AN INTERIM URGENCY ORDINANCE OF THE CITY OF
2 TUSTIN, CALIFORNIA, PROHIBITING HOTEL AND MOTEL
USES IN THE C-1 DISTRICT EXCEPT UPON ISSUANCE OF A
3 CONDITIONAL USE PERMIT.

The City Council of the City of Tustin does ordain as
5 follows:
6 1. The Council hereby finds and determines as follows:
7 a. That in order to protect the public safety, health
and welfare, it is necessary that an interim ordinance be adopted
8 as an urgency measure prohibiting hotels and motels in the C-1
commercial district without'first obtaining a use permit therefor.

b. That hotel and motel uses in the C-1 district
10 would be in conflict with a contemplated zoning proposal which the
City Council, the Planning Commission and the Planning Department
11 are considering, studying and intend to study and consider for a
reasonable period of time, to-wit, approximately four (4) months.

c. The adoption of this interim ordinance as an
13 urgency measure is necessary to prevent the construction of any
hotels or motels without the issuance of a conditional use permit,
14 which such construction would have or might have an adverse effect
on other properties, development, uses and occupancies in the City
15 and should not be permitted until further study has been completed.
16 2. An interim ordinance is hereby adopted as an urgency
measure to protect the public health, safety and welfare and is
17 adopted as an urgency measure by a four-fifths (4/5ths) vote
pursuant to the provisions of Section 65858 of the Government Code
18 and shall take effect immediately upon passage.
19 3. Testimony at regular meetings of the City Council on
September 6 and 19, 1983, and the comments of the City Council in
20 reference to this subject are incorporated herein by this reference.
21 PASSED AND ADOPTED at a regular meeting of the City Council
of the City of Tustin, California, held on the 17th day of
22 OCtober, 1983.

second reading and duly passed and adopted at a regular meeting held on the 17th
day of October, 1983, as an urgency measure by the following vote:
