CONCERNS: At this time members of the public may address the Commission regarding any items not on the agenda and within the subject matter jurisdiction of the Commission (NO action can be taken on off-agenda items unless authorized by law). If you wish to address the Commission on any matter, please fill out one of the forms located at the speaker's table so that your remarks on the tape recording of the meeting can be attributed to you. CONSENT CALENDAR: All matters listed under the Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Commission, staff, or public request specific items to be discussed and/or removed from the Consent Calendar for separate action. Any writings or documents provided to a majority of the Planning Commission regarding any item on this agenda will be made available for public inspection in the Community Development Department located at 300 Centennial Way, Tustin, California, during normal business hours. Agenda -Planning Commission February 9, 2010 -Page 1 1. APPROVAL OF MINUTES -JANUARY 26, 2010, PLANNING COMMISSION MEETING. PUBLIC HEARINGS: 2. CODE AMENDMENT 10-001, PROHIBITING DRIVE-IN AND DRIVE-THRU ESTABLISHMENTS WITHIN COMMERCIAL AREAS OF OLD TOWN TUSTIN, AND ADOPTING ORDINANCE NO. 1378. On December 8, 2009, the Tustin Planning Commission held a public hearing and adopted Resolution No. 4129 recommending that the Tustin City Council adopt Ordinance No. 1373 to: 1) reduce restaurant parking requirements for Old Town Tustin; and 2) facilitate the establishment of outdoor restaurant seating areas in Commercial Districts within the City, including Old Town Tustin. At that time, the Planning Commission also discussed a concern that drive- thru establishments were currently listed as a conditionally permitted use within the City's C-2 zoning regulations, and that drive-thru establishments might not be a supportable use within C-2 zoned properties located within Old Town Tustin. Specifically, the Planning Commission noted that drive- thru establishments might not compatible with the historic Old Town walking experience. The Planning Commission recommendation supporting adoption of Ordinance 1373 included a recommendation that the City Council eliminate drive-thru establishments as a conditionally permitted use in Old Town. RECOMMENDATION: That the Planning Commission adopt Resolution No. 4142, recommending that the Tustin City Council adopt Ordinance No. 1378 amending Section 9233 of Part 3 of Chapter 2 of Article 9, prohibiting drive-in and drive-thru establishments in Old Town. Presentation: Dana Ogdon, Assistant Community Development Director 3. SPECIFIC PLAN AMENDMENT 10-001, MINOR TEXT AMENDMENTS. The City of Tustin is proposing minor text amendments to the MCAS Tustin Specific Plan, which will not substantially amend the Specific Plan, but will clarify the calculation of gross and net acreage within Planning Area 1 and would revise existing language to provide additional flexibility to allow the submittal of a concept plan for any portion of Planning Area 1. Agenda -Planning Commission February 9, 2010 -Page 2 RECOMMENDATION: That the Planning Commission adopt Resolution No. 4143, recommending that the Tustin City Council adopt Ordinance No. 1379, amending various sections of the MCAS Tustin Specific Plan. Presentation: Dana Ogdon, Assistant Community Development Director REGULAR BUSINESS: 4. WORKSHOP: USE DETERMINATION CODE AMENDMENT 10-002: Code Amendment 10-002 (CA 10-002) proposes the incorporation of minor amendments to the Zoning Code (Article 9 Chapter 2) of the Tustin City Code (TCC). Specifically, the Code Amendment meets the following objectives: a. Incorporate use determinations into the Zoning Code that have been previously determined by the Community Development Director and/or the Planning Commission to be similar to other permitted uses or conditionally permitted uses within various City zoning districts. b. Provide accurate and updated information in the Zoning Code for both staff and the public as to which uses are permitted or conditionally permitted and the review process required for approval of such uses. c. Integrate other minor amendments by clarifying and simplifying the Zoning Code text including grammatical and spelling changes, updating terminology, alphabetizing lists, and incorporating legal updates.
