PUBLIC HEARINGS Amendment to Vesting Tentative Tract Map 14410, Amendment to Hillside Review 95-001, Amendment to DesiGn Review 95-008 and Amendment No. 2 to Conditional Use Permit 91-008 APPLICANT/ LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: LEWIS HOMES OF CALIFORNIA MR. GARY LUQUE LOTS 7, 8, "N", "0" AND "U" OF TRACT 13627; LOW DENSITY RESIDENTIAL/HILLSIDE DISTRICT - EAST TUSTIN SPECIFIC PLAN (ETSP) THIS PROJECT IS COVERED BY A PREVIOUSLY CERTIFIED EIR (85-2) FOR THE EAST TUSTIN SPECIFIC PLAN. NO ADDITIONAL DOCUMENTATION IS REQUIRED. AUTHORIZATION TO ADD THREE ADDITIONAL PRODUCTION UNITS TO THE BUILDOUT OF A PREVIOUSLY APPROVED RESIDENTIAL DEVELOPMENT Planning Commission Minutes May 28, 1996 Page 2 Recommendation - That the Planning Commission take the following actions: 2. 3. 4. 5. Approve the Environmental Determination for the project by adopting Resolution No. 3446; Amend Hillside Review 95-001 by adopting Resolution No. 3447, as submitted or revised; Amend Design Review 95-008 by adopting Resolution No. 3448, as submitted or revised; Amend Conditional Use Permit 91-008 by adopting Resolution No. 3449, as submitted or revised; and Recommend that the City Council approve Amendment to Vesting Tentative Tract Map 14410 by adopting Resolution No. 3450, as submitted or revised. Presentation: Greg Gubman, Associate Planner The Public Hearing opened at 7:07 p.m. Gary Luque, representing Lewis Homes, stated that in the approved product line of E1 Dorado the homes will be of a size to appeal to large families. Lewis Homes have also introduced a single story element and a middle plan called an "upside down" house with kitchen, living and master bedroom upstairs and childrens bedrooms and family room downstairs. He stated that the two product lines will blend together. Since they are similar products, the street scene will be compatible between the new and old tracts. There will be full disclosure to buyers that there are two product lines in E1 Dorado. Commissioner Bone asked if Lewis Homes was aware of the two product lines last September when the application was first made. He also asked about timing on the phases and if they would be built all at once or pre-sold first. Gary Luque stated that two product lines had been contemplated at the time of the application. It is anticipated that Phase A will begin at the same time as Phase B and each phase would be built- out on speculation. The homes will not be pre-sold and they anticipate selling 3-4 per month. Commissioner Bone asked if there would be anything in the CC&R's that would address garage storage. Gary Luque stated that he was not aware of any restrictions for storage in garages but that each home has a three car garage. Dan Fox, Senior Planner, stated that the Specific Plan for East Tustin requires a minimum two car garage space to be accessible for each residential unit so that if it was found that someone was stock piling their garage, code enforcement could be implemented. Standard language should be included in the CC&R's related to the amount of parking available as well as for guest parking. The Public Hearing closed at 7:16 p.m. Commissioner Mitzman moved, Lunn seconded, to approve the Environmental Determination for the project by adopting Resolution No. 3446 as submitted. Commissioner Mitzman moved, Lunn seconded, to amend Conditional Use Permit 91-008 by adopting Resolution No. 3449 as submitted. Motion carried 5-0. Commissioner Mitzman moved, Lunn seconded, to recommend that the City Council approve Amendment to Vesting Tentative Tract Map 14410 by adopting Resolution No. 3450 as submitted. Motion carried 5-0. 3. Desiqn Review 96-014 and Variance 96-003 APPLICANT: OWNER: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: MATLIN DVORETZKY & PARTNERS MR. GARY BARDOVI SOUTHWEST DEVELOPMENT COMPANY MR. CHARLES KANE 1602 NISSON ROAD MULTIPLE FAMILY RESIDENTIAL DISTRICT (R-3) THIS PROJECT HAS BEEN DETERMINED TO CATEGORICALLY EXEMPT (CLASS 2) PURSUANT TO THE PROVISIONS OF SECTION 15302 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT 1. TO RELOCATE TWO EXISTING ON-SITE APARTMENT BUILDINGS ABOVE A PROPOSED NEW, SEMI- SUBTERRA/~EAN PARKING GARAGE. 