RESOLUTION NO. RDA 92-11
A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING DESIGN REVIEW
92-036 AUTHORIZING THE CONSTRUCTION OF A 680-SQUARE
FOOT ADDITION TO AN EXISTING COMMERCIAL BUILDING ON
THE PROPERTY LOCATED AT 13041 NEWPORT AVENUE
The Redevelopment Agency of the City of Tustin does hereby
resolve as follows:
I' The Redevelopment Agency finds and determines as follows:
Pursuant to the adopted Town Center Redevelopment
Plan, the Redevelopment Agency shall approve all
site plans and architectural designs of any project
proposed within the project area.
That a proper application, Design Review 92-036,
has been filed on behalf of Burnett-Ehline
requesting authorization to construct a 680-square
foot addition to an existing commercial building on
the property located at 13041 Newport Avenue.

Pursuant to Section 9272 of the Tustin Municipal
Code, the Redevelopment Agency finds that the
location, size, architectural features and general
appearance of the proposed development will not
impair the orderly and harmonious development of
the area, the present or future development
therein, or the occupancy as a whole. In making
such findings, the Redevelopment Agency has
considered at least the following items:

Height, bulk and area of buildings.
Setbacks and site planning.
Exterior materials and colors.
Type and pitch of roofs.
Towers, roof structures, doors and windows.
Landscaping, parking area design and traffic
circulation.
Location, height and standards of exterior
illumination.
Relationship of proposed structures to
existing adjacent uses.
Appearance and design relationship of proposed
structures to existing structures and possible
future structures in the neighborhood.
Development guidelines and criteria as adopted
by the City Council.
This project has been determined to be
Categorically Exempt (Class 1) pursuant to Section
15301 of the California Environmental Quality Act.

II.
The Redevelopment Agency hereby approves Design Review
No. 92-036 authorizing the construction of a 680-square
foot addition to an existing commercial building on the
property located at 13041 Newport Avenue, subject to all
conditions contained in Exhibit A attached hereto.
PASSED AND ADOPTED by the Redevelopment Agency of the City of
Tustin at a regular meeting held on the 20th day of July,
1992.

1.1
The proposed project shall substantially conform with the
submitted plans for the project date stamped July 20,
1992, on file with the Community Development Department,
as herein modified, or as modified by the Director of
Community Development Department in accordance with this
Exhibit.
1.2
Unless otherwise specified, the conditiona contained in
this Exhibit shall be complied with prior to the issuance
of any building permits for the project subject to review
and approval by the Community Development Department.
1.3
Design Review approval shall become null and void unless
building permits are issued within eighteen (18) months
of the date of this Exhibit.
1.4
Any public improvements damaged by the applicant adjacent
to this property shall be repaired and/or replaced as
determined by the Engineering Division and shall include,
but not be limited to, curb and gutter, street paving and
drive apron.
1.5
Ail construction shall be in accordance with the UBC and
applicable city Codes.
1.6
Approval of Design Review 92-036 is contingent upon the
applicant signing and returning an "Agreement to
Conditions Imposed" form, as established by the Director
of Community Development.

At plan check, submit three (3) sets of construction
plans and two (2) sets of calculations. Requirements of
the Uniform Building Code shall be complied with as
approved by the Building Official. No field changes
shall be made without corrections submitted to and
approved by the Community Development Department.

USE RESTRICTIONS
3.1
The restaurant seating shall at no time exceed 89 seats,
unless additional parking becomes available and said
change is submitted to the Community Development
Department for review. This design review approval shall
not authorize any additional seats to the center-wide
total and shall conform to the requirements as approved
for Variance 88-05. A seating plan shall be submitted
at building plan check for review and approval by the
Community Development Department.
FEES
4.1
Prior to the issuance of any permits, the payment of the
following fees are required:
a. Building plan check and permit fees shall be paid
to the Community Development Department.
b. School impact fees shall be paid to the Tustin
Unified School District.
c. New Development Tax shall be paid to the Community
Development Department.
