HomeMy WebLinkAboutCC RES 90-47 2 5 6 7 10 11 RESOLUTION NO. 90-47 A RESOLUTIOn; 01:' THE CITY COUi:CIL OF THE CITY OF TUSTIN CALIFORNIA, RECITING THE FACT OF TIlE GENERAL I'IUHICIPAL ELECTION HELD ON APRIL 10, 1990, DECLARING THE RESULT AND SUCII OTi{ER .~dA'i'TE;~S AS PROVIDED BY I~W WHEREAS, a General Municipal Election was held and conducted in the city of Tustin, California, on Tuesday, April 10, 1990, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities; and WHEREAS, pursuant to Resolution No. 90-28, adopted April 2, 1990, the city Clerk canvassed the returns of the election and has certified the results to this City Council, the resu].ts are received, attached and made a part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNC.IL OF TIIE CITY OF TUSTIN, Ii CALIFORNIA, DOES HEREBY RESOLVE, DECi~\RE, DETERMINE AND ORDER AS 17 I FOLLOWS: 18: 19 2O 21 22 24 25 2~ 27 28 SECTION 1. That the whole number of ballots cast in the City except absent voter ballots was 3,89].. That the whole number of absent voter ballots cast in the City was 579, making a total cf 4,470 ballots cast J.n the City. SECTION 2. That the names of persons voted for at the election for Member of the City Council are as follows: Member of the City Council, Lop. g Term - Leslie Anne Pontious, Dennis E. Pedersen, Charles E. "Cinuck" Puckett, Caro].e Bryant and John Kelly; Member of the City Council, Short Term - Jim Potts, John Norman Butler and Berk!ee A. Maughan. SECTION 3. That the number of votes given at each precinct and the number of votes given in the City to each of the persons above named for tb.e respective offices for which the persons were candidates '..:ere as listed in "Exhibit A" attached. 1 2 7 8. 10 11 12 13 15 17 18 20 21 22 Reso]utJ. on No. 90-47 Page 2 SECTION 4. The City Council does declare and determine that: Charles E. Puckett and Leslie Anne Pontious were elected as Members of the City Council for the full terms of four years each; and Jim Pott$ was elected as Member of the City Council for the term of office Jn which a vacancy was created by the resignation of Ronald B. Hoesterey, which ends in April, 1992. SECTION 5. The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election, showing: (1) The whole number of ballots cast in the City; (2) The names of the persons voted for; (3) For what office each person was voted for; (4) The number of votes given at each precinct to each person; (5) The total number of votes given to each person. SECTION 6. That the City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the city Clerk and authenticated; the the City Clerk shall also administer to each person elected the Oath of Office prescribed J.n the Constitution of the State of California and shall have them subs{.-ribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. WYNN, City Clerk and ex-officio Clerk of the City Council of the City of Tustin, California, does hereby certify that the whole number of the members of the City Council of the City of Tustin is four; that the above and foregoing Resolution No. 90-47 was duly and regularly introduced, passed and adopted at an adjourned regular meeting of the City Council held on the 17th day of April, 1990 by the following vote: COUNCILMEMBER AYES: Edgar, Kennedy COUNCILMEMBER NOES: None COUNCILMEMBER ABSTAINED: Prescott COUNCILMEMBER ABSENT: Kelly Valerie Whiteman, Chief Deputy City Clerk
