HomeMy WebLinkAbout07 Zoning Administrator ActionsITEM #7 i`T ~ ~ ~~ PATE: OCTOBER 13, 2009 (~ ~ ~ (" - (; O m~~ ~~` _S C TO: PLANNING COMMISSION FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: ZONING ADMINISTRATOR ACTIONS BACKGROUND A member of the Planning Commission has requested that Zoning Administrator actions be placed onto each Planning Commission agenda. Staff provided the Planning Commission a report in February 2008 that clarified the role and responsibilities of the Zoning Administrator position as established by City Council adoption of Ordinance No. 552 in May 1972 and significantly updated by Ordinance No. 1157 in December 1995. At that time, it was noted that the Zoning Administrator has the authority to approve, conditionally approve, or deny any of the minor adjustments, variances, conditional use permits, etc. identified in the Ordinance (Section 9299 of the Tustin Municipal Code). The Zoning Administrator function is fulfilled by the Director of Community Development or designee. The Zoning Administrator hears approximately 15 cases per fiscal year. As stated in the Ordinance findings, City Council determined that the purpose of the Zoning Administrator is to improve the processing efficiency for certain routine minor variations and administrative actions. The applicant or any interested party may appeal any action of the Zoning Administrator to the Planning Commission, or an appeal of a design review application within a redevelopment project area to the Redevelopment Agency when filed within seven days of the Zoning Administrator action. Staff currently provides the Planning Commission two opportunities to review Zoning Administrator actions. First, all Zoning Administrator actions are immediately forwarded to the Tustin City Council and Planning Commission following a decision. Second, Community Development Department staff provides the Planning Commission with a quarterly Project Summary Report that identifies the status of all Community Development projects and activities (including Zoning Administrator actions) that occurred during the previous three months. Staff believes that current Community Development reporting procedures are sufficient in light of the routine and minor nature of all Zoning Administrator actions. ~~ ~ U o'd~--~ Dana L.
