CONSENT CALENDAR
Approved 1. APPROVAL OF MINUTES - JANUARY 26, 2010,
PLANNING COMMISSION MEETING.
PUBLIC HEARINGS:
Adopted Resolution 2. CODE AMENDMENT 10-001, PROHIBITING DRIVE-IN AND
No. 4142 DRIVE-THRU ESTABLISHMENTS WITHIN COMMERCIAL
AREAS OF OLD TOWN TUSTIN, AND ADOPTING
ORDINANCE NO. 1378.
On December 8, 2009, the Tustin Planning Commission
held a public hearing and adopted Resolution No. 4129
recommending that the Tustin City Council adopt Ordinance
No. 1373 to: 1) reduce restaurant parking requirements for
Old Town Tustin; and 2) facilitate the establishment of
outdoor restaurant seating areas in Commercial Districts
within the City, including Old Town Tustin.
At that time, the Planning Commission also discussed a
concern that drive-thru establishments were currently listed
as a conditionally permitted use within the City's C-2 zoning
regulations, and that drive-thru establishments might not be
a supportable use within C-2 zoned properties located within
Old Town Tustin. Specifically, the Planning Commission
noted that drive-thru establishments might not compatible
with the historic Old Town walking experience. The
Planning Commission recommendation supporting adoption
of Ordinance 1373 included a recommendation that the City
Council eliminate drive-thru establishments as a
conditionally permitted use in Old Town.
RECOMMENDATION:
That the Planning Commission adopt Resolution No. 4142,
recommending that the Tustin City Council adopt Ordinance
No. 1378 amending Section 9233 of Part 3 of Chapter 2 of
Article 9, prohibiting drive-in and drive-thru establishments in
Old Town.
Adopted Resolution 3. SPECIFIC PLAN AMENDMENT 10-001, MINOR TEXT
No. 4143 AMENDMENTS.
The City of Tustin is proposing minor text amendments to
the MCAS Tustin Specific Plan, which will not substantially

amend the Specific Plan, but will clarify the calculation of
gross and net acreage within Planning Area 1 and would
revise existing language to provide additional flexibility to
allow the submittal of a concept plan for any portion of
Planning Area 1.
RECOMMENDATION:
That the Planning Commission adopt Resolution No. 4143,
recommending that the Tustin City Council adopt Ordinance
No. 1379, amending various sections of the MCAS Tustin
Specific Plan.
REGULAR BUSINESS:
Presented -Amy 4. WORKSHOP: USE DETERMINATION CODE AMENDMENT

Code Amendment 10-002 (CA 10-002) proposes the
incorporation of minor amendments to the Zoning Code
(Article 9 Chapter 2) of the Tustin City Code (TCC).
Specifically, the Code Amendment meets the following
objectives:
a. Incorporate use determinations into the Zoning Code
that have been previously determined by the
Community Development Director and/or the Planning
Commission to be similar to other permitted uses or
conditionally permitted uses within various City zoning
districts.
b. Provide accurate and updated information in the
Zoning Code for both staff and the public as to which
uses are permitted or conditionally permitted and the
review process required for approval of such uses.
c. Integrate other minor amendments by clarifying and
simplifying the Zoning Code text including grammatical
and spelling changes, updating terminology,
alphabetizing lists, and incorporating legal updates.
STAFF CONCERNS
5. REPORT OF ACTIONS TAKEN AT FEBRUARY 2, 2010,
CITY COUNCIL MEETING.
The Director reported:

• City Council considered the amendment to the conditions of
approval related to Traditions Restaurant which would
typically have come through the Planning Commission; the
City Council brought an appeal to the Council; the ground
lease holder, the building lease holder, and the business
owner requested the authority to sign the Agreement to
Conditions; the conditional use permit will not run with the land
but with the lease hold interest.
• City Council will conduct interviews for the open Commission
positions on February 16, 2010, at 4:30 p.m.
COMMISSION CONCERNS
Thompson • Attended the City Council meeting on February 2 and provided an
overview of the OCTA Citizens Advisory Committee; an Energy
Supply and Sustainability Workshop on February 4 provided by
SDG&E; the Mayor's Inaugural Dinner; the Southern California
Transportation Forum on February 5; and the Orange County
Business Council Infrastructure Update on February 9, featuring a
presentation on the Great Park in Irvine;
• Indicated his father, Bob Thompson, was in attendance this
evening; in 1990, his father was significantly involved in helping to
restore Commissioner Thompson's historic home.
Puckett • Noted his Planning Commission term is expiring and he is
reapplying;
• Stated the attendance for the Mayor's Inaugural was down this
year, but it was still a wonderful event that benefitted the Tustin
Community Foundation;
• Reminded everyone that the Citrus Ranch Park Grand Opening
takes place February 27;
• Wished his wife a Happy Valentine's Day.
Kasalek • Noted the tribute to former Mayor Lou Bone at the Mayor's
Inaugural Dinner was well deserved;
• Indicated it was nice the meet the grandfather of Luke Thompson,
our "honorary" Planning Commissioner;
• Stated she received her call from AIertOC, so the program is
working;
• Wished everyone Happy Valentine's Day.
Murray Attended the Pioneer Middle School PTO; the historic training on
January 27-28; the Chamber Mixer; the Mayor's Inaugural Dinner;
the Eagle Scout Court of Honor at which Dane Nielsen was
honored;

Murray continued . Enjoyed presenting the Certificate of Recognition to the very nice
owners, Trajan Perez and Charlotte Bougeois, of the Greenwood
House;
• Commended City services for their response during the recent
rainstorms;
• Complimented the Tustin Police Department regarding recent
arrests in a homicide case and a sexual assault suspect;
• Congratulated his daughter whose Cal Cup team finished second
in a recent tournament;
• Wished his wife Happy Valentine's Day.
Kozak . Thanked staff for their work on tonight's agenda items;
• Noted that former Mayor Jeff Thomas was appointed Vice
President of the Metropolitan Water District of Orange County;
• Indicated he and his wife enjoyed the Mayor's Inaugural and
complimented Erin Nielsen and her team, which includes Chuck
Puckett as President of the Foundation, for the success of that
event;
• Stated it was his pleasure to open the historic workshop on
January 27.
Puckett Added that he heard many comments that Tustin was the "finest
venue" ever for the California Preservation Foundation.
Kasalek Added that the tour of the Hanger was the highlight for many
workshop attendees.
Kozak Noted that the Grand Opening of Citrus Ranch Park takes place from
10:00 a.m. to 12:00 p.m., Saturday, February 27.
8:26 p.m. ADJOURNMENT:
The next regular meeting of the Planning Commission is scheduled
for Tuesday, February 23, 2010, at 7:00 p.m. in the City Council
Chamber at 300 Centennial Way.