2. TO REDUCE THE REQUIRED FRONT SETBACK FROM 15 FEET TO 7.5 FEET, AND TO REDUCE THE MINIMUM BUILDING DISTANCE REQUIREMENTS FROM 15 FEET TO 11.5 FEET. Recommendation -That the Planning Commission approve Design Review 96-014 and Variance 96-003 by adopting Resolution No. 3442, as submitted or revised. Presentation: Greg Gubman, Associate Planner Commissioner Vandaveer inquired about moving the buildings. Staff stated that the applicant submitted a construction phasing plan where the two apartment buildings would actually be moved to the front property line then moved back where they will be located permanently when the structure is completed. Commissioner Kasalek inquired if parking would be more of a problem during this construction. Staff stated that six residential units would be vacated so that there would be an off-set affect. Commissioner Lunn asked at what point in time the subsidizing for this affordable housing would expire and if after it expired when would the units be considered for conventional marketing rates. Staff stated that at this time the contract has lapsed and HUD is presently negotiating to either retain the present management to control the property or will search for someone to manage this project under a HUD contract. If HUD is not able to do this then the owner has the option of retaining the property at market rents. Planning Commission Minutes May 28, 1996 Page 4 Commissioner Bone inquired if the City could post the property for no parking on the south side in the curve. Doug Anderson Traffic Engineer, stated this situation would be re- evaluated at the time the project is completed, however, typically the outside of a curve is allowed for parking up to driveway locations. Commissioner Lunn inquired how many parking spaces would be available when the project is completed. Staff stated that the project has 248 parking spaces and although it still falls short of the ideal, the situation will be improved. The Public Hearing opened at 7:29 p.m. The Public Hearing closed at 7:29 p.m. Commissioner Bone requested that the applicant inspect the balconies at this complex since some of these balconies are full of debris. Commissioner Vandaveer moved, Lunn seconded, to approve Design Review 96-014 and Variance 96-003 by adopting Resolution No. 3442 as submitted. Motion carried 5-0. 4. Conditional Use Permit 95-027 APPLICANT: OWNER: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: LINDA EVANS FITNESS CENTERS, INC. MIKE MCNEESE, DIRECTOR OF OPERATIONS THE RREEF FUNDS MICHAEL F SEVERSON 1162-1192 IRVINE BOULEVARD RETAIL COMMERCIAL (C-i) THIS PROJECT HAS BEEN DETERMINED CATEGORICALLY EXEMPT (CLASS 1) PURSUANT TO THE PROVISIONS OF SECTION 15301 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. AUTHORIZATION TO ESTABLISH A HEALTH CLUB WITHIN AN EXISTING TENANT SPACE IN TUSTIN HEIGHTS CENTER. Recommendation -It is recommended that the Planning Commission approve Conditional Use Permit 95-027 by adopting Resolution No. 3441, as submitted or revised. Presentation: Greg Gubman, Associate Planner Commissioner Bone asked if there were only three showers and if there were any lockers available. Staff stated that there are three showers and the lockers are not shown on the plans but that this is a matter deferred to the expertise of the marketing program of the Linda Evans facility. The Public Hearing opened at 7:35 p.m. Michael F. Severson, District Manager for Orange County, representing RREEF Funds, stated that this women only Linda Evans Fitness Center affords a cross shopping opportunity for the women who frequent this center. Parking is more than adequate and RREEF is supporting the use. NO ADDITIONAL DOCUMENTATION IS REQUIRED. AUTHORIZATION TO ADD THREE ADDITIONAL PRODUCTION UNITS