STACK, ACTING DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: AUTHORIZING THE CITY OF TUSTIN TO APPLY FOR A PROPOSITION 84 FUNDING PROGRAM GRANT AND DESIGNATION OF THE ACTING DIRECTOR OF PUBLIC WORKS/CITY ENGINEER TO SUBMIT AN APPLICATION TO THE STATE OF CALIFORNIA SUMMARY The Public Works Department is pursuing a state grant funded through Proposition 84 to offset a portion of the Rawlings Reservoir CIP No. 6136 construction costs. A resolution authorizing the City to apply for the grant must be approved by the City Council to accompany the grant application due January 7, 2010. RECOMMENDATION It is recommended that the City Council approve Resolution No. 10-06, and authorize the Acting Director of Public Works/City Engineer to execute the application on behalf of the City. FISCAL IMPACT The Rawlings Reservoir Project grant application will be for the maximum amount of $10 million per project. The total grant amount available to the City will be dependent upon the number of applications submitted and the final ranking of the City's project by the State, and will be subject to a final funding agreement for City Council consideration. DISCUSSION Proposition 84 was approved by voters in 2006 and provides $130 million for projects required to protect public health by preventing or reducing the contamination of groundwater that serves as a major source of drinking water for a community. Funding is currently on hold due to state budget issues. However, shelf ready project applications are currently being accepted by the Department of Water Resources. Approximately 80% of Tustin's water supply is groundwater. The Rawlings Reservoir Project is intended to store local groundwater treated for nitrates and other contaminants at the City's 17th Street Desalter Plant. Staff is requesting authorization from the City Council to submit an application to the State of California for these funds. If the City's application is selected, the grant would reimburse the City for a portion of the Rawlings Reservoir Project construction costs, subject to a final fu In greement with the State. Do~g~a~ S: Suck Fred Adjarian AcJ1t ng"Director of Public Works/City Engineer Water Services Manager Authorizing City to apply for Prop. 84 Grant & Reso 10-O6.docx RESOLUTION NO. 10-06 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA AUTHORIZING THE CITY OF TUSTIN TO APPLY FOR A PROPOSITION 84 FUNDING PROGRAM GRANT AND DESIGNATION OF THE ACTING DIRECTOR OF PUBLIC WORKS/CITY ENGINEER TO SUBMIT AN APPLICATION TO THE STATE OF CALIFORNIA WHEREAS, the City of Tustin has the authority to construct, operate and maintain the City of Tustin Water Services; WHEREAS, the City of Tustin desires to enhance the provision and protection of the drinking water supplied to the consumers of the City of Tustin Water Services. NOW, THEREFORE, BE IT RESOLVED by the City of Tustin that, pursuant and subject to all of the terms and provisions of The Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006 (Proposition 84) and all amendments thereto, application be made to the State of California for funding; and AND BE IT FURTHER RESOLVED that the Acting Director of Public Works/City Engineer is hereby authorized and directed to cause the necessary data to be prepared, investigations to be performed and application to be signed and filed with the State of California.
