HomeMy WebLinkAbout02 General Plan ConformityITEM #2 Report to the Planning Commission DATE: JANUARY 12, 2010 TV~ l ~1V SUBJECT: GENERAL PLAN CONFORMITY DETERMINATION APPLICANT: TUSTIN COMMUNITY REDEVELOPMENT AGENCY PROPERTY OWNER: TUSTIN COMMUNITY REDEVELOPMENT AGENCY LOCATION: 14741-14751 NEWPORT AVENUE ZONING: MULTIPLE FAMILY RESIDENTIAL DISTRICT (R-3) ENVIRONMENTAL DETERMINATION: GENERAL PLAN CONFORMITY DETERMINATIONS REQUIRED BY GOVERNMENT CODE SECTION 65402 ARE NOT "PROJECTS" REQUIRING ENVIRONMENTAL REVIEW PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT REQUEST: GENERAL PLAN CONFORMITY FINDING FOR CONVEYANCE OF EIGHT (8) RESIDENTIAL UNITS LOCATED AT 14741 AND 14751 NEWPORT AVENUE OWNED BY THE COMMUNITY REDEVELOPMENT AGENCY TO THE CITY OF TUSTIN RECOMMENDATION That the Planning Commission adopt Resolution No. 4138 determining that the conveyance of eight (8) residential units located at 14741-14751 Newport Avenue owned by the Community Redevelopment Agency to the City of Tustin is in conformance with the Tustin General Plan. BACKGROUND On January 19, 2010, the Tustin Community Redevelopment Agency (Agency) is proposing the sale of eight (8) residential units located at 14741 and 14751 Newport Avenue owned by the Agency to the City of Tustin in conjunction with the Newport Avenue Extension Project Phase II. Pursuant to Section 65402 (c) of the Government Code, prior to acquisition or disposition of real property by a local agency such as the Planning Commission General Plan Conformity Determination January 12, 2010 Page 2 City, a general plan conformity determination is required. The Planning Commission is authorized to determine whether the location, purpose, and extent of the proposed conveyance are consistent with the General Plan. The property to be acquired will be necessary to retain right-of-way needs associated with the Newport Avenue Extension Project Phase II which is recognized in the City's Circulation Element of the General Plan and in the South Central Redevelopment Plan. Any remaining property after right-of-way needs are met will be subsequently marketed and utilized for future development in the South Central Project Area consistent with the General Plan and Zoning Ordinance. Therefore, the location, purpose, and extent of the proposed conveyance are in conformance with the General Plan. ~~-~C-l J stina Willkom Elizabeth A. That the Community Redevelopment Agency proposes to convey eight (8) residential units located at 14741 and 14751 Newport Avenue owned by the Agency to the City of Tustin. B. That the proposed conveyance is associated with the extension of with the Newport Avenue Extension Project Phase II which is recognized in the City's Circulation Element of the General Plan and in the South Central Redevelopment Plan. C. That California Government Code Section 65402 (c) provides that a local agency such as the City shall not acquire real property until the location, purpose, and extent of the project has been submitted to and reported upon by the local planning agency as to the conformity with the applicable, adopted general plan. D. That general plan conformity determinations required by Government Code Section 65402 are not "projects" requiring environmental review pursuant to the California Environmental Quality Act. II. The Planning Commission hereby determines that the location, purpose, and extent of a proposed conveyance of eight (8) residential units located at 14741 and 14751 Newport Avenue in conjunction with the extension of the Newport Avenue Extension Project Phase II conforms with the Tustin General Plan.
