PUBLIC CONCERNS:

Diane Lujan Clapp, 13362 Montecito, Tustin, expressed concern about
the 220 E1 Camino Real location of the Edgewood pre-school.
Another school, Ability Plus, has taken over the lease but has not
acquired a permit. Edgewood already has a lease and litigation is
ensuing. This building was remodeled for pre-school use. She does
not believe the square footage of the building and playground will
accommodate an elementary school. She is interested in seeing
Edgewood occupy the location as a pre-school.
Elizabeth Binsack stated that if Ability Plus files an application
for a Conditional Use Permit this week the item will come before
the Planning Commission for consideration as early as the first
meeting in July.

A CATEGORICAL EXEMPTION HAS BEEN PREPARED IN
CONFORMANCE WITH SECTION 15301 (CLASS 1) OF THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA).
AUTHORIZATION TO CONVERT AN EXISTING AUTOMATIC CAR
WASH TO AN EXPRESS CAR WASH WITH HAND CAR WASHING
SERVICES.
Recommendation - That the Planning Commission adopt Resolution No.
3524 approving Conditional Use Permit 97-002 and Design Review 97-
002.
Presentation: Karen Peterson, Associate Planner
The Public Hearing opened at 7:10 p.m.
Commissioner Kozak, with respect to the KHR Associates traffic
analysis comments, asked if staff recommended that the south
driveway be an exit only and the north driveway entrance only.
Karen Peterson stated that the site functions in this manner and is
the preferred layout but none of the conditions specifically
require this circulation pattern.
Douq Anderson, Traffic Engineer, stated that there were concerns
with truck turning movements and he concurs with the traffic study
to retain the number of driveways on the site.
Commissioner Kozak asked if the landscaping was to be adjusted for
the elevation around the pump islands on the northerly side.
Karen Peterson stated that six inch curbing and other improvements
are anticipated to achieve this planter area.
Commissioner Vandaveer asked for an explanation as to how a
customer would go thorough the wash tunnel and then return for the
detailing.
Douq Anderson stated that a customer would go through the tunnel,
turn left, and return through the gas pumps or the alley to the
detailing area with the attendants directing the traffic flow.
Commissioner Bone asked why it has taken since September 5, 1996
until now to bring this project forward.
Elizabeth Binsack stated that in August of 1996 Code Enforcement
issued a citation to the property owner identifying that the
facility was supposed to be operated as a fully automated car wash.
The owner of the facility had removed the mechanics that made it an
automatic car wash and added new mechanics to make it a partially
automated facility. The City requested that the owner request a
Conditional Use Permit or convert back to the originally approved
use. The time lapse was due in large measure to efforts to bring
the plan into conformance with the City's current guidelines.

Commissioner Bone requested a right turn only sign at the end of
the wash tunnel. He noted that the KHR Associates traffic analysis
shows entrance arrows at the southerly driveway.
Douq Anderson stated there is two-way access at both driveways and
the alley which conform to the California Vehicle Code.
Commissioner Bone asked if the employees were to use the parking
spaces on the site and noted that there is an empty tree well at
the front of the site.
Karen Peterson stated the facility had a total of four employees
which could utilize the parking spaces.
Douq Anderson stated that he would look into getting a tree for the
empty well.
Commissioner Bone asked what would transpire if the project is not
completed within the four month time frame noted in the conditions.
Elizabeth Binsack stated that the City would commence revocation of
the Use Permit which would require them to cease operations.
Commissioner Bone requested a condition to address the problem of
persons exiting their vehicles after leaving the wash tunnel.
Adnon Khatib, 2366 W. Broadway, Anaheim, spoke on behalf of Mr. Al-
Said. Mr. Khatib concurred with the staff report. He stated that
Mr. Al-Said encourages patrons to remain in their vehicles.
Commissioner Bone asked if Mr. Khatib was familiar and agreed with
all the conditions of approval.
Mr. Khatib stated he discussed the conditions with the operator
who also understands and will fulfill the conditions of approval.
He noted that once a month they have a truck service that cleans
the sediment tanks next to the car wash which takes about two
hours.
Commissioner Bone asked where the employees park and noted that the
glass was broken out of the western most light on the side of the
building.
Mr. Khatib stated that all the employees ride bikes and do not have
to use the parking spaces. Mr. Khatib will see that the light is
repaired.
The Public Hearing closed at 7:40 p.m.
Commissioner Pontious moved, Vandaveer seconded, to adopt
Resolution No. 3524 approving Conditional Use Permit 97-002 and
Design Review 97-002 revised as follows: Exhibit A, Condition 3.7,
first sentence shall read, "If, at any time in the future, the City
is made aware and concurs that a parking, traffic or circulation
problems exists on the subject property, then the Community
Development and Public Works Departments may require the property
owner to submit an updated traffic analysis prepared by the
applicant's consultant, at no expense to the City." Condition 3.2
shall add additional sentences to read, "No drying, detailing or
other vehicle finishing shall take place by the customer outside
the wash tunnel. A sign shall be posted on the site indicating
that customers are to remain in their vehicles, subject to approval
of the Community Development Director." Condition 3.18 added to
read, "The southerly driveway shall be restricted to right turn
egress only. A sign shall be posted on the site indicating such;
subject to the approval of the City's Traffic Engineer." Condition

