SUBJECT: CONSIDERATION OF CLAIM OF ZAHIDA BEG, CLAIM NO. 09-39
SUMMARY:
The Claimant alleges that her sewer lateral was damaged due to root infestation from a nearby
City-owned tree.
RECOMMENDATION:
That the City Council deny Claim Number 09-39, Zahida Beg, and direct Staff to send notice
thereof to the Claimant.
FISCAL IMPACT:
None.
DISCUSSION:
The City's Claims Administrator, NovaPro, has completed their investigation and concludes that
there is no liability on the part of the City. It is believed that the clay lateral was cracked, thus
attracting tree root infestation as opposed to tree roots causing the damage to the sewer lateral.
The responsibility to maintain the lateral sewer line belongs to the homeowner. Staff is
recommending denial of the claim.
