STACK, ACTING DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: AWARD OF A CONSTRUCTION CONTRACT FOR THE TUSTIN CIVIC CENTER ROOF REPLACEMENT PROJECT (CIP No. 1032) SUMMARY Staff is requesting that the City Council reject the lowest bid as non-responsive and award the construction contract for the Tustin Civic Center Roof Replacement project to the lowest responsible bidder. RECOMMENDATION It is recommended that the City Council find the bid submitted by the apparent lowest bidder, Solar Integrated Technologies, Inc., to be nonresponsive and award the construction contract for the Tustin Civic Center Roof Replacement Project (CIP No. 1032) to the second lowest bidder, RGSLA, Inc., in the amount of $407,676.00 and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City. FISCAL IMPACT Sufficient funds for this project are available in the Fiscal Year 2009-2010 Capital Improvement Program Budget. BACKGROUND The roofs on the Civic Center buildings have reached the end of their useful life and are showing signs of deterioration from age and the elements. Over the last few years, Field Services crews have worked at length to locate and repair roof leaks that have been reported in each of the buildings. Efforts to perform patch repairs have had limited success in reducing the number and severity of leaks. This project will implement necessary flat roof replacements for the City Hall, Police and Community Center buildings. The proposed construction project will provide a new roof for the Tustin Civic Center with a 30-year manufacturer's warranty. DISCUSSION On August 4, 2009, the City Council authorized staff to solicit bids for this project. Formal bids were publicly opened September 17, 2009, by the City Clerk. (Solar) for $394,600.00. After a staff review of Solar's bid and consultation with the City Attorney's office, the apparent lowest bid was rejected as nonresponsive to the bid specifications. Solar's bid was found nonresponsive because its bid proposal was based on the use of materials that do not comply with the City's specifications. The Public Contracts Code allows substitutions of materials as "equals" within a set time frame as determined by the awarding agency. The City's specifications required bidders to submit proposed substitutions to the City up to ten (10) days prior to the bid opening. This procedure allows an opportunity for the City to review the request and make a formal determination on the adequacy of the material prior to opening the bids so bid process is fair and equitable bid for all bidders. Solar failed to submit the request. In addition, Staff found that Solar's bid included an alteration of the Bidder Bond which failed to comply with the City's requirements. Staff has reviewed the references and the State Contractor's License for RGSLA, Inc. has determined that they are appropriate for the subject project.
