2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
3 TUSTIN, CALIFORNIA, AMENDING SECTIONS 9270 AND 9271
OF THE TUSTIN CITY CODE BY REQUIRING A USE PERMIT
AND ESTABLISHING STANDARDS AND CRITERIA FOR THE
4 INSTALLATION OF DISH ANTENNAE
5 The City Council of the City of Tustin does hereby resolve as follows:
0 I. The City Council finds and determines as follows:
7 A. Television Dish Antennae are becoming a popular mechanism for
the receiving of distant broadcast signals for commercial,
8 industrial use and home entertainment.
{) B. Dish antennae have the potential of adding visual pollution,
obscuring vistas, reducing open space and adversely impacting
10 community ameni ties.
11 C. The review of certain antenna installations by the Planning
12 Commission, and the opportunity for adjoining property owners to
express their comments and concerns, warrants the requirement of
13 a use permit for the preservation of community aesthetics.
14 II. The City Council hereby amends Sections 9270 and 9271 of the Tustin
City Code to include the following:

16 (f) Dish Antennae located in residential zones exceeding three (3)
17 feet in diameter and located other than in rear yard areas
obscured from publ i c ri ght-of-way view.
18 (g) Dish Antennae located in all zones other than residential,
exceeding three (3) feet in diameter and not fully screened or
19 otherwise obscured from publ i c ri ght-of-way view.

9.] y. Criteria for dish antenna installation.
22 (1) Definitions. For the purpose of this section, a dish
antenna is a disc-shaped antenna either solid or mesh type
23 construction exceeding three (3) feet in diameter, intended
but not limited to the purpose of receiving communications
24: from an orbiting satellite transmitter.
25 (2) Location:
26 (a) Residential Zones: A Dish antenna installed at ground
level in the rer yard and obscured from public
27 right-of-way view is exempt from the requirement of a

use permit. If a useable signal cannot be obtained
3 from a rear yard location the dish antenna may be
located in the side yard of the property or on a
I building roof subject to issuance of a use permit.
5 (b) Non-residential Zones: A Dish antenna located at
ground level or on a building roof completely obscured
6 from public right-of-way view is exempt from the
requirement of a use permit. Those antennae which
'7 cannot be obscured as determined by City staff are
8 subject to issuance of a use permit.
9 (3) Antenna Color Compatibility: All Dish antennae shall be
compatible in color with their surroundings and not include
signage whether manufacturer's name or other advertising.
10 Antennae shall be painted to match surrounding background
if only partially obscured or to match dominant building
11 color if roof mounted.
12 (4) Height Limitations:
13 (a) Residential Zones: Dish antennae shall not exceed the
maximum building height limit permitted in the zone if
]l roof mounted nor exceed ten (10) feet in height if
15 ground level mounted.
16 (b) Non-Residential Zones: Dish antennae shall not exceed
the maximum building height limit permitted in the
zone if roof mounted nor exceed fifteen (15) feet in
17 height if ground level mounted.
18 (5) Building Permits: A building permit shall be obtained
prior to the installation of any dish antenna exceeding
19 three (3) feet in diameter.
20 PASSED AND ADOPTED at a regular meeting of the Tustin City Council held on
21 the 4th day of February , 1985.
