OF THE CITY OF TUSTIN, CALIFORNIA, SETTING A TIME AND PLACE OF A PUBLIC HEARLNG TO CONSIDER TItE DESIGNATION AND ADOPTION OF AN UNDERGROUND UTILITY DISTRICT REQUIRING THE REMOVAL OF POLES, OVERHEAD WIRES AND ASSOCIATED OVERHEAD STRUCTURES WlTHIN THE AREA OF THE CITY OF TUSTIN LOCATED ON RED HILL AVENUE BETWEEN COPPERFIELD DRIVE AND 160' + NORTH OF EL CAMINO REAL, WHICH AREA IS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A' ATTACIlED HERETO AND ON THAT CERTAIN MAP ON FILE IN THE OFFICE OF THE CITY CLERK AND CITY ENGINEER OF THE CITY OF TUSTIN WHEREAS, Ordinance No. 411 of the City of Tustin authorizes the City Council from time to time to call public heatings to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead v-ires and associated overhead structures within certain designated areas of the City and to consider the underground installation of the aforementioned appurtenances for suppbqng electric, communication, or similar associated services to the residents of the City of Tustin; and WIIEREAS, by the aforementioned Ordinance No. 411, the City Clerk is required to notify all affected prtperty owners, if any, as shown on the last equalized assessment roll and also to notify all concerned utilities by mail of the time and place of heatings to determine whether to form an und.erground utility district and of the availability of the City Engineer's report of the details of the district in the office ofthe City Clerk prior to said hearing; and WIIEREAS, said notice is required to be given to the aforementioned property owners and concerned utilities at least ten (10) days prior to the date of the public hearing; and WIIEREAS, the City Engineer has advised that this report is on file in the office of the City Clerk; and WItEREAS, the City Council has determined that a public hearing should be set on June 1, 1998, at the hour of 7:00 P.M. in the City Council Chambers at 300 Centennial Way in the City of Tustin. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said council hereby sets Monday, June 1, 1998 at 7:00 P.M. in the City Council Chambers at 300 Centennial Way in the City of Tustin, California, as the time and place for a public hearing to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the establishment of an underground utility district within the area of the City of Tustin generally located on Red Hill Avenue between Copperfield Drive and 160' + North of El Carnino Real as shown on a certain map on file in the office of the City Clerk and the City En~neer of the City of Tustin. 1 5' 7 8 9 10 11 12 15 I4~ 15 16 17 18 I9 20 21 24 26 27 BE 1T FURTHER RESOLVED, that the City Clerk is hereby authorized to notify all affected property owners, if any, as shown on the last equalized assessment roll an~ to also ' notify all utilities affected by this proposal by a notice through the United States mail of the time and place of said hearing, and of the availability of the City Engineer's report of the details of the distriCt in the office of the City Clerk prior to said hearing, ten (10) days prior to the date thereof.
