CONDITIONAL USE PERMIT 10-002- a request to operate live entertainment in conjunction with an existing restaurant at 2497 Park Avenue. APPLICANT: PROPERTY OWNER: ENVIRONMENTAL STATUS: RECOMMENDATION DAVID COPLEY AULD DUBLINER VESTAR/KIMCO TUSTIN, L.P. VESTAR DEVELOPMENT COMPANY THIS PROJECT IS CATEGORICALLY EXEMPT PURSUANT TO SECTION 15301 (CLASS 1 - EXISTING FACILITIES) OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT That the Zoning Administrator adopt Zoning Administrator Action No. 10-005 approving Conditional Use Permit 10-002. Presentation: Ryan Swiontek, Associate Planner The Public Hearing opened at 10:34 a.m. The Acting Zoning Administrator explained the process and asked the attendee to introduce himself. Zoning Administrator Agenda May 24, 2010 Page 2 The applicant, David Copley, responded. The Acting Zoning Administrator reviewed the staff report and asked the applicant if he had any questions or concerns. Mr. Copley asked for clarification regarding Finding F.9. The Acting Zoning Administrator explained that this condition provides advance warning to the applicant that, should violations occur, the Police Department or Code Enforcement officers could issue an administrative citation without apre- citation warning. The Acting Zoning Administrator approved Zoning Administrator Action No. 10-005 approving Conditional Use Permit 10-002.
