HUSTON, CITY MANAGER FROM: PAMELA ARENDS-KING, FINANCE DIRECTOR SUBJECT: ORDINANCE NO. 1377, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SECTION 1632 OF THE TUSTIN CITY CODE REGARDING REQUEST FOR PROPOSALS FOR INDEPENDENT AUDITORS SUMMARY: Ordinance No. 1377 will amend Section 1632 of the Tustin City Code regarding request for proposals for independent auditors. RECOMMENDATION: First reading of Ordinance No. 1377, an Ordinance of the City Council of the City of Tustin, California, amending Section 1632 of the Tustin City Code regarding request for proposals for independent auditors. FISCAL IMPACT: None. BACKGROUND: The discussion to make changes to Section 1632 and/or make an exception to Section 1632 was brought to the Audit Commission's attention by the Finance Director. The current auditors, Macias Gini & O'Connell LLP, will have completed the City's audit for five years ending 2008/09. The request to the Audit Commission was to extend the auditor's contract for one year because of the complex accounting and auditing issues due to various developments the City is currently experiencing and the heavy workload staff will experience implementing new finance software. Bringing new auditors in for Fiscal Year 2009/10 will be extremely challenging because staff will not have the extra time that is required to work with new auditors. The Audit Commission was agreeable to extending the auditor's contract, but an exception and/or amendment to the existing Code would have to be addressed. Tustin City Code Section 1632 currently reads "Requests for proposals for independent auditors, excluding the current auditor, shall be solicited at least every five (5) years. Requests for proposals and the selection of the independent auditor shall follow guidelines developed by the Audit Commission and such other criteria as may be recommended from FIRST READING OF ORDINANCE 1377 REGARDING AMENDMENT OF REQUEST FOR PROPOSALS FOR INDEPENDENT AUDITORS NOVEMBER 17, 2009 Page 2 time to time by the Finance Director." The recommended amendment to Tustin City Code Section 1632 reads "Requests for proposals for independent auditors shall be solicited periodically at the discretion of the City Council. Requests for proposals and the selection of the independent auditor shall follow guidelines developed by the Audit Commission and such other criteria as may be recommended from time to time by the Finance Director." The recommended amendmen# does not conflict with any auditing standards or guidelines. The City Council of the City of Tustin, Caiifomia, ordains: SECTION 1: Section 1632 of the Tustin City Code is amended to read: SECTION 1632 REQUESTS FOR PROPOSALS Requests for proposals for independent auditors shall be solicited periodically at the discretion of the City Council. Requests for proposals and the selection of the independent auditor shall follow guidelines developed by the Audit Commission and such other criteria as may be recommended from time to time by the Finance Director. SECTION 2. This Ordinance shall take effect on the 31st day after it is enacted. PASSED, APPROVED, AND ADOPTED this day of ~ 2009.
