Kapadia Presented the staff report.
Planning Commission discussion ensued.
The Public Hearing opened at 7:34 p.m.
Chair Murray invited the applicant to the lectern.
Donna Kelly spoke on behalf of Lennar.
Shaun Bradley spoke on behalf of Meta Housing Corporation.

Chair Murray called a brief recess.
The meeting reconvened at 8:56 p.m.
Further Planning Commission discussion ensued.
The Planning Commissioners stated their reasons for recom-
mending denial of the rental tenure.
Staff requested time to discuss and prepare a resolution of
denial of the rental aspect of the project.
After a brief recess, the meeting reconvened at 9:24 p.m.
The Director described the resolution as a denial of the rental
tenure and status quo on the condominium aspect; stated this
item will go before the City Council April 20, 2010, where the
Council may consider an approval, the Planning Commission's
recommendation, or modify and take a separate action;
notification of that meeting will be provided to interested parties.
It was moved by Thompson to approve the resolution as
presented, seconded by Kasalek. Motion carried 5-0.

STAFF CONCERNS
3. REPORT OF ACTIONS TAKEN AT MARCH 16, 2010,
CITY COUNCIL MEETING.
The Director reported:
• the City Council took action on the Use Determination
Ordinance; the second reading will be held at the April 6,
2010, Council meeting;
• the Planning Commission recommendation on the 2009
General Plan Annual Report was approved; that
document has been forwarded in compliance with state
law.
COMMISSION CONCERNS
Kozak Thanked staff for their hard work on the staff report, which
covered the information for which the Commission and
residents requested feedback at the last meeting;
• Stated he attended the Tustin Area Council of Fine Arts
(TACFA) Centennial last evening at Illiano's;
• Noted he will be joining other members of the Commission
for the tour of the Metropolitan Water District of Orange
County (MODOC) this Friday.
Kasalek Indicated that she plans to take the Water District tour;
• Noted that the Tustin Youth Track Meet takes place this
Saturday at Tustin High School;
• Wished everyone a Happy Easter.
Puckett • Reminded everyone the Easter Egg Hunt is coming up and
also the Pancake Breakfast sponsored by the Tustin
Community Foundation; 500 breakfasts were served last
year; the plan this year is to serve 1,000;
• Indicated he also will be taking the MODOC tour;
• Stated there will be a "Water Party" this Sunday between
5:00 and 7:00 p.m. at Wilcox Manor-everyone should bring
a Tustin water bill and arrange to donate money to the Tustin
Community Foundation on their future water bills;
• Offered, once again, his congratulations to Mayor Pro Tem
Nielsen for his being awarded the Silver Beaver.

Thompson Attended the Chamber of Commerce Business and
Economic Development Committee on March 11; the OCTA
Citizens Advisory Committee Bicycle Ad Hoc Committee
meeting on March 16; the OCTA CAC which provided a
presentation on the Anaheim Resort Transportation
Intermodal Center (ARCTIC), a very impressive facility; and
the TACFA event;
• Noted the "Broadway in the Park" musical this year has been
announced: "Guys and Dolls";
• Provided a water update from Reuters;
• Noted the Conservancy Preservation's award dinner on April
19 is an event not to be missed.
Murray Thanked staff for their hard work on this evening's report;
• Stated that the Easter Egg Hunt is one of his favorite Tustin
events of the year;
• Indicated he attended the Orange County Water Policy
Forum; the Pineapple Hill Grill ribbon-cutting; "Casino Night"
at the Senior Center-kudos to Marilyn Esposito and Barbara
Guerrero; the Chili Cook-off and Street Fair committee
meeting on March 17t"; on the 18t", the Orange County
Vector Control District Board meeting; and the TACFA event,
where the food was great;
• Shared that last weekend his daughter's water polo team
won first place in a tournament Sunday which was her
birthday and also Commissioner Puckett's birthday;
• Added he is looking forward to the performance of "Guys and
Dolls."

It was moved by Puckett, seconded by Kozak, to adjourn.
Motion carried 5-0.
The next regular meeting of the Planning Commission is
scheduled for Tuesday, April 13, 2010, at 7:00 p.m. in the City
Council Chamber at 300 Centennial Wa~c.
