SUBJECT: ORDINANCE NO. 1369, RECOMMENDING ADOPTION OF THE OFFICIAL
ZONING MAP OF THE CITY OF TUSTIN
SUMMARY:
The boundaries of the zoning districts designated and established in the City of Tustin's
adopted Zoning Code are required by Tustin City Code Section 9213c to be illustrated
on a map entitled "Zoning Map of the City of Tustin." Staff has finalized the GIS version
of the "Zoning Map of the City of Tustin" and is proposing Ordinance No. 1369 for the
Tustin City Council to formally adopt that map as the official illustrative "Zoning Map of
the City of Tustin." The proposed Zoning Map is clearer, more accurate, uses color
gradations to depict land use intensity, and now includes a legend that identifies the
location of all Specific Plan neighborhoods approved within the City.
RECOMMENDATION:
That the Tustin City Council introduce and have first reading of Ordinance No. 1369
designating the official Zoning Map of the City of Tustin. (Attachment C).
FISCAL IMPACT:
Ordinance No. 1369 is a City -initiated project. There are no direct fiscal impacts
anticipated as a result of adopting this ordinance.
BACKGROUND:
California Government Code Section 65800 et seq. requires each city to adopt,
administer and implement zoning laws, ordinances, rules and regulations to implement
the community's adopted general plan. Zoning laws preserve the health, safety and
welfare of the community by regulating the use of buildings, structures, and land within
the city. To carry out this purpose, the City Council has divided the City of Tustin into
zoning districts where uniform zoning regulations apply and differentiate one type of
zone district from those in other types of zone districts.
The boundaries of the zoning districts designated and established in the City of Tustin's
adopted Zoning Code are required by Tustin City Code Section 9213c to be illustrated
on a map entitled "Zoning Map of the City of Tustin." Tustin's official Zoning Map

appears to have been adopted in its entirety only twice in the history of the City; once
with the original adoption and enactment of the City's first Zoning Code in 1947, and
again in 1961 through a comprehensive Zoning Code update. However, Tustin's official
Zoning Map has been amended over 140 times through numerous, Tustin City Council -
approved Zone Changes, Planned Communities, Specific Plans, annexations, etc. Each
change has been physically recorded on the official Zoning Map by City staff using pen
and ink on a vellum map that is preserved and maintained by the Community
Development Department (Attachment A). Black -line prints of the Zoning Map are
available to the public at a minimal cost.
The City of Tustin has recently developed a computerized Geographic Information
System (GIS) that allows users to develop maps, create interactive queries (user
created searches), analyze land use information, link and edit parcel data and maps,
and colorfully present the results of all of these operations. The GIS is extremely
flexible and computer generated maps can be easily and seamlessly updated. The GIS
has recently become an increasingly important tool utilized by planners, engineers,
police and other City staff.
Staff has finalized the GIS version of the "Zoning Map of the City of Tustin" and is
proposing Ordinance No. 1369 for the Tustin City Council to formally adopt that map as
the official illustrative "Zoning Map of the City of Tustin." The proposed Zoning Map is
clearer, more accurate, uses color gradations to depict land use intensity, and now
includes a legend that identifies the location of all Specific Plan neighborhoods
approved within the City. The new Zoning Map proposes no zoning district designation
changes, but simply presents previously approved zoning information in a better,
clearer, electronic format rather than the current vellum/black line print format. Because
of its digital, electronic format, the new Zoning Map can be viewed at any scale on any
personal computer with access to the internet, enabling the public, realtors, and others
to independently and accurately determine the zoning of a property without visiting with
or phoning Community Development staff at City Hall. The proposed Zoning Map can
be viewed as Exhibit 1 to proposed Ordinance 1369 (Attachment C), or an enlarged
version can be viewed by visiting the "Planning and Zoning Documents" link on the City
of Tustin Community Development Department's web page, and by using the following

On October 27, 2009, the Tustin Planning Commission adopted Resolution No. 4125,
recommending that the Tustin City Council adopt Ordinance No. 1369 designating the
GIS Zoning Map as the official illustrative "Zoning Map of the City of Tustin" (Attachment
B). The Community Development Department will continue to administer and maintain
this map.
ENVIRONMENTAL ANALYSIS
Ordinance No. 1369 is exempt from environmental review under CEQA pursuant to
Section 15061(b)(3) of the State CEQA Guidelines. This section provides that a project
is exempt from environmental review where it can be seen with certainty that there is no
possibility that the activity in question may have a significant effect on the environment.

Proposed Ordinance No. 1369 would formally designate the GIS Zoning Map as the
official illustrative "Zoning Map of the City of Tustin. The proposal would not change
any development or use standards, cause any development to occur, or otherwise
directly or indirectly affect the environment.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL
ADOPT ORDINANCE NO. 1369 DESIGNATING THE OFFICIAL ZONING

The Planning Commission does hereby resolve as follows:

Section 15061(b)(3) of the State CEQA Guidelines. This section provides
that a project is exempt from environmental review where it can be seen
with certainty that there is no possibility that the activity in question may
have a significant effect on the environment. The proposed amendment
deals only with procedural matters and would not change any
development or use standards, cause any development to occur, or
otherwise directly or indirectly affect the environment.

health, safety, and welfare of the citizens of the City of Tustin.
II. The Planning Commission hereby recommends that the City Council adopt
Ordinance No. 1369 designating the GIS Zoning Map as the official "Zoning Map
of the City of Tustin."
PASSED AND ADOPTED by the Planning Commission of the City of Tustin at a regular
meeting on the 27th day of October, 2009.

The City Council of the City of Tustin does hereby ordain as follows:
