At this time members of the public may address the Commission regarding any items not on the agenda and within the subject matter jurisdiction of the Commission (NO action can be taken off-agenda items unless authorized by law). Mr. Robert A. Wehn - 18082 Lillian Way, addressed the Commission on his concerns of health risks and in particular exposure to radiation from a previously approved wireless communication facility at 18062 Irvine Boulevard. Lois Bobak, Deputy City Attorney, stated that no action could be taken with regard to the approval since there had been no appeal made; the Brown Act precluded discussion and the item was not on the agenda for this meeting. If the Commission wanted to discuss the matter, it would have to be agendized for a future meeting. Chairman Bone asked if information could be put together to address Mr. Wehn's concerns about the facility. The Director will provide a report to Mr. Wehn and to each of the Commissioners. Minutes of the Auqust 26, 1996 Planninq Commission Meetinq. Commissioner Vandaveer moved, Pontious seconded, to approve the minutes of August 26, 1996. Motion carried 5-0. PAULARINO COSTA MESA, CA 92626 ATTN: KIM KASELL 501 WEST FIRST STREET FIRST STREET SPECIFIC PLAN/COMMERCIAL THIS PROJECT IS CONSIDERED CATEGORICALLY EXEMPT (CLASS 11) PURSUANT TO SECTION 15311 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT AUTHORIZATION TO INSTALL EXPOSED NEON ON A SIGN Recommendation - That the Planning Commission adopt Resolution No. 3471 approving Design Review 96-015 authorizing the installation of exposed neon on a storefront sign. Presentation: Sara Pashalides, Associate Planner Commissioner Kozak inquired if the First Street Specific Plan included a Design Review Board. He asked if the scale of the sign was consistent with the scale of the building and the guidelines within the General and Specific Plans. Sara Pashalides stated that there was no Design Review Board for the First Street Specific Plan, but there was a separate document which contains Design Guidelines and an entire section which deals with signs. This project would be allowed 75 square feet of wall sign on that elevation and they are only proposing 48 square feet. City regulations do not dictate how much neon can be on the sign. Commissioner Bone complimented the applicant on the upgrading and landscaping made to the property. Commissioner Pontious moved, Mitzman seconded, to approve Design Review 96-015 by adopting Resolution No. 3471. Motion carried 5-0. Planning Commission Minutes September 9, 1996 Page 3 3. Planning Commission Work Proqram/Year-In-Review The Work Program represents a compilation of items and tasks to be addressed in 1996-97. The City of Tustin Planning Commission Activity 1995-96 Year in Review consists of a summation of the Planning Commission Activities for fiscal year 1995-96. Presentation: Elizabeth Binsack, Community Development Director Commissioner Bone asked if auto brokering and auto pawn brokering could also be addressed. The Director will add auto brokering and pawn to the listing. Commissioner Kozak was pleased with the presentation of the information. He suggested that the 21 topics be put in a matrix on a single page and include a title or brief description, a review date column and an action date column for use in tracking. Commissioner Pontious suggested that along with such a matrix an attachment be added to explain any changes. Commissioner Kozak inquired if the shopping cart retrieval workshops would be conducted at Planning Commission meetings. The Director stated that the workshops would be conducted with staff and members of the Tustin Pride Committee. Commissioner Kozak stated that he would like to add to the work plan an update on signs with regard to the sign code to include an inventory of the various signs throughout the City and in particular those out of compliance and an abatement program as property changes hands. Also, the Commissioner is interested in the development of the Esplanade Linear park at the old railroad right-of-way within the City. He has seen a portion which is undeveloped and inquired if there was some program to advance the development of the park. The Director the County. Commission. noted that this portion of land may actually be in She will investigate and report back to the Commissioner Kozak commented that if the property is in the County perhaps the City can inquire as to the status of development. The Director commented regarding the inventory and abatement sign issue. The project would be a significant undertaking and is not budgeted. STAFF CONCERNS: 4. Report on Actions taken at the September 3, 1996 City Council Meetinq. Presentation: Elizabeth A. Binsack, Community Development Director Staff reported that there were no planning items on the subject agenda. Planning Commission Minutes September 9, 1996 Page 4 Commissioner Vandaveer inquired as to what passed on the Laguna Gardens project. The Director stated that the Development and Disposition Agreement between the Redevelopment Agency and Developer was approved, and the entitlements would be presented to the Commission at the September 23, 1996 meeting. 5. Oral Report on Public Hearinq Noticinq Presentation: Elizabeth Binsack, Director, Community Development Department By consensus of the Commission it was agreed that the sample notice would adequately solve the problem and address the concern as originally expressed by Commissioner Mitzman. The Commission approved the sample with the addition of a cross piece to be attached to the wooden stake which would serve to keep the card stock from folding forward. COMMISSION CONCERNS: Commissioner Pontious - Commissioner Mitzman Commissioner Kozak None None Reported a number of exposed dumpsters on Newport Boulevard north of Irvine Boulevard and requested Code Enforcement action. Requested that the storm drain on Warren Avenue which is filled with debris be cleaned out and that the County be contacted to make sure the other collector areas in the City are cleared before the rains begin. Commissioner Vandaveer Inquired if all the businesses which had a sign saying "open" were required to have Design Review. Staff stated that if the "open" signs were in the window of the business and placed twelve inches back, Design Review was not necessary. Commissioner Bone Referred to the Code Enforcement memo of September 4, 1996, concerning Item No. 1, the Sports Park, and reported that the "A" frame has only been moved across the street and the situation still exists. Referred for Code Enforcement the proliferation of garage sales on weekends and stated that he would like to see Code Enforcement on duty at least Saturday mornings. Staff stated that additional part time staff is being recruited at present to specifically work on weekends. The next regularly scheduled meeting of the Planning Commission is on September 23, 1996 beginning at 7:00 p.m., City Council Chambers, 300 Centennial Way, Tustin.
