1. CONDITIONAL USE PERMIT 09-016 - a request for authorization to permit an accessory building to be used as a guest quarters. APPLICANT/ PROPERTY OWNER: ANDREW DURANT LOCATION: RECOMMENDATION 180 NORTH C STREET That the Zoning Administrator adopt Zoning Administrator Action 09-007 approving Conditional Use Permit 09-016. Presentation: Cari Meyer, Assistant Planner Zoning Administrator Agenda August 31, 2009 Page 2 The Public Hearing opened at 10:32 a.m. The Acting Zoning Administrator reviewed the staff report. The Acting Zoning Administrator asked the applicant if he had read and understood the staff report and conditions of approval. Mr. Durant answered in the affirmative. Mr. Sjoberg asked for further clarification concerning the Certificate of Appropriateness process and the Cultural Resources Overlay District. Staff explained that this application does not require the Certificate because the property is not in the Cultural Resources Overlay District. Mr. Sjoberg asked for verification that the structure will not be visible from the street. The Acting Zoning Administrator stated the existing structure is unpermitted but will be brought up to Code; there will be a covenant attached to the property that requires any future owner to follow the restrictions identified; the guest quarters will not be readily visible from the street. Mr. Sjoberg asked if this approval would impact the parking. The Acting Zoning Administrator answered in the negative; this application is intended to bring an existing guest quarters up to Tustin City Code, is strictly for guests, and may not be used as a rental. Homes listed on the Historic Resources Survey are considered very carefully by staff. The Acting Zoning Administrator approved Zoning Administrator Action 09- 007 approving Conditional Use Permit 09-016. The Public Hearing closed at 10:40 a.m. 2. CONDITIONAL USE PERMIT 09-022 - a request for authorization to operate a ballet school for children 4 to 18 years of age. APPLICANT: CAROLYN LOVETT LOVETT DANCE CENTER PROPERTY OWNER: GEORGE MESTOVAS Zoning Administrator Agenda August 31, 2009 Page 3 RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action 09-009 approving Conditional Use Permit 09-022 Presentation: Cari Meyer, Assistant Planner The Public Hearing opened at 10:41 a.m. The Acting Zoning Administrator reviewed the staff report and asked the applicant if she had read and understood the report and conditions of approval. The applicant answered in the affirmative. Mr. Sjoberg asked for the address. Staff explained the location of the proposed studio. The Acting Zoning Administrator Zoning Administrator Action 09-009 approving Conditional Use Permit 09-022.
