CONDITIONAL USE PERMIT 09-032- a request for authorization to modify a master sign program for the Mimi's Plaza Shopping Center to refine general sign criteria and to deviate from Tustin City Sign Code maximum size requirements for three (3) freeway-facing wall signs. APPLICANT: PROPERTY OWNER: ENVIRONMENTAL STATUS: RECOMMENDATION JON MERRY JM COMMERCIAL, LLC MIMI'S PLAZA, LLC C/O JM COMMERCIAL, LLC THIS PROJECT IS CATEGORICALLY EXEMPT PURSUANT TO SECTION 15311, CLASS 11 OF TITLE 14, CHAPTER 3 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT That the Zoning Administrator adopt Zoning Administrator Action No. 10-004 approving Conditional Use Permit 09-032. Presentation: Reina Kapadia, Associate Planner Zoning Administrator Agenda May 3, 2010 Page 2 The Acting Zoning Administrator asked the attendees to introduce themselves. Linda and Jerry Wooten, Wooten's Scrapbook Co., and Jon Merry, applicant, were in attendance. The Public Hearing opened at 10:37 a.m. The Acting Zoning Administrator explained the procedure, reviewed the staff report and asked if everyone had read the report and conditions of approval. Mr. Merry referred to Condition 2.2 and indicated that compliance within 60 days would be extremely difficult for one particular tenant, Bizakis Furs, which has been struggling through these difficult economic times. He stated that sign has existed for 14 years and suggested that perhaps the sign could be grandfathered in to the new sign program. The Acting Zoning Administrator indicated that the condition could be amended to allow six (6) months for compliance, but the tenant needs to show that the process has begun. The Public Hearing closed at 10:49 a.m. The Acting Zoning Administrator approved Zoning Administrator Action No. 10-004 approving Conditional Use Permit 09-032 with the modification of Condition 2.2. REGULAR BUSINESS: None ADJOURNMENT: The meeting adjourned at 10:51 a.m. The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