TO THE BUILDOUT OF THE EXISTING RESIDENTIAL DEVELOPMENT Recommendation - That the Planning Commission continue this project to the June 10, 1996 Planning Commission meeting to allow the applicant and residents additional time to discuss and resolve outstanding concerns. Presentation: Daniel Fox, Senior Planner Commissioner Mitzman asked for an update on the meetings held with the applicant, the homeowners and staff. Dan Fox, Senior Planner, stated that there have been two meetings with some additional options and alternatives from the applicant, however, discussion is still on-going. Next week there should be a more firm proposal from the applicant. This information will be available by the June 10, 1996 Planning Commission meeting. Commissioner Bone moved, Vandaveer seconded, to continue this item to the June 10, 1996 Planning Commission Meeting. Motion carried 5-0. REGULAR BUSINESS: 6. Use Interpretation 96-003 APPLICANT: LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: CALIFORNIA PACIFIC HOMES WILLIAM L. MOORHOUS LOT 27, TRACT 13627 MEDIUM-HIGH DENSITY RESIDENTIAL -ETSP THIS PROJECT HAS BEEN DETERMINED TO BE CATEGORICALLY EXEMPT (CLASS 3) PURSUANT TO SECTION 15303 OF THE CALIFORNIA EQUALITY ACT (CEQA) TO DETERMINE THAT THE FRONT YARD SETBACKS CAN BE MEASURED FROM THE BACK OF SIDEWALK RATHER THAN RIGHT-OF-WAY LINE Recommendation - That the Planning Commission determine by Minute Motion that front yard setbacks shall be measured from the Right- of-Way line as specified in Section 3.6.3.3.a of the East Tustin Specific Plan. Desiqn Review 96-018 APPLICANT/OWNER LOCATION: ZONING: ENVIRONMENTAL STATUS: REQUEST: NEXTEL COMMUNICATIONS 36 AUTO CENTER DRIVE PLANNED COMMUNITY COMMERCIAL THIS PROJECT HAS BEEN DETERMINED TO BE CATEGORICALLY EXEMPT (CLASS 3) PURSUANT TO THE PROVISIONS OF SECTION 15303 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. APPROVAL OF A 60-FOOT HIGH MONOPOLE WITH 5-FOOT HIGH ANTENNAS AND ACCESSORY STRUCTURE. Recommendation - That the Planning Commission approve Design Review 96-018 by adopting Resolution No. 3451, as submitted or revised. Presentation: Rosa Ceja, Assistant Planner Commissioner Bone inquired if this was a cellular structure. The Director stated the monopole is very traditional and similar to the one constructed at west Sixth Street. In the future these monopole structures and similar cellular facilities will be subject to the approval of a Conditional Use Permit by the Planning Commission. The Urgency Ordinance passed by the City Council requires a Conditional Use Permit approval for all major communication facilities. Minor facilities can be approved administratively. Commissioner Vandaveer moved, Mitzman seconded, to approve Design Review 96-018 by adopting Resolution No. 3451 revised as follows: Condition 1.6 shall read, "Prior to the issuance of building permits, the applicant shall provide to the Community Development Department, documentation issued by the California Public Utilities Commission confirming that Nextel Communications' Enhanced Specialized Mobile Radio (ESMR) is a public utility." The Director reported on the subject agenda· 1996 City Council COMMISSION CONCERNS: Commissioner Lunn None Commissioner Mitzman None Commissioner Vandaveer Asked for an update on the status of the bollard lights at E1 Camino Real and Main Street. Doug Anderson, Traffic Engineer, stated that the Public Works Department is still working on the project. Commissioner Bone - Inquired about the increasing number of blue tarps on the condominium roofs at E1 Camino between Park Center and Tustin Ranch Road. The Director stated that she will find out the re-roofing schedule and report back to the Commissioner. - Asked what happened to the proposed project of Al's Woodcraft. Dan Fox, Senior Planner, stated that the Community Development Department will look into matter and report back. - Reported that the state of the City luncheon has been sold out and there is now a waiting list.
