The City Council of the City of Tustin does hereby ordain as follows:

SECTION 1: Chapter 1, Article 8, Tustin City Code is amended to read as
7 fol lows:
8 8105 adoption of the State Historical Building Cede
9 The State of California, California Administrative Cede, Title 9.4,
State Building Standards, Part 8, State Historical Building Code,
10 for the purpose of providing alternative building regulations for
the rehabilitation, preservation, restoration or relocation of
11 i" buildings or structures designated as historical buildings by
~ Federal, State of California, County of Orange, or City of Tustin.
12 All provisions in effect October 20, lgYg, adopted and published by
office of administrative hearings, Department of General
13 Services, distributed by State of California, Documents
Section, P.O. Box 1015, North Highlands, California, 95880, of
14 which not less than three (S) copies have been and now are filed in
the office of th City Clerk of the City of Tustin, are hereby
~. 15 adopted and incorporated herein as fully as though set forth in
i full herein.

2. GENERAL PENALTY; CONTINUINS~VIOLATION

No person shall violate any provisions, or fail to comply with any
18 of the provisions of this Code, or of any code adopted herein by
reference. Any person violating any of the provisions or failing
19 to comply with any of the mandatory requirements of this Code, or
of any cede adopted by reference her.ein, unless otherwise specified
20 in this Code, shall he punishable by a fine of not more than
$500.00 or by imprisonment in the City or County Jail for a perled
21 of not exceeding six months, or by both such fine and
imprisonment. Each such person violating such provision or failing
22 to comply with such requirements shall he guilty of a separate
offense, and each day during any portion of which any violation of
25 any provision of this Code, or of any code adopted by reference
herein, is comnitted, continued, or permitted by such person,
24 shall constitute a separate offense, and shall he punishable
accordingly. Provided further that each such person violating
25 a provision which l~mtts the time an act my he permitted or
continued, each such peried of portion thereof of which any
26 violation of such provision is committed, continued or permitted
by such person shall constitute a separate offense, and shall
~- 27 he punishable accordingly.
! 28 In addition to the penalties hereinabove provided, any condition
caused or permitted to exist in violation of any of the provisions
29 of this Code, or of any code adopted by reference herein, sb~ll be
deemed a public nuisance and my be su~mmrily ahated as such by
30 this City, and each day such condition continues sbsll he regarded
as a new and separate nuisance and offense.

5 3. SEWERABILITY OF PARTS OF THIS ORDINANCE AND THE ADOPTED CODES
6 It is hereby delcared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases
7 of this Ordinance and the adopted Codes are severable, and if
stay phrase, clause, sentence, paragraph or section of this Code
8 shall be declared unconstitutional by the valid judgment or decree
of court of competent jurisdiction, such unconstitutionality shall
9 not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this Ordinance and the adopted Codes.

4. The City Clerk shall certify to the passage of this Ordinance,
11 and shall cause the same to be published once within fifteen (15)
days after it adoption, in the Tustin News, a newspaper of general
12 circulation, printed, published and circulated in said City, and
~.mediately upon and after its passage it shall take effect and be
13 in full force.

PASSED AND ADOPTED at a regular meeting of the City Council of the City of
15 Tustin, held on the 18th day of May , 1981.
