CONSENT CALENDAR: (ALL MATTERS LISTED UNDER CONSENT CALENDAR ARE CONSIDERED ROUTINE AND WILL BE ENACTED BY ONE MOTION. THERE WILL BE NO SEPARATE DISCUSSION OF THESE ITEMS PRIOR TO THE TIME OF THE VOTING ON THE MOTION UNLESS MEMBERS OF THE COMMISSION, STAFF OR PUBLIC REQUEST SPECIFIC ITEMS TO BE DISCUSSED AND/OR REMOVED FROM THE CONSENT CALENDAR FOR SEPARATE ACTION.) CONSENT CALENDAR: 1. Minutes of the May 11, 1998 Planning Commission Meeting. Commissioner Pontious moved, Commissioner Browne seconded, to approve the Consent Calendar. Motion carried 4-0. Planning Commission Minutes May 26, 1998 Page 2 PUBLIC HEARINGS: 2. APPEAL OF NOTICE AND ORDER OF A PUBLIC NUISANCE AT 13151 RANCHWOOD ROAD On April 6, 1998 the City's code enforcement officer declared the property located at 13151 Ranchwood Road a public nuisance due to overgrown weeds and vegetation. The property owner filed an appeal of this determination on April 13, 1998. Recommendation: That the Planning Commission adopt Resolution No. 3592 denying the appeal of the Enforcement Officer's public nuisance determination at 13151 Ranchwood Road, and directing staff to abate the public nuisance conditions in the front and rear yards and bill all costs of this enforcement action and abatement process to the property owner. Elizabeth A. Binsack, Director of Community Development presented the subject report. George Wiesinger, Code Enforcement Officer gave a narrative of a videotape viewed by the Commission. Commissioner Kozak inquired if the work at the front of the property changes staff's recommendation. The Director stated that staff's recommendation remains the same. The Public Hearing opened at 7:14 p.m. Marcella Napolitan, appellant stated that the information presented was incorrect and that work on the front of the property was completed on April 5, 1998. Commissioner Kozak asked the applicant about work completed on the property. Marcella Napolitan stated the work is indicated on the work order she presented to the Commission. Chairman Mitzman asked if someone lives on the property. Marcella Napolitan stated that the property has been vacant since December 1997. Peter Kline 13182 Wickshire, Chairman of the Bellewick Homeowners Association, stated that the property has been an attractive nuisance for 15 years and has decreased property values Commissioner Pontious asked if the Association collects dues Peter Kline stated that the Association collects fees for maintenance of common areas only. Commissioner Kozak explained the community's concern with emergency access and appearance of the neighborhood to the applicant. The Public Hearing closed at 7:28 p.m. Commissioner Pontious asked if the homeowners association has any ability to maintain the property on an on-going basis and assess the property owner for the work. The Director stated that a citation could be issued but nuisance abatement was more expeditious. Lois Bobak Deputy City Attorney stated that an injunction through civil court would be the only way to gain long-term compliance. Commissioner Kozak inquired if herbicide could be used to delay regrowth. The Director stated that herbicide would be investigated as a deterrent to regrowth. Commissioner Pontious moved, Commissioner Kozak seconded, to adopt Resolution No. 3592 denying the appeal of the Enforcement Officer's public nuisance determination at 13151 Ranchwood Road, and directing staff to abate Planning Commission Minutes May 26, 1998 Page 3 the public nuisance conditions in the front and rear yards and bill all costs of this enforcement action and abatement process to the property owner. Motion carried 4-0. REGULAR BUSINESS: 3. CONTINUED ITEM - REVISED AUTO SERVICE DESIGN GUIDELINES BACKGROUND This is a continued item from the meeting of April 27, 1998. After reviewing the draft Auto Services Guidelines, the Planning Commission determined that the changes in policy and design standards would be more effective if incorporated into the City Code, rather than developed into guidelines. It was also suggested that the draft guidelines be modified by strengthening the language and requiring compliance with the policies and standards. RECOMMENDATION That the Planning Commission provide direction on the proposed additions and modifications to the guidelines. Based on the Planning Commission's direction, staff will prepare revised draft guidelines and an appropriate Resolution recommending approval of the revised Guidelines for consideration. Lori Ludi, Associate Planner presented the subject report. Commissioner Kozak thanked staff and the Commission for incorporating his comments into the guidelines. Commissioner Pontious stated her concern that the guidelines be part of a code amendment to carry more weight and suggested guidelines be changed to standards. Daniel Fox stated that staff is presently working with the consultant and anticipates that the revised guidelines can easily be integrated to provide better direction to staff. The Planning Commission directed staff to rename/change the guidelines to be standards and return a draft to the Planning Commission for forwarding to the City Council for approval. 4. Status Report Recommendation: Receive and File Presentation: Daniel Fox, AICP, Senior Planner Commissioner Kozak moved to receive and file the subject report. STAFF CONCERNS: 5. Report on Actions taken at the May 18, 1998 City Council Meetinq Elizabeth A. Binsack, Community Development Director reported on the subject agenda. COMMISSION CONCERNS: There were no Commission Concems ADJOURNMENT: Commissioner Pontious moved, Commissioner Kozak seconded, to adjourn the meeting at 7:46 p.m. Motion carried 4-0.