3.19 added to read, "The southerly driveway shall be restricted to

carried 5-0.
REGULAR BUSINESS:
3. Status Reports
Presentation: Daniel Fox, AICP, Senior Planner
Commissioner Bone inquired if Lot 27 had to stay within 8,058
units.
Daniel Fox, Senior Planner, affirmed.
Commissioner Vandaveer moved, Pontious seconded, to receive and
file this report. Motion carried 5-0.
STAFF CONCERNS:
Report on Actions taken at the June 16, 1997 City Council
Meetinq.
Presentation: Elizabeth Binsack, Community Development Director
The Director reported on the subject agenda and introduced Bradley
Evanson and Minoo Ashabi, newly hired Assistant Planners.
Status Report, Orange County Flood Control Channel, adjacent
to Monterey Pines Apartments
Presentation: Daniel Fox, AICP, Senior Planner
Commissioner Bone stated that on June 19th a field meeting was held
with representatives from the City, the School District, Orange
County Flood Control and County Supervisor Tom Wilson's office. He
asked if the County had followed up on this meeting in contacting
the Director. To which the Director replied in the negative. He
noted that there are four separate districts at that location,
including the City of Tustin, the School District, the City of
Santa Ana and the Flood Control District. Flood Control stated
that they would be willing to share the cost of erecting a fence.
He believes the channel is the responsibility of the Orange County
Flood Control District and would like to see a memorandum drafted
to City Council addressing the channel issue with a recommendation
to contact the Flood Control District.
Commissioner Pontious supported the suggestion and would like to
see the Council consult with the School District and the Tustin
Police Department to gather statistics on crime in the area.
Commissioner Kozak suggested that the memorandum to Council recap
the findings from the meeting which was arranged by Chairman Bone
making it clear that the Orange County Flood Control District is
primarily responsible for ensuring the safety of the community with
respect to a hazard free flood control channel.
Commissioner Pontious moved, Vandaveer seconded, to instruct staff
to draft a memo to the City Council on behalf of the Planning
Commission addressing the problems observed at this flood control
channel site and requesting City Council to seek action from the
Flood Control District to ensure the safety of the community.

COMMISSION CONCERNS:
Commissioner Kozak
Reported that the pedestrian island on E1 Camino Real, as
it curves toward Newport, needs some landscape attention
particularly close to the street.
Commissioner Pontious
Inquired what was happening to the area on E1 Camino and
Browning where the City has purchased property.
Staff stated that there were no plans for development at this
time, although, E1 Camino Real is to be widened. It is not
included in major arterial, or super street funding status and
alternative means of financing the widening are currently
being studied.
Commissioner Mitzman
Inquired if there had been a fiscal impact report
prepared for Lot 27 to study the effect of the project.
The Director reported that the Irvine Company has prepared a
fiscal impact analysis for that site which will be included in
the information when the project comes before the Commission.
The project will also include a development agreement which
will require City Council approval.
Inquired who the new owner was of the property at
Jamboree and Edinger.
Staff stated the new owner is California Pacific Equities.
Commissioner Vandaveer
Inquired if a traffic light could be installed at Main
and Newport for the left hand turn pocket.
Douq Anderson, Traffic Engineer, stated that the City is
looking at a number of locations for traffic improvements and
installation of left turn arrows for the next fiscal year.
Commissioner Bone
Reported that the Pankey property has closed escrow; the
purchase encompassed all the center holdings including
the apartment complexes and that there is a possibility
of Albertson's returning to the center.
Reported a bus bench smashed on Newport Avenue at the
freeway ramp and inquired if there was an emergency
number to have this type of damage repaired over the
weekend.
Douqlas Anderson suggested the best avenue of approach
was to call the police department.
Noted that there have been complaints that dog owners are
letting their dogs off leashes to run in packs at the
Sports Park and there is a safety concern expressed by
parents and other dog owners. The park area also needs
to be cleared of dog feces.
Reported that the church next to the car wash on Red Hill
Avenue has a proliferation of signs.

Commissioner Vandaveer moved, Kozak seconded, to adjourn the
meeting at 8:10 p..m. Motion carried 5-0.
The next regularly scheduled meeting of the Planning Commission is
on July 14, 1997 beginning at 7:00 p.m., City Council Chambers, 300
Centennial Way, Tustin.
