HomeMy WebLinkAboutZA Action Agenda 12-28-09ACTION AGENDA ZONING ADMINISTRATOR MEETING DECEMBER 28, 2009 CALL TO ORDER: 10:35 a.m. Community Development Conference Room ROLL CALL: Dana Ogdon, Acting Zoning Administrator Cari Myer, Assistant Planner Flor Williams, Recording Secretary PUBLIC CONCERNS: (Limited to 3 minutes per person for items not on the agenda) CONSENT CALENDAR: No Items on Consent Calendar PUBLIC MEETING: 1. CONDITIONAL USE PERMIT 09-031- a request to conduct massage, yoga/pilates classes, and book workshops in conjunction with an existing bookstore and retreat center at 505 West First Street. APPLICANT: RONALD S. ADAMS REBEKAH L. SCHNEIDER THE SANCTUARY BOOKSTORE AND RETREAT PROPERTY OWNER: CARL L. & MOZELLE E. WOOD FAMILY LIMITED PARTNERSHIP RECOMMENDATION That the Zoning Administrator adopt Zoning Administrator Action No. 09-014 approving Conditional Use Permit 09-031. The Public Hearing opened at 10:35 a.m. The Acting Zoning Administrator introduced staff and asked the attendees to introduce themselves. Attendees introduced themselves as the Applicants, Rebekah Schneider and Ronald Adams, also known as Scott, from The Sanctuary Bookstore and Retreat. The Acting Zoning Administrator stated that there were no Public Concerns and no others present. Zoning Administrator Agenda December 28, 2009 Page 2 The Acting Zoning Administrator reviewed the report and stated that the Conditional Use Permit applied as long as the massage use was ancillary to the primary business. The Acting Zoning Administrator asked Mr. Adams and Ms. Schneider if they were familiar with the City of Tustin's Interim Massage Ordinance relating to massage uses. Mr. Schneider replied that he had heard of it but wasn't familiar with the Ordinance. The Acting Zoning Administrator stated that massage technicians had to be approved by the City, unless they were State Certified. The Acting Zoning Administrator asked Assistant Planner Cari Meyer to provide a copy of the Interim Ordinance to the Applicants. The Acting Zoning Administrator asked the Applicants if they had read the staff report and if they had any questions on the conditions of approval. Mr. Schneider stated that the report and Conditions of Approval didn't contain anything that had not already being explained by Assistant Planner Cari Meyer and BJ Azarvand from the Building Division. The Acting Zoning Administrator approved Zoning Administrator Action No. 09-014 approving Conditional Use Permit 09-031. REGULAR BUSINESS: None ADJOURNMENT: The Public Hearing closed and meeting adjourned at 10:38 a.m. The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
