HUSTON, CITY MANAGER KRISTI RECCHIA, DIRECTOR OF HUMAN RESOURCES Agenda Item Reviewed: City Manager Finance Director CONSIDERATION OF CLAIM OF FRED SALIBA, CLAIM NO. 09-32 3 N A The Claimant alleges that he has filed two police reports regarding threatening and harassing phone calls he has received from several acquaintances. The Tustin Police investigated the cases, but no arrests were made. Claimant is seeking restitution in the amount of $150,000 for what he believes to be a lack of response and violation of his civil rights by the Tustin Police. RECOMMENDATION: That the City Council deny Claim Number 09-32, Fred Saliba, and direct Staff to send notice thereof to the Claimant. FISCAL IMPACT: None. DISCUSSION: The City's Claims Administrator, NovaPro, has completed their investigation and concludes that there is no liability on the part of the City. The Police Department put forth a concerted effort to assist by investigating the claimant's complaints, however the Police Department is not liable for threats and/or harassment the claimant may have received by unknown parties. Staff is recommending denial of the claim. Kristi Recchia Director of Human Resources ATTACHMENT: Copy of Claim No. 09-32 to city attorney of the city of tustin. my name is Fred Saliba and towards the end of the year of 2007 i filed a police report #. 07-8441 in regards to threatning and harrrasement calls which also had police corruption involved becaust the ones that are making these calls they said that they are working with the police and they are also affiliated with the mafia. I spoke with detective camarillo and I told her these people are affiliated with gangs from boston and they knew bunch of corrupted cops and also they dealt drugs and sunny rosete/perez also wanted to go into the police just to be a crooked officer.detective camarillo said she would put a trap on my phone which i called my phone company and they said that was never done and they would not be able to do anything for me without an officer from the police departement calls them because they need their badge#.and the calls never stopped they would call my place of work as we I and ~ ~ ~1, they would harrass many people they somehow had access to my voice' the ~ I7~ would than e m g y y y ~``~'` g y greetin s almost on doll basis. the also would threatened my family I was fired from work because of this and I had to quit few jobs and I as well purchased a new car in december of 2007 that was all weel drive and drove to indianapolis in the worst storm weather they had in $ years just to be close to my kid which at the time she was only 12 years old because they said they would harm her as well.the entire time i was waiting for an arrest to be made and charges to be filed against all of these criminals that are doing this only to find out that detective camarillo closed the case. i gave them plenty of evidence and witnesses and than this went on in indianapolis as well I had to start work there i was running out of funds and they somehow found out where i was working and they did the same thing they would call my work with threats and harrassements this is all aggravated and they also would call up women that i am trying to meet I was single at the time and trying to find me a soulmate and they would sexually verbally abuse them over the phone and they would harrass them and make phony dates with them pretending they were me.I called the tustin police from Indiana and i spoke with seargeant harper and complaint to him about how could they let all this keep on happening and they need to make an arrest and fife charges, these criminals are just above the law and they need to be stopped.he asked me for more evidence which i had told them before when I opened the case that i had plenty more of evidence if they needed any and the officer that took the report thought that there was already plenty of evidence when he took the report. and i mailed him more evidence nothing did stop and the seargeant would not even return my call. I came back to California and still the threats and harrasements never stopped they called my work here in California again and i have witnesses to everything that you are reading.and I filed anothe r report at towards the end~of 2008 case#08-7878. everything they were doing is aggravated over the years they had broken into my car and house and they confessed to all of their criminal activities that they are practicing.they would call hotels that i would stay in as well they also would threat witnesses they also would call places where i r_• applied at for jobs and they would harrass them as well,a ford dealership in Q;S~ indianapolis and a translation company called JTG they would tell people from those Cr(~u'C='~' companies that i would preform any kind of sexual acts if they were to hire me. the ~ ~~ seargent also lied and controdicted himself over the time I filed the second rep 7 and totally handled the investigation with his detectives in an unethical matter.my civil rights were so violated for such a period of time and my well being was as well threatened and still is i am still to today receiving these calls. this went on for a long time and i am asking you for justice i want a full investigation in the police departement and I want to press charges on the ones behind all of these crimes. sunny rosete also known as sunny perez I know is one, and other people that he has given my # to an person by the name david gonzales and a woman that desquizes her voice sometime to sound like a man and they use names as nick shepper and aerio. you have all the vidences it's still in your departement. i am also asking for restitution for a small amount of $150,000.00 which is only how much this matter cost me financially,if i was to have to include attorneys and the media i would than have to ask for millions.I am a tustin citizen i went to school in this city i have lived almost all of my life in this city and i have great faith in law enforcement and i am not going to let this make me loose faith. i have tried everything I can to stop these criminals from hurting anyone,or myself I have used evry part of my skills that i learned as a citizen and as navy graduate.Need to hear back from you within the next 30 days. /Z~~L~ -~-r, ~~r~- ~.~ C~G'~ thank u. ~~~~- -~.._.~ ~.~ IF LATE CLAIM: COMPLETE ITEMS 1- 9 AND THIS APPLICATION.
