OF TUSTIN, APPROVING THE REZONING OF CERTAIN
;5 PROPERTIES FROM C-1 TO CG DISTRICT AT THE
NORTHEASTERLY CORNER OF RED HILL AVENUE AND
4 NISSON ROAD

The City Council of the City of Tustin does ordain as follows:

I. That the City Council of the City of Tustin does hereby find and
~/ determine as fol 1 ows:
8 A. That a proper application, (Zone Change 81-2) has been filed on
behalf of Eugene and Rita Tutt for a zone change from the Retail
9 Commercial (C-1) to the Commercial General (CG) District for the
property described in Exhibit "A" attached hereto and incorporated
10 herein by this reference as though set forth herein in full.
ll B. That a public hearing was duly called, noticed and held on said
appl icati on.
C. That a zone change should be granted for the following reasons:
1. The Commercial General District is in conformance with the
14 commercial land use designation of the Tustin Area General
P1 an.
2. The Commercial General District authorizes a broader range of
I6 permitted uses and provides the opportunity for review of
unclassified uses for appropriateness of site and development.
D. Development of subject property shall be in accordance with the
18 policies adopted by the City Council; Uniform Building Codes as
administered by the Building Official; Fire Code as administered by
19 the Orange County Fire Marshal; and street improvement requirements
as administered by the City Engineer.
E. Final development plans shall require the review and approval of
21 the Community Development Di rector.
22 F. That this project is categorically exempt from the requirements of
the California Environmental Quality Act.
G. Uses within the District are subject to approval of a use permit.
II. The City Council hereby approves zone change 81-2 for the above
.~5 described properties (Exhibit "A") from the Retail Commercial (C-1)
to the Commercial General (CG) District subject to the following
26 requirements:
27 A. The posting of a bond in an amount determined necessary by the
Public Works Director for the completion of public improvements at
28 such time as the property is improved or public improvements can be
constructed without adverse impact upon existing private property
29 improvements.
30 B. The filing of a parcel map as required by the Subdivision Map Act
for that portion of Parcel 2 of Parcel Maps 25 - 29 recorded in
31 Book 25, Page 29 of Miscellaneous Maps of Orange County.

C. The recording of a signed agreement as prepared by the City
Attorney and the posting of a bond to guarantee the removal of the
billboards from subject property at no expense to the City within
three (3) years from the date of the adoption of this ordinance.
PASSED AND ADOPTED at a regular meeting of the City Council held on the 1st
6 day of June, 1981.
