Minutes of the June 24, 1996 Planninq Commission Meetinq. Commissioner Vandaveer moved, Bone seconded, to approve the Consent Calendar. Motion carried 3-0. The Public Hearing opened at 7:05 p.m. The Public Hearing closed at 7:05 p.m. Presentation: Rosa Ceja, Assistant Planner Commissioner Bone moved, Vandaveer seconded, to approve Amendment to Conditional Use Permit 91-04 and Design Review 91-06 by adopting Resolution No. 3457 as submitted. Motion carried 3-0. REGULAR BUSINESS: 3. Use Interpretation 96-003 APPLICANT: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST': CALIFORNIA PACIFIC HOMES 1 CIVIC PLAZA, SUITE 275 NEWPORT BEACH, CA 92660 ATTN: WILLIAM L. MOORHOUS LOT 27, TRACT 13627 (PORTOLA PARKWAY, JAMBOREE ROAD, TUSTIN RANCH ROAD) EAST TUSTIN SPECIFIC PLAN; MEDIUM-HIGH RESIDENTIAL DENSITY THIS PROJECT HAS BEEN DETERMINED TO BE CATEGORICALLY EXEMPT (CLASS 3) PURSUANT TO SECTION 15303 OF THE CALIFORNIA EQUALITY ACT (CEQA) TO DETERMINE THAT THE FRONT YARD SETBACKS CAN BE MEASURED FROM THE BACK OF SIDEWALK RATHER THAN RIGHT-OF-WAY LINE Recommendation - The applicant has withdrawn the application. further action is required on this item. No Request For A Finding Of General Plan Conformance For The E1 Modena Channel Proposed Repairs APPLICANT: LOCATION: ENVIRONMENTAL STATUS: COUNTY OF ORANGE, ENVIRONMENTAL MANAGEMENT AGENCY EL MODENA - IRVINE CHANNEL BETWEEN RED HILL AND NEWPORT AVENUES AND BETWEEN THE CONFLUENCE OF NORTH TUSTIN CHANNEL TO 17TH STREET THE COUNTY OF ORANGE ENVIRONMENTAL MANAGEMENT AGENCY HAS PREPARED AND ADOPTED A NEGATIVE DECLARATION FOR THE PROPOSED PROJECT. THE MITIGATION MEASURES ARE CONSISTENT WITH THE CITY OF TUSTIN'S DEVELOPMENT STANDARDS. THE PUBLIC COMMENTS PERIOD OR NEGATIVE DECLARATION CLOSED ON APRIL 19, 1996. Recommendation That the Planning Commission approve Resolution No. 3456 finding that the proposed channel repairs are in conformity with the adopted General Plan. Presentation: Elizabeth Binsack, Community Development Director Commissioner Bone asked if the County could be contacted to respond more rapidly to graffiti cleanup on the channels. The Director stated that in forwarding information to the County, following action on this item, a letter will be included requesting County cooperation in removing the graffiti. Planning Commission Minutes July 8, 1996 Page 3 Commissioner Vandaveer asked if there was any cost te the City for these repairs. The Director stated the only cost was staff time in preparing the report. Commissioner Vandaveer moved, Bone seconded, to approve Resolution No. 3456 finding that the proposed channel repairs are in conformity with the adopted General Plan. Motion carried 3-0. STAFF CONCERNS: Report on Actions taken at the July 1, 1996 City Council Meetinq. Staff reported on the subject agenda. COMMISSION CONCERNS: Commissioner Vandaveer Reported that the balcony at 17091 Alta Dena, Apartment D, has been patched with plywood and appears to be unsafe. Since it is an egress for 2 apartments he requested a code enforcement inspection at the location as a safety precaution. Would like the hospital sign removed at Newport Avenue since the hospital is closed. Commissioner Bone Complemented Code Enforcement for their prompt action at getting landscaping to be done at the Arco Station site at Newport/Mitchell. Staff stated that although the report to the Commission on responses from the previous meeting did not include vehicles parked at the Pankey site, follow up was being carried out and this will be included in the next report to the Planning Com~,ission. ADJOURNMENT: Commissioner Vandaveer moved, Bone seconded, to adjourn the meeting at 7:15 p.m. Motion carried 3-0.
