CONDITIONAL USE PERMIT 09-023 - a request for authorization to sell beer and wine for on-site consumption (ABC License Type 41) in conjunction with an existing restaurant located at 14131 Red Hill Avenue. APPLICANT: PROPERTY OWNER: LOCATION: RECOMMENDATION MANOJKUMAR C. NILKANTH TRADITIONS RESTAURANT HUBERT G. WILSON LARRY SMITH 14131 RED HILL AVENUE That the Acting Zoning Administrator take no action and forward this item to the Planning Commission for consideration and action. Presentation: Cari Meyer, Assistant Planner The Acting Zoning Administrator explained that, due to the long history of this location, the request would be referred to the Planning Commission meeting of October 13, 2009. The Acting Zoning Administrator asked if the attendees had any questions. Mr. Manoj C. Nilkanth, the applicant, had no questions. Zoning Administrator Action Agenda October 5, 2009 Page 2 Mr. Dick Evitt, representing All Star Realty, asked if staff anticipated a favorable recommendation to the Planning Commission. Staff responded in the affirmative. Mr. Evitt stated that the intention would be to upgrade to a Type 47 license as soon as that is allowed and asked if that would be a problem. The Acting Zoning Administrator indicated that such requests are typically authorized administratively by the Community Development Director but that may not be the case given the history of this location.
