BRANCH, County Recorder A RESOLUTION AND ORDER OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN ORDERING AND DIRECTING DISPOSITION BY SALE OF A PARCEL OF PROPERTY ADJACENT TO NEWPORT AVENUE IN THE CITY OF TUSTIN, CALIFORNIA. The Community Redevelopment Agency of the City of Tustin resolves and orders as follows: _ 1. The Community Redevelopment Agency of the City of Tustin, California, duly adopted Resolution No. 78-24, a Resolution of Intention to Sell a Portion of Property Located on Newport Avenue in the City of Tustin, California, more particularly described therein. 2. in Resolution No. 78-24a public hearing was set, said Resolution was published and copies of the Notices of said hearing were duly posted along the area proposed to be sold and each and all of the aforesaid Notices were duly given, published and posted more than ten (10) days prior to the date of said public nearing. ;. in the 21st day of August, 1978, at 7:30 P.M., the Community Rede- velopment Agency held the said public hearing and has found as follows:. a. That the property is not needed for any present or prospective public use, and is therefore excess and s::ro- us land. D.-:a't the public interest and convenience require the sale of said site. c. That the site proposed for sale is described as southerly half of Lot 12 in Block "B" of "Martin's Addition to the Town of Tustin," as per the map recorded in Book 19, Page 79, of Miscellaneous Records of Los Angeles County, California, excepting therefrom the northwesterly 20.00 feet thereof, is unnecessary for any present or prospective public purposes. d. That any and all easements upon said parcel shall be retained by the Community Redevelopment Agency. e. The subject property to be sold has a reasonable and fair market value of $5500.00. 4. That any person who wishes to make an offer to purchase the said property may do so by submitting to City at or before the time for submissions of proposals an offer in writing in the form attached as Exhibit "A" accompanied by a cashier's check in the sum of $5,000.00 payable to the Community Redevelopment Agency of the City of Tustin. 5. That the minimum, base bid shall be $5,500.00. Final sale shall be subject to the normal real estate sales provisions as prepared by the City Attorney. 6. That the Community Redevelopment Agency shall reserve the right to refuse all bids. 7. That the Community Redevelopment Agency shall prepare any parcel map(s) required for the sale of property. Any purchaser(s) of the subject property shall be obligated to use the property for the purposes designated in the Tustin Zoning Ordinance. Develop- ment shall be in conformity with all applicable laws, including all applicable federal and state labor standards. The purchaser(s) and purchaser's successors and assigns, agree that in the construction of the said improvements upon subject property that they will not discriminate against any employee or appli- cant because of race, color, religion, sex, marital status or national origin and shall refrain from restricting the rental, sale, or lease of the nro~erty on the basis of race, color, religion, ancestory or national origin. Purchaser(s) shall covenant by and for himself, his heirs, executors, admin- istrators, and assigns, and all persons claiming under or through them, that there shall be no discrimination against or segregation of, any person or group of persons on account of race, color, creed, national origin, or ances- tory in the sale, lease, sublease, transfer, use, occupancy, tenure or enjoy- ment of the subject premises, nor shall the grantee himself or any person claiming under or through him establish or permit any such practice or prac- tices of discrimination or segregation with reference to the selection, loca- tion, number, use or occupancy of tenants, lessees, subtenants, sublesses, or vendees in the premises to be conveyed. The foregoing shall be covenants and conditions running with the land, the breach of which shall cause the fee to revert to the Community Redevelopment Agency. 9. That proposals shall be submitted no later than lO:O0 A.M. on ~.tember 11, 1978 , to the City Clerk's Office, at whichl~ime the staff shall open and review the proposals. 10. That a hearing is set for ~ptember 18, 1978, at 7:30 P.M. in the Council Chambers of the City of Tustin at Tustin City Center, Centennial at Main, Tustin, California, at which time and place the Community Redevelopment Agency shall pass upon any and all proposals and accept such offer as it deems in the best interest of the City of Tustin. ll. That a copy of this resolution shall be published once in the Tustin ~, a weekly newspaper published and circulated in the City of Tustin, California, and once in The,.~]~9.~, a daily newspaper published in the County of Orange, and outside of the City of Tustin, California. The aforesaid publications shall be made not less than ten (10) days prior to the date of said public hearing. Prior to said public hearing, copies of this resolution shall be posted for not less than ten (10) days in at least three (3) cons- picuous places upon the aforesaid real property. 12. The City Clerk is hereby ordered to have recorded in the office of the Recorder of the County of Orange, a certified copy of this resolution and order.
