That the Planning Commission adopt Resolution No. 3716 approving Conditional
Use Permit 00-004.
The Public Hearing opened at 7:02 p.m.
Bradley Evanson, Assistant Planner presented the subject report.
Commissioner Davert asked if the hours stated in Condition 2.4 were requested
by the applicant.
Bradley stated that the hours in Condition 2.4 are more generous than what the
applicant requested because staff wanted to give the applicant more flexibility.
Commissioner Davert stated that he would like to change the hours to Monday
through Saturday.
Commissioner Pontious asked if the current requested hours would preclude an
employee from working on Saturday or just not opening for business.

Commissioner Davert moved, Commissioner Pontious seconded, to approve the
minutes corrected as follows:
Top of page 4, need to complete sentence attributed to Chairperson Kozak as
follows: "is pleased that approval of this request will provide the congregation
with a permanent home."
Motion carried 5-0.
PUBLIC HEARINGS:
2. Conditional Use Permit 00-004 a request to establish a contractor's office in an
existing office building. The project is located at 275 Centennial Way, Suite 211,
within the First Street Specific Plan zoning district.

Bradley stated that an employee would not be precluded from working on
Saturday but not opening for business.
Commissioner Davert asked if staff could approve this kind of application in the
future.
The Director stated that uses identified as office use only have later converted to
something different and construction materials have shown up on site. She
further noted that the Zoning Administrator Ordinance could be modified to allow
the Zoning Administrator to approve this kind of conditional use permit.
Commissioner Davert stated that the change should be considered at a future
meeting.
Chairperson Kozak asked for a consensus for changing the hours of operation.
Commissioner Davert noted that he did not wish the applicant to have to return
to request a change in the hours at a later date.
The Director stated that staff is not concerned with changing the hours.
Chairperson Kozak suggested amending Condition 2.4 by changing Friday to
Saturday.
The public hearing closed at 7:07 p.m.
Commissioner Davert moved, Commissioner Bell seconded, to approve
Conditional Use Permit 00-004 by adopting Resolution No. 3716 amended as
follows:
Finding 1. D.2: change "Friday" to "Saturday"
Condition 2.4: change "Friday" to "Saturday"
Motion carried 5-0.
Conditional Use Permit 99-012 And Design Review 99-017 a request to
construct a major wireless communication facility. The project is located at 15201
Woodlawn Avenue within the Pacific Center East Specific Plan (Technology
Center) zoning district.

STAFF CONCERNS:
4. Report on Actions taken at the February 22, 2000 City Council Meeting
Elizabeth A. Binsack, Director of Community Development reported on the subject
agenda.
Commissioner Pontious moved, Commissioner Kawashima seconded, to receive
and file. Motion carried 5-0.
COMMISSION CONCERNS:
Commissioner Bell
Noted that there have been half-constructed block pilasters at the
intersection of Pioneer and Patriot Way since before Christmas.
The Director responded that staff will check into the pilasters.
Commissioner Davert
Noted that the Wendy's on Red Hill is under construction.
Stated that he attended a special board meeting of the Tustin Unified
School District and a member of the board asked him to answer some
questions related to potential development on the vacant lot at Tustin
Ranch Road and Rawlings Way. He stated that he spoke only as a private
citizen, made general comments about the planning process, and clarified
that there are no entitlements on the property. He further noted that he
made no reference to any specific projects agendized or otherwise. He did,
however, meet the architect on a possible upcoming project.
Asked about the status of getting a City seal for the Council Chambers.
The Director noted that a vendor was located who agreed to make the seal but
later stated they were not able to complete the job. Staff will need to explore other
sources to create the seal.
Commissioner Pontious
Stated that staff should re-evaluate the First Street Specific Plan and noted
that there have been a lot of exceptions through the years.
The Director stated that staff would review the document and evaluate the pros
and cons of revising the plan. Staff's findings can be brought to the Planning
Commission in the form of a workshop.
Commissioner Kawashima
Noted there are a large number of cars with for sale signs in the rear
parking lot at Larwin Square.
Commissioner Pontious
Noted that Bally's had balloons flying over their building during the weekend
and suggested that staff let them know they are not allowed.
The Director said staff would follow-up with Bally's.
Chairperson Kozak
Noted that auto auction signs from a shop in Santa Ana were on the
offramp at Irvine BIvd and 55 freeway, the bridge and the private property
fence on the north side of Irvine Boulevard all day Sunday.

The Director noted that a City code enforcement officer works on Saturday but not
Sunday so it is difficult to address the removal of signs posted on Sundays. She
further noted that code enforcement does, however, do a sweep for signs every
Monday. She added that staff will propose a code amendment that would allow
staff to issue citations based on the business name on the flyer.
Noted that the City monument sign on First Street by the 55 freeway is not
illuminated.
Staff will advise Public Works.
ADJOURNMENT:
Commissioner Davert moved, Commissioner Pontious seconded, to adjourn the
meeting at 7:20 p.m. Motion carried 5-0.
A regular meeting of the Planning Commission will be held on March 13, 2000 beginning
at 7:00 p.m., City Council Chambers, 300 Centennial Way, Tustin.
