HomeMy WebLinkAboutCC RES 92-17 1 2 3 4 5 6 7 8 9 10 11 12 13 17 18 19 9O 22 9.7 28 RESOLUTION NO. 92-17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN MODIFYING TtIE PLANNING COMMISSION'S DECISION ON AN AMENDMENT TO DESIGN REVIEW 91-07, TO PERMIT AN ADDITIONAL DEVELOPMENT BONUS RELATED TO SIGN HEIGHT PURSUANT TO THE CRITERIA OF THE LOT CONSOLIDATION PROGRAM OF THE FIRST STREET SPECIFIC PLAN FOR THE PROPERTIES LOCATED AT 135 SOUTH PROSPECT AVENUE AND 240 EAST FIRST STREET The City Council of the City of Tustin does hereby resolve as follows: The City Council finds and determines as follows: A. That an appeal of the Amendment to Design Review 91-07 was filed by Henry Kumagai to request the elimination of the requirement to provide combined sign copy area for a monument sign on the property located at 240 East First Street. That an appeal before the City Council was duly held on January 20, 1992 and continued to February 3, 1992. Ce That, pursuant to the criteria stated in Sectior III.F of the First Street Specific Plan, the following was determined: The request to permit only sign copy area fox the car wash business on the monument sign does not address the design guidelines of the First Street Specific Plan in that the resul~ would not further the cohesiveness of th~ development site. The addition of an architectural embellishment causing the overall sign height to exceed sir feet will provide an architectural feature similar in character to the main buildings both sites meeting the design guidelines the First Street Specific Plan. This project is considered to be Categoricall] Exempt (Class 11) pursuant to Section 15311 of the California Environmental Quality Act. II. WYNN, City Clerk and ex-officio Clerk of the City Council of the City of Tustin, California, does hereby certif~ that the whole number of'the members of the City Council o~ the City of Tustin is five; that the above and foregoinq Resolution was duly and regularly passed and adopted at a regular meeting of the City Council held on the 3rd day o4 February, 1992, by the following vote: ~ COUNCiLPERSONS AYES: z't]cKetz. , PeEri(,us, Edgar, ~)'''. cL~s, Presc~)t COUNCILPERSONS NOES: ~one COUNCILPERSONS ABSTAINED: None COUNCILPERSONS ABSENT: Xone MARY E.~YNN, C t~y Clerk EXHIBIT A RESOLUTION NO. 92-17 CONDITIONS OF APPROVAL AMENDMENT TO DESIGN REVIEW 91-07 (1) GENERAL 1.1 The proposed project shall substantially conform to the submitted plans date stamped February 3, 1992 on file with the Community Development Department as herein modified or as modified by the Director of Community Development. 1.2 Unless otherwise specified, all conditions in this exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. 1.3 Design Review approval shall become null and void unless sign permits and all construction is completed within eighteen (18) months of the date of this exhibit. 1.4 Approval of the modification to an Amendment to Design Review 91-07 is contingent upon the applicants signing and returning an "Agreement to Conditions Imposed" form, as established by the Director of Community Development. 1.5 Ail applicable conditions contained in Exhibit A of City Council Resolution No. 91-111 shall remain in full force and effect. 1.6 This approval is related to the monument sign only. (i) (3) PLAN SUBMITTAL 2.1 At building plan check and prior to the issuance of sign permits, the applicant shall submit two copies of plans, including site plan, fully dimensioned and detailed eieva~ions, at~ached methods and elec%rica! details for illumination, s=ruc=urai calculations for footings for approval by the Building Official. The monument sign shall be located a minimum of ten (10) feet easterly of the reciprocal driveway along First Street. The actual sign copy for the sign shall be reviewed and approved by the Community Development Department ~nd shall be limited to the identification oI the actual business names, addresses, and lawful use of the premises upon which it is located and shall not include pricing information or specific brand names, with the exception of that information required by State Law. Brand names or logos incorporated into the name of the business may be considered when demonstrated to be part of the business name. Identification of product, trade and service information is permitted and is considered supplemental provided it is subordinate to the business name and does not total more than 25% of the total sign area. A fourteen-inch high architectural embellishment shall be permitted to be placed on top of the monument sign cabinet at the applicant's discretion. This architectural feature shall not be considered in calculating the overall sign square footage and may not be traded in to provide additional copy area. The applicant shall submit a desired architectural detail for review and approval by the Community Development Department. (l) FEES 4.1 Payment of all Building plan check and permit fees shall be made prior to the issuance of any building permits in accordance with the Tustin City Code. AEB:nm
