CONSENT CALENDAR
1. Minutes of the March 23, 1998 Planning Commission Meeting.
Commissioner Pontious moved, Commissioner Davert seconded, to approve the
Consent Calendar. Motion carried 5..0.
PUBLIC HEARINGS:
Variance 98-001 a request to reduce the required rear yard setback from twenty
(20) percent of the lot depth to seven feet ten inches (7'-10") to allow for the
construction of an addition to an existing single-family residence. Staff is
proposing that the approval be limited to a ten (10) foot encroachment into the
required rear yard setback. The project is located at 14681 Evanston within the E-
4, Residential Estate Development district.

The Public Hearing opened at 7:03 p.m.
Chairman Mitzman inquired if the applicant was in agreement with the conditions of
approval.
Jim Maddux, applicant stated his agreement with the conditions of approval.
The Public Hearing closed at 7:07 p.m.
Commissioner Davert moved, Commissioner Pontious seconded, to adopt
Resolution No. 3585 approving Variance 98-001. Motion carried 5-0.
VESTING TENTATIVE TRACT MAP 15601, DESIGN REVIEW 97-035 &
HILLSIDE REVIEW 98-001 a request to subdivide a 15.3 acre property into 44
numbered lots and 14 lettered lots for the purpose of creating 44 single-family
detached residences. The project location is Lot 26 and a portion of Lots 13 and
24 of Tract 13627 at the northerly terminus of Township Drive within the Planned
Community Residential, Low Density Residential of the East Tustin Specific Plan.
Daniel Fox, Senior Planner presented the subject report.
The Public Hearing opened at 7:11 p.m.
Bob McClaire, applicant described the concerns of the adjacent residents.
Todd Bloom, 2395 Suddaby, stated his concern with the proximity of the rear yard
setback and presented the Planning Commission with letters from four homeowners.
Karen Potcole, resident, stated her concern with the 16 foot setback.
Chairman Mitzman asked the City Attorney for clarification on the minimum setback and
the legal precedence if the Commission were to enforce a higher setback.
Lois Bobak, Deputy City Attorney, stated that the project exceeds the minimum
requirement set forth in the City Code and the Planning Commission has the discretion for
approval.
William J. Collins, 2261 Pavillion Dr. stated his concern with the effect of the new
development on the storm drain behind his home.
Gary Martin, Hunsaker & Assoc. stated that the existing storm drain will be removed and
replaced with a drain of 100 year storm capacity.
Daniel Fox, Senior Planner stated that conditions in the tentative map and design review
resolutions require that all civil engineering and improvement plans be part of the plan
check process and that engineering staff is aware of the drainage conditions and has
included conditions to accommodate those conditions.
William J. Collins - asked what recourse the residents have if the project is approved by
the Planning Commission and the residents are not satisfied with the project.
The Director stated that the residents could appeal the approval to the City Council.
Lois Bobak stated that the conditions of approval state that the channel shall be designed
to accommodate a 100 year flood and if engineering studies presented to the City do not,
in the City's opinion, accommodate a 100 year flood, the channel will have to be
reengineered.

Daniel Fox stated that it would be to Mr. Collins' benefit to stay in contact with
Warmington and Hunsaker & Associates to assure that he is comfortable with the final
details of the project.
The Public Hearing closed at 7:34 p.m.
Commissioner Davert indicated that his concerns were addressed by the resolution
amendments and commended the developer, neighboring homeowners, the North Tustin
community and staff for working problems out prior to the hearing.
Commissioner Pontious stated that her concerns were also addressed by the
amendments and commended Warmington for the project's architecture.
Commission Kozak indicated his support and commended the developer for their
advance work with the community.
Chairman Mitzman stated his support for the project.
Commissioner Davert moved, Commissioner Pontious seconded, to adopt
Resolution No. 3586 approving the environmental determination for the project.
Motion carried 5-0.
Commissioner Davert moved, Commissioner Pontious seconded, to adopt
Resolution No. 3587, as amended, recommending that the City Council approve
Vesting Tentative Tract Map 15601. Motion carried 5-0.
Commissioner Davert moved, Commissioner Pontious seconded, to adopt
Resolution No. 3588 approving Design Review 97-035 and Hillside Review 98-001.
Motion carried 5-0.

4. Report on Actions taken at the April 6, 1998 City Council Meeting
Elizabeth A. Binsack, Community Development Director reported on the subject agenda.
Commissioner Davert moved, Commissioner Pontious seconded, to receive and
file. Motion carried 5-0.
COMMISSION CONCERNS:
Commissioner Browne
Stated that he and Commissioner Davert were given a tour of the MCAS
Tustin base and thanked staff.

Commissioner Kozak
Cited an article in The Register which references a survey of places to do
business in Southern California and the City of Tustin was rated very highly.
The Director noted that Tustin News reporter George Stewart would be doing a
follow-up story to that article.
ADJOURNMENT:
Commissioner Davert moved, Commissioner Pontious seconded, to adjourn the
meeting at 7:42 p.m. Motion carried 5-0.
A regular meeting of the Planning Commission will be held on April 27, 1998 beginning at
7:00 p.m., City Council Chambers, 300 Centennial Way, Tustin.
