APPROVAL OF MINUTES - SEPTEMBER 22, 2009, PLANNING COMMISSION MEETING. Action Agenda -Planning Commission October 13, 2009 -Page 1 PUBLIC HEARINGS: Adopted Resolution No. 2. CONTINUED CONDITIONAL USE PERMIT 09-017 4127, as amended REQUESTING AUTHORIZATION TO ESTABLISH AND OPERATE AN INDOOR/OUTDOOR BOUTIQUE ENTERTAINMENT VENUE/NIGHTCLUB WITH LIVE ENTERTAINMENT AND A TYPE 48 ALCOHOLIC BEVERAGE CONTROL LICENSE FOR THE ON-SITE SALE OF GENERAL ALCOHOLIC BEVERAGES. THIS PROJECT IS LOCATED AT 2429 PARK AVENUE IN THE SP-1 - MCAS TUSTIN SPECIFIC PLAN DISTRICT, NEIGHBORHOOD F, PLANNING AREA 19 -COMMERCIAL ZONING DISTRICT. RECOMMENDATION: That the Planning Commission adopt Resolution No. 4127 approving Conditional Use Permit 09-017. Adopted Resolution No. 3. CONDITIONAL USE PERMIT 08-014 AND DESIGN 4132, as amended REVIEW 08-004, A REQUEST TO INSTALL AND OPERATE A MAJOR WIRELESS TELECOMMUNICATIONS FACILITY CONSISTING OF A STEALTH MONOPINE WITH NINE PANEL ANTENNAS AND TWO GPS ANTENNAS AND ASSOCIATED EQUIPMENT LOCATED WITHIN A GROUND-MOUNTED BLOCK WALL ENCLOSURE AND AN ENCLOSED SELF STORAGE UNIT, INCLUDING CAPACITY FOR CO-LOCATION IN THE FUTURE. THIS PROJECT IS LOCATED AT 14861 FRANKLIN AVENUE IN THE PLANNED COMMUNITY INDUSTRIAL (PC-IND) ZONING DISTRICT. RECOMMENDATION: That the Planning Commission adopt Resolution No. 4132 approving Conditional Use Permit 08-014 and Design Review 08-004. Adopted Resolution No. 4. CONDITIONAL USE PERMIT 09-023, A REQUEST TO 4131, as amended AUTHORIZE THE SALE OF BEER AND WINE FOR ON- SITE CONSUMPTION (ABC LICENSE TYPE 41) IN CONJUNCTION WITH AN EXISTING RESTAURANT LOCATED AT 14131 RED HILL AVENUE. THIS PROJECT IS LOCATED IN THE RETAIL COMMERCIAL (C-1) ZONING DISTRICT. Action Agenda -Planning Commission October 13, 2009 -Page 2 RECOMMENDATION: That the Planning Commission adopt Resolution No. 4131 approving Conditional Use Permit 09-023. REGULAR BUSINESS: Received and filed 5. PROJECT SUMMARY. The summary focuses on the status of projects that the Planning Commission, Zoning Administrator, or Community Development Director approved, major improvements projects, and other items of interest. RECOMMENDATION: That the Planning Commission receive and file this report. Approved 6. TUSTIN HISTORIC REGISTER NOMINATION. Owners of historic homes or commercial buildings in Tustin are eligible to participate in the City's Plaque Designation program, called the Tustin Historic Register. The purpose of the voluntary program is to recognize Tustin's historic properties, educate the public, increase public interest in historic properties, and promote community pride. RECOMMENDATION: That the Planning Commission approve the nomination of 145 Pacific Street to the Tustin Historic Register Plaque Designation Program and select the most appropriate historical name and date of construction for the property. Presentation: Scott Reekstin, Senior Planner Received and filed 7. ZONING ADMINISTRATOR ACTIONS. The staff report responds to a Planning Commissioner's request that Zoning Administrator actions be agendized for the Planning Commission. RECOMMENDATION: That the Planning Commission receive and file this report. Action Agenda -Planning Commission October 13, 2009 -Page 3 STAFF CONCERNS: 8. REPORT OF ACTIONS TAKEN AT THE OCTOBER 6, 2009, CITY COUNCIL MEETING. The Director indicated she had nothing on which to report. COMMISSION CONCERNS: Thompson • Attended the Public Workshop on the City Center project proposal • Attended the Building Industry Legal Defense Foundation on Southern California Water Supply on October 6th which included several interesting speakers • Attended the Orange County Business Council's Infrastructure Committee, which included focus on the high speed rail • Congratulations to the State for applying for OCTA $4.5 billion grant for high speed rail throughout the State, more than half of which would go to the connection from Anaheim to Los Angeles Union Station Puckett Stated he and his wife lunched at The Winery, a lovely restaurant at the District • Noted the Tustin Hangars video is being shown on Cable TV • Indicated that Tustin Tiller Days were a great success; Cherrill Cady did a great job, as she has done for the past 30 years • Hopes to be playing in the Lions Club Golf Tournament tomorrow • Reminded everyone the Mayor's Breakfast takes place November 19 at the Salvation Army Church, beginning at 7:00 a.m. • Go Angels and Dodgers! Kasalek • Attended the community outreach workshop and was very impressed with the honesty and concerns of the residents present • Enjoyed Tiller Days • Reminded everyone the Old Town Art Walk occurs October 24, 10:00 a.m. to 4:00 p.m. • Thanked staff for the new City of Tustin lapel pins • Asked if there are areas in Tustin that lack cell phone coverage Director Answered that all commercial and industrial areas allow cell sites; residential neighborhoods do not. Kasalek Suggested that Tustin Ranch is one of those areas lacking coverage. Action Agenda -Planning Commission October 13, 2009 -Page 4 Director Responded that there are fewer commercial areas in the northern areas of Tustin Ranch; staff is developing a master plan for locations, including some park sites. Murray Attended Tiller Days; his family enjoyed riding on a float • Noted the Tustin Brewery has received national recognition for one of their brews • Stated the Tustin Athena Award nominations have been announced, one of whom is on the Tustin Foundation • Indicated the Tustin High football team continues to dominate • Reminded everyone the Halloween Howl takes place October 30 from 3:00 to 5:00 p.m. • Complimented Cherrill Cady for her 30 years of service • Enjoyed a wonderful dinner at The Winery • Noted there is a Whole Pets food store in Old Town Kozak • Complimented folks for their collaboration in making Tustin Tiller Days a wonderful event every year • Noted that last year's Art Walk was a great event, one that also requires a lot of collaboration among various Tustin groups • Indicated it is good to see progress at 155 West First Street • Thanked staff for the lapel pins and for their work on tonight's agenda items • Asked that Code Enforcement pursue the entity that has been putting stickers on the backs of road signs, a computer repair service, black and white sticker, with the number 949-337-6993 9:13 p.m. ADJOURNMENT The next regular meeting of the Planning Commission is scheduled for Tuesday, October 27, 2009, at 7:00 p.m. in the City Council Chamber at 300 Centennial Way.
